1 Introduction
1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for the lottery (the “Lottery”) which is promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies listed on its website www.healthlottery.co.uk (the “Website”).
1.2 The correspondence address is The Health Lottery ELM Limited, Northern & Shell Building, 10 Lower Thames Street, London, EC3R 6EN.
1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence numbers 000-026057-R-309179 and 000-026057-N-309180.
1.4 The Lottery operates as a series of society lotteries under the Gambling Act 2005, (“The Act”) each or all being referred to as ”The Health Lottery”, depending on the context. Operating this way allows costs to be kept to a minimum so that larger sums of Health Lottery funding can be allocated to local health related projects, and, unlike other lotteries, every single part of Great Britain gets a fair share of the pot.
1.5 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company (“CIC”). Each CIC represents certain Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and share in the proceeds. Money is then donated to support health related projects within their respective local areas.
1.6 A complete list of the CICs promoting the society lotteries can be seen at Annex A.
1.7 Players should be aware that all the participating CICs are independent companies. THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and good causes they support is available. It should also be noted that the allocation of funds to good causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity People’s Health Trust and not by THL.
1.8 At least 20% of the proceeds of each Lottery shall be paid to health related good causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.
1.9 All entries into and participation in the Lottery is strictly governed by these T&Cs. By entering the Lottery, a Player agrees to be bound by the T&Cs in force on that date. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.
1.10 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the Website, and THL will provide a copy by post on receipt of a stamped address envelope at the address in 1.2. Alternatively a copy of the shortened form of the T&Cs can be obtained on request from a Health Lottery Participating Retailer.
1.11 If and when changes are made to the T&Cs THL will use its database of registered Players to notify all those Players for whom it has email details. THL will also distribute a revised version of its T&Cs to all Participating Retailers. THL will endeavour to give eight weeks’ notice of any such change, although there may be occasions where this is not possible. [top]
2 Definitions
2.1 Any words within these T&Cs which start with a capital letter shall have the following meanings:
(a) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.
(b) “Lottery Draw” or “Draw” means the weekly lottery draw conducted by The Health Lottery every Saturday after 19:30, when sales will be closed for each week’s draw;
(c) “Lottery Ticket” and “Ticket” means the ticket which is purchased by a Player in anticipation of a Lottery Draw and which carries the numbers selected by the Player for entry into the Lottery;
(d) “Participating Retailer” means a retailer or store that has agreed to sell Health Lottery tickets on behalf of THL and the CICs.
(e) “Player” means a person who purchases a Lottery Ticket in accordance with these T&Cs; and
(f) “Prize” means the prize monies that may be won in the course of the Lottery Draw. [top]
3 Conditions of Entry
3.1 To enter the Lottery and to be eligible to win a Prize, Players:
(a) must be 16 years of age or over; and
(b) must comply with these T&Cs and any other rules of the Lottery notified by THL.
3.2 Excluded Persons are ineligible to participate in the Lottery and shall not be entitled to receive any Prizes.
3.3 All entry instructions communicated by THL shall form part of the Game Rules of the Lottery which are available on the Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2.
3.4 In purchasing a Ticket, Players acknowledge and agree that:
a) they may be entered into a Lottery Draw which is not promoted by the CIC representing their geographic region; and
b) part of the Ticket price will go towards Good Causes (Good Cause means the funding of health related good causes in England, Scotland and Wales).
3.5 By accepting the Prize from THL, Players warrant that they:
(a) are not a director or an employee of THL, the CICs, People’s Health Trust, or a key IT contractor or supplier;
(b) are not a spouse or dependent of any person described in 3.5(a); and
(c) are eligible to win a Prize under clause 3.1; and
(d) fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.
For the avoidance of doubt any Participating Retailers who act as direct agents of the CICs and use PayPoint, e-pay or Payzone terminals and software to transact Lottery Tickets will not be deemed to be agents of THL for the purposes of this clause and will be entitled to buy Tickets and receive Prizes from THL.
3.6 THL will have sole and absolute discretion as to whether to accept any entry to the Lottery.
3.7 THL will rely on its own technical logs and records when determining whether the Player is eligible to receive a Prize.
3.8 The Player accepts that the Ticket they purchase in any week may not benefit directly the region in which they bought the Ticket. THL aims to ensure that different CICs representing different regions take it in turns to participate in The Health Lottery each week to ensure that across the course of a year, every participating region of the UK will benefit from monies raised as equally as possible.
3.9 Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Act and any relevant regulations made thereunder from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time. Any amended Rules will be published on the Website at least 28 days prior to them taking effect. [top]
4 How to Enter the Lottery
4.1 Players enter the Lottery either by purchasing a paper Ticket from a retailer authorised by THL or by using the Website to purchase an online Ticket. Tickets will normally cost £1 per line per Draw. Participating Retailers may require proof of age or other identification to be shown before the Ticket will be sold. THL reserves the right to introduce new channels.
4.2 The Player must choose five different numbers, each of which must be between 1 and 50, or may prefer to be allocated at random five different numbers in that range (a “Quick Pick”).
4.3 The Player may choose to activate a Health Lottery Playcard (the “Playcard”) with their chosen five number selections for any play. Health Lottery Participating Retailers can activate a Playcard or Players may activate their Playcard by SMS, phoning the Contact Centre or on the Website. The activation of a Playcard will result in one or more selections of five numbers (up to a maximum of ten) being recorded on The Health Lottery account record designated by the unique number on the Playcard in question.
4.4 Following activation, a Playcard may be used to purchase Tickets for future Draws.
4.5 A Ticket will be valid only for the Draw(s) to be held on the date(s) shown on the face of the Ticket. Players may choose to purchase a Ticket which enters the Player into the Lottery for up to eight weeks in advance.
4.6 It is the Player’s responsibility to check at the time of purchase that the date of the Draw and the numbers shown on the Ticket are accurate.
4.7 Cancellations are allowed only under exceptional circumstances. Any cancellation or reversal will need to be completed at the same location and on the same terminal as the original transaction. THL will allow cancellations and reversals for both a Ticket sale and a payout. In e-pay and Payzone Retailers , and in Participating Retailers using their own EPOS system to sell Tickets there will be a 30 minute timeout after which a reversal and cancellation cannot be performed at the terminal. PayPoint Retailers will only allow a cancellation within 10 minutes of the relevant transaction provided that no other transactions have been made in the interim.
4.8 For the avoidance of doubt, a Player may not seek cancellation of a Quick Pick Ticket if the numbers selected are not to his or her liking.
4.9 The Player is solely responsible for ensuring that the Ticket remains safe and in a good and legible condition. The Ticket is sole evidence of entry into a Draw and must be in the possession of a Player to enable them to claim a Prize. The Playcard cannot be used to claim a Prize or be relied upon as evidence of entry into a Draw.
4.10 Subject always to clause 9.2, THL accepts no responsibility for lost, stolen, damaged or defaced Tickets. [top]
5 Playing the Lottery Online
5.1 Online Players of the Lottery are required to provide THL with their name, date of birth, address, contact details and bank details before an online registration will be processed. In order to play online Players must have a GB registered debit card registered at a GB address. Identity checks will be carried out to confirm that the player is at least 16 years old.
5.2 Registered online Players will be provided with an e-wallet in which they may deposit funds which they wish to use to participate in the Lottery Draws. No more than £500 may be deposited in the e-wallet in a single transaction. Players can only make payments by Debit Card which will be made to Health Lottery Financial Ltd (“HLFL”), a sister company of THL which handles all financial transactions for THL and the CICs.
5.3 Online Players can play by subscription using Direct Debit (“Subscription Players”). The Direct Debit Guarantee applies to all Direct Debit arrangements set up by the Players. Direct Debits will be collected by HLFL.
5.4 No online Player may purchase more than £40 of Tickets for any single Lottery Draw.
5.5 No online Player will be permitted to deposit more money if the balance in their e-wallet is more than £2,000.
5.6 THL reserves the right to impose such cooling-off periods on the use of deposited monies as it considers appropriate and will notify the same to Players before the deposit is accepted.
5.7 THL reserves the right to terminate a Player’s online account at any time, at its absolute discretion. Upon the termination of the online account, all monies held by THL on behalf of the Player will be returned to the Player’s bank account within 5 working days.
5.8 Players may be asked if they wish to be contacted for advertising, promotional and marketing purposes. If Players wish to be removed from THL’s mailing list, they should contact THL by email at unsubscribe@healthlottery.co.uk or call the Health Lottery Contact centre on 0844 375 55 55*. [top]
6 The Lottery Draw and Prizes
6.1 The Lottery Draw will be broadcast, as advertised, on a weekly basis. THL reserves the right to change the broadcast arrangements for the Draw from time to time and will notify Players of any such change either directly, if they are online Players, or through notification posted on the home page of the Website.
6.2 The names of the participating CICs which will benefit from the Draw in any one week will be displayed on the Website and the relevant CIC name will also appear on the Ticket. Tickets for more than one Draw will clearly display the date of all Draws and the relevant CIC for each Draw.
6.3 The results of any Lottery Draw published on the Website or in any other source shall be for information purposes only and a Prize shall only be awarded to a winning Ticket which has the number(s) recorded at the Draw itself, by THL and an independent auditor.
6.4 In the Lottery Draw, five numbers will be drawn at random by an approved ball machine from the range between 1 and 50 (the “Winning Numbers”).
6.5 Subject to this clause 6, the Prizes paid to the holders of Tickets with Winning Numbers in the Lottery Draw will be as follows: if three of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £50. If four of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £500. If five of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of up to £100,000 (the “Jackpot”). Only one Prize may be claimed in respect of each entry made to the Lottery Draw.
6.6 Players who win a Prize of £50 with a paper Ticket may collect their Prize from any Participating Retailer which sells Tickets for the Lottery Draw. Players who win a Prize in excess of £50 with a paper Ticket must contact THL on 0844 375 55 55* in order to claim their Prize. THL will only pay out Prizes in excess of £50 by cheque or electronic transfer to a UK bank account. THL reserves the right to pay Prizes in excess of £50 by means of any new payment method that becomes available in the future.
6.7 The Player is responsible for ensuring that the full £50 Prize is paid by the retailer for a match 3 balls win at the time the Ticket is validated.
6.8 No Prize will be paid on a Ticket that has been forged, altered, damaged or defaced in any way.
6.9 No Prize will be paid on a Ticket that fails THL’s validation process.
6.10 Online players who win from £50 up to £500 may collect their Prize(s) through their Health Lottery online account.
6.11 Players who win a Prize in excess of £50 must contact The Health Lottery on 0844 375 55 55* in order to claim their Prize. Subscription Players will automatically receive notification from THL of their Prize.
6.12 Should the total sum of Prizes due for payment in respect of any Lottery Draw exceed £15,000,000, THL reserves the right to reduce the sum of the Prizes distributed to Players. In such circumstances, THL will reduce the Jackpot and £500 Prizes in proportion so as to bring the total Prize payout to a minimum of £15,000,000.
6.13 In the event that the aggregate of the £50 Prizes due for payment in respect of any Lottery Draw exceeds £12,000,000, and the total Prize payout exceeds £15,000,000, THL reserves the right to reduce the Jackpot, £500 and £50 Prizes in proportion in order to bring the total sum of Prizes paid to a minimum of £15,000,000.
6.14 In the event that the total value of Tickets sold of any constituent lottery in the Lottery Draw are less than £1,000,000 the Jackpot Prize for a Player’s Ticket in which five of the Winning Numbers are matched will be the greater of £25,000 or 10% of the total value of Tickets sold of that particular lottery.
6.15 THL reserves the right to change the Prize sums paid to Players without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.
6.16 Winning Players may be required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.
6.17 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned immediately to THL.
6.18 THL will use its reasonable endeavours to provide the Prize payment to the Player within fourteen days of receiving the Player’s identification documents but will not be liable for late delivery.
6.19 Tickets will expire if the Prize is not claimed within 180 days following the day of the Draw and the Prize will not be paid.
6.20 There will be no substitutions for the advertised Prizes and the Prizes are not transferable.
6.21 Each winning Player is responsible for paying any and all taxes on any Prize won.
6.22 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their written consent. [top]
7 Self Exclusion
7.1 Any Player may opt at any time to be excluded from purchasing Tickets for future Lottery Draws by visiting the Website or a Participating Retailer. For online Players at the start of the period of self-exclusion (the “Exclusion Term”), all monies held by THL in the Player’s e-wallet will be returned to the Player and the online account will be suspended.
7.2 Players may choose the length of the Exclusion Term, subject to a minimum period of six months. During the Exclusion Term, they will not be permitted to access the account held with THL or to purchase any Tickets using that account.
7.3 THL will not contact the Player at the expiration of the Exclusion Term. The Player may reinstate the account held with THL by contacting info@healthlottery.co.uk , although a cooling-off period of one week will be imposed by THL before the account becomes active.
7.4 The Player may choose to enter another Exclusion Term at any time.
7.5 Players may choose to enter an opt-out scheme under which they will not receive marketing materials from THL. Where THL communicates with its Players by email, each message will include a brief description of the way that the recipient may notify THL that they wish communications to cease.
7.6 THL will remove from its marketing lists the details of any Player who, upon receipt of unwanted marketing material, calls THL’s Contact Centre or sends an email with the relevant details to unsubscribe@healthlottery.co.uk . If Players no longer wish to receive SMS based marketing, they must text the word STOP in reply to the message sent by THL.
7.7 Players should play responsibly. Information on how to gamble responsibly and how to access information about, and help in respect of, problem gambling can be found on the website or be sending a stamped addressed envelope to the address in 1.2. 8 Limitation of The Health Lottery’s Liability and Reservation of Rights
8.1 Nothing in these T&Cs shall exclude or limit THL’s liability:
(a) for death or personal injury resulting from THL’s negligence; or
(b) for fraudulent misrepresentation; or
(c) for liability that cannot be excluded or limited by law.
8.2 Subject always to clause 8.1 neither THL nor any of the societies participating in the Health Lottery from time to time shall be liable to a Player for any loss or damage suffered by a Player arising from:
(a) any failures or delays in any delivery methods (including postal services) used by THL or the Player from time to time.
(b) any event which THL believes is beyond their reasonable control.
and in addition;
(c) the Lottery is provided on an “as is” and “as available” basis and no representations or endorsements of any kind are made; and
(d) all warranties, conditions and guarantees relating to the Lottery made by or on behalf of THL, whether express or implied by law, in the course of dealing or otherwise, are excluded to the maximum extent permitted by law.
8.3 THL is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Lottery for:
(a) loss of revenue, contract, profits, business or anticipated savings or loss of data;
(b) any special or indirect or consequential losses; or
(c) any loss of goodwill or reputation.
8.4 THL does not guarantee that use of the Website, telephone system, broadcast or live transmission will be uninterrupted, timely and / or error-free.
8.5 Subject to clause 8.1, THL’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player.
8.6 THL is not responsible for any websites which may be visited via hyperlinks provided on the Website. Visitors to and transactions made on such websites are conducted entirely at the site user’s own risk.
8.7 THL reserves the right to exclude any Player from the Lottery in the event that THL believes in its sole discretion that the Player may be using technology to gain an unfair advantage over other Players of the Lottery. [top]
9 Liability of Players
9.1 Players agree to fully indemnify THL in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by THL due to the Player’s misuse of the Website.
9.2 Nothing contained in these T&Cs shall affect the statutory rights of any Player. [top]
10 Complaints
THL’s Complaints Procedure is published on the Website. Players should email THL on help@healthlottery.co.uk or call the Contact Centre on 0844 375 55 55* in the event of a complaint or to express any dissatisfaction with any aspect of The Health Lottery. [top]
11 Dispute Resolution
If a complaint is not resolved to a Player’s satisfaction by the use of THL’s Complaints Procedure, THL will refer the matter to an independent adjudicator through the CEDR (Centre for Effective Dispute Resolution, International Dispute Resolution Centre,70 Fleet Street,LondonEC4Y 1EU). [top]
12 Intellectual Property
All intellectual property rights generated as a result of the operation of the Lottery shall be the property of THL and Players agree to take all steps (at THL’s cost) to vest in THL any intellectual property which the Player creates in the course of entering the Lottery. [top]
13 Data Protection
All information provided by Players to THL for the purposes of the Lottery will be stored, managed and used in accordance with current Data Protection legislation and also with the THL’s Privacy Statement as posted on the Website. THL’s Privacy Statement forms part of these T&Cs. [top]
14 Governing Law
These T&Cs are governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts. [top]
15 Insolvency
The lottery monies managed by THL and HLFL on behalf of the CICs are ring-fenced and covered by a Declaration of Trust of which the CICs and the Players are the beneficiaries. In the event that THL or HLFL are declared insolvent, the lottery funds are protected and the creditors of THL or HLFL will have no recourse to the lottery funds held on trust for the CICs and the Players.

The Terms and Conditions for playing the Health Lottery Game (the “Lottery”) which is promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies listed on its website www.healthlottery.co.uk.
1.1The Health Lottery Game played at a Retailer, via the Health Lottery Website or by Online or Offline Direct Debit is governed by the Terms & Conditions and the Game Rules.
1.2 The Lottery operates as a series of society lotteries under the Gambling Act 2005, (“The Act”) each or all being referred to as ”The Health Lottery”, depending on the context. Operating this way allows costs to be kept to a minimum so that larger sums of Health Lottery funding can be allocated to local health related projects, and, unlike other lotteries, every single part of Great Britain gets a fair share of the pot.
1.3 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company (“CIC”). Each CIC represents certain Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and share in the proceeds. Money is then donated to support health related projects within their respective local areas.
1.4 A complete list of the CICs promoting the society lotteries can be seen at Annex A.
1.5 Players should be aware that all the participating CICs are independent companies. THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and good causes they support is available. It should also be noted that the allocation of funds to good causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity People’s Health Trust and not by THL.
1.6 At least 20% of the proceeds of each Lottery shall be paid to health related good causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.
1.7 All entries into and participation in the Lottery is strictly governed by these T&Cs and the Game Rules. By entering the Lottery, a Player agrees to be bound by the T&Cs in force on that date. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these Game Rules & T&Cs have been breached.
1.8 THL reserves the right to amend these T’s & C’s from time to time. The current version will be posted on the Website, and THL will provide a copy by post on receipt of a stamped address envelope at the address in 1.1. Alternatively a copy of the shortened form of the T&Cs can be obtained on request from a Health Lottery Participating Retailer.
1.9 These T’s & C’s ("Terms and Conditions") apply to all Games played via the Health Lottery Website, or via Direct Debit.
1.10 Only by Registering to Play and accepting the Terms and Conditions, can a Player access Games on the Health Lottery Website or play by Direct Debit.
1.11 By accepting the Prize from THL, Players warrant that they:
a) are not a director or an employee of THL, the CICs, People’s Health Trust or a key IT contractor or supplier;
b) are not a spouse or dependent of any person described in 1.11(a); [top]
Any words within these Rules which start with a capital letter shall have the following meanings:
‘Cancelled Draw'
means any Draw which does not take place by reason only of the expiry, suspension or revocation of either the Company's Licence from the Gambling Commission.
'Central Computer System'
means the computer systems used by the Company from time to time to operate Health Lottery games.
'Claimant'
means a Player or Direct Debit Player who submits a claim for a prize payment within the applicable claim period.
'Commission'
means the Gambling Commission, being the body that regulates the Lottery.
'Company'
means The Health Lottery ELM Limited, Northern & Shell Building, 10 Lower Thames Street, London, EC3R 6EN
‘Claim Form’
means the form that will be supplied to a claimant to be completed as part of the process for claiming a prize.
'Entry'
means a chance or entry in the Game which has been registered as an entry on the Central Computer System.
‘Excluded Person’
means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.
‘Key IT Contractor’
means contractors involved in the development and support of the central system software and infrastructure
‘Self Excluded Person’
Means any person who has chosen to exclude themselves from the Lottery any reason, either via the Website, Contact Centre or in a Retailer in accordance with the Act.
'Game'
means The Health Lottery Game.
'Direct Debit'
The entitlement to participate in some Draw-Based Games for a multiple number of Draws in accordance with Rule.
'Player'
means a member of the Playing Public who purchases a ticket, who is eligible to play the Game in accordance the Terms and Conditions relating to this Game.
'Prize'
means a prize won by a Player in the Game. [top]
3. Status of these Terms and Conditions
3.1 Status of Terms and Conditions
These Terms and Conditions, the Privacy Policy (which is incorporated by reference into these Terms and Conditions), the applicable Games Rules, detail the full extent of the obligations and liabilities of the Company to On-line Players and Direct Debit Players.
3.2 Precedence
To the extent of any conflict or inconsistency, the order of precedence for these Terms and Conditions, the applicable Games Rules, shall be in descending order as follows:-
(a) the applicable Games Rules;
(b) these Terms and Conditions (excluding, for this purpose, the Privacy Policy);
(c) the Privacy Policy.
3.3 Changes to Terms and Conditions
The Company may change these Terms and Conditions (including the Privacy Policy), and/or the Games Rules and at any time. Any changes shall be binding on on-line Players and Online Direct Debit Players and will take effect immediately on notification. All Players must agree that they will be bound by such changes when they next claim a Prize or on the next occasion they play the Games or access their Account following the changes taking place whichever is the sooner. 4.1 Criteria for Registration
(a) Any person wishing to play the Health Lottery On-line must be located in Great Britain;
(b) Any person wishing to play the Health Lottery must aged 16 years or older;
(c) Any person wishing to play the Health Lottery On-line must supply their debit card details which must be linked to bank account (or building society) that is based in Great Britain (GB) for which they are an authorised user, and must also be linked to a GB address.
(d) When registering using the bank card referred to in (c) above must not been reported as lost or stolen and may to be used to open any more than one Account;
4.1.1 The Company reserves the right to refuse a Registration at its absolute discretion.
4.1.2 The Company reserves the right to carry out checks or request information from Players from time to time during or after registration to verify that the Players and the information supplied by Players meet the criteria set out in this clause. No Prizes will be paid to a Player if the criteria set out in this are not met, or if they are ineligible to play for any reason. In carrying out these checks, personal information provided may be disclosed to a credit reference agency, which may make a record of that search.
4.2 How to Register
4.2.1 Players will be required to supply certain information to the Company via a series of web screens which this information will be used by the Company to determine whether or not the Player meets the criteria set out in Clause 4.1. This information will include, but is not limited to, your
(a) name;
(b) home address details;
(c) date of birth;
(d) debit card details;
(e) e-mail address;
4.2.2 You must be located in Great Britain when applying to become an Online or Direct Debit Player.
4.2.3 If you supply debit card details relating to a jointly owned bank (or building society), you accept that Prizes won may be paid into that joint account.
4.2.4 Once the Company has verified the information supplied during the Registration process detailed above you will be asked to enter a User Name and Password.
4.2.5 On successful completion of this you will be able to play Games. If the Company subsequently discovers that a Player was not or is no longer eligible to open an Account, the Company reserves the right to suspend or terminate that Account.
4.3 Password Security
You are responsible for keeping your details secure at all times and take steps to prevent unauthorised use of your Account. You must inform the Company immediately of any unauthorised access to your Account.
4.4 Re-setting of Passwords
A Player, or Direct Debit Player may use the "Forgot Sign-In Details" section of the Site to reset his Password or re-establish a user name at any time, provided that they are able to provide certain security information as requested by the Company.
4.5 Processing of Player Related Information
The processing of a Player's Information will be undertaken by the Company in accordance with the Privacy Policy. [top]
5.1 Placing funds into your Account and Limits
5.1.1 Once registered, you will be able to credit funds from the bank (or building society) account specified by that Player to your Account.
5.1.2 You will be able to place £5 as a minimum and £500 maximum into your Account at any one time and in any one transaction.
5.1.3 The Company will check at the point that you attempt to place money into your account using the debit card details that you supply whether or not you have sufficient funds in your bank (or Building Society) account,
5.1.4 You will only be permitted to place a maximum of £500 into your wallet at any time or 24 hour period using your Debit Card. You will not be permitted to place any more than £2000 into your On-line account.
5.1.5 You will be limited to £40 for any one Lottery Draw.
5.2 Withdrawing of Funds from your On-Line Account
You will be permitted to withdraw Funds from your on-line account back onto the Debit Card registered on the Central Computer System only. The minimum withdrawal amount is £10 unless your account balance is less than £10 in which case you will be able to withdraw the whole balance. Should your debit card be lost or should you wish to change your registered debit card before it has expired you will be required to contact the Health Lottery Contact Centre (Contact Centre)on 0844 375 5555. Before your new cards details can be added you will need to withdraw any funds in your account. Should your debit card expire you may update your account with the details of your new card through your account on the website.
5.3 Closure of an Account/Ceasing to play by Direct Debit.
5.3.1 A Player may close an Account at any time, at which time the Company will return any Funds to the bank (or building society) account registered on the Central Computer system, or return other means should that bank account no longer be active for any reason.
5.3.2 If the Company is unable to return funds to the registered bank account or by any other agreed means, the Company will retain the funds for a period of 3 years. At the end of that period the Company reserves the right to donate the funds to the Peoples Health Trust or any other good cause as determined by the Company. The Player may contact the Company at any point in that three year period, at which time the Company will use all reasonable endeavours to refund the player providing proof of ownership and identity can be established.
5.3.3 A Direct Debit Player may cease playing by Direct Debit at any time. Direct Debits can be cancelled for any purchases that have not yet been placed in a draw. Direct Debit payments will be collected monthly on either the 1st of or the 15th day of the month, where that day falls on a bank holiday or weekend the payment will be taken on the next working day. In the event that a player who plays by Direct Debit chooses to cancel a Direct Debit the payment will be cancelled for the next collection cycle. Any plays for which money has been collected that have been entered into the draw cannot be cancelled under any circumstances.
5.4 Termination/Variation/Suspension of Accounts
5.4.1 The Company may terminate, vary or suspend the provision of the Games, access to a Player's Account’s without prior notice:-
(a) on breach of these Terms and Conditions, the relevant Game Rules; or
(b) for maintenance work required to upgrade or update the Central Computer System; or
(c) if the Company ceases to offer the Games; or
(d) for any other reason at the Company's sole discretion.
5.4.2 On termination of an Account, the Company will return the Player's Funds to the bank (or building society) account, details of which are held by the Company on the Central Computer System in respect of that Player, or return the Funds to the relevant Player by other appropriate means using all reasonable endeavours. In the event that a refund cannot be made the provisions made in Clause 5.3 will apply.
5.5 Player initiated Charge backs
5.5.1 If a Player informs any bank (or building society) that unauthorised use of a debit card has been undertaken in relation to an Account and the bank (or building society) requests that the relevant sums be returned by the Company to the relevant Player's bank (or building society) account ("Chargeback"), the Company will suspend the Player's Account and ask the Player to contact the Contact Centre on 0844 375 5555.
5.5.2 The Company reserves the right to debit the Player's Account with the amount of the Chargeback together with any funds that the Player has utilised that are subject to that Chargeback. If that debit results in a negative balance in the relevant Player's Account, the Company reserves the right to recover that balance from the Player at which point the Company will terminate that Account.
5.6 Accounts that become Dormant
If an Account becomes Dormant and there are funds on that Account, the Company will use all reasonable endeavours to contact that Player or their representatives where appropriate. If the Company is unable to contact the Player, it may at its discretion, return the Funds, to the bank (or building society) supplied by the Player using the debit card details as held by the Company on the Central Computer System In the event that a refund cannot be made the provisions made in Clause 5.3 will apply.
5.7 Debit Card Expiry
5.7.1 It is the responsibility of the Player to ensure that the information supplied to register to play the Health Lottery On-line is kept up to date.
5.7.2 In the event that a Player's debit card expires, the Company will use its reasonable endeavours to return the Player's Funds to his bank (or building society) account. If the Company is unable to return the Player's Funds, the Company shall use its reasonable endeavours to alert the Player of this and the Player should, in these circumstances, contact the Contact Centre in order to arrange an alternative appropriate means for the Company to return his Unutilised Funds. 6.1 Provision and use of Equipment
Players are required to provide all equipment and technology necessary to access the Internet and the games/products/services that the Company makes available via the Health Lottery Website.
6.2 Jurisdictions other than the Great Britain
Players and Direct Debit Players agree that playing the Games whilst located in any jurisdiction other than the Great Britain is strictly prohibited. The Company has the right to terminate a Player's Account withhold any Prize to any Player or Direct Debit Player in respect of any Games played whilst located in any jurisdiction other than Great Britain.
6.3 Use of Content
For the avoidance of doubt, the Company is the owner or licensee of all the copyright, trade marks and other intellectual property rights in, to and in respect of the Site.
6.4 Warranties and Indemnities
6.4.1 Each Player and or Direct Debit Player warrants that they will only use their Account, play the Games and use the Site in accordance with these Terms and Conditions and in an appropriate and lawful manner and shall not authorise or permit any other party to:
(a) receive, access or transmit any content which is obscene, pornographic, threatening, racist, menacing, offensive, defamatory, in breach of confidence, in breach of any intellectual property right (including, without limit, copyright) or otherwise objectionable or unlawful; or
(b) knowingly or recklessly transmit any content (including, without limit, viruses) through the Site and/or the Interactive System which shall cause, or be likely to cause, detriment or harm, in any degree, to computer systems owned by the Company or others; or
(c) hack into, make excessive traffic demands on or cause any impairment of the functions of any computer system, deliver or forward chain letters, "junk mail" of any kind, surveys, contests, pyramid schemes or otherwise engage in any behaviour intended to inhibit others from playing the Games or using the Site and/or the Interactive System or any other website, or which is otherwise likely to damage the reputation or business of the Company or of any third party.
6.4.2 Each Player and or Direct Debit Player agrees to indemnify the Company against any costs, losses, damages and expenses which the Company may suffer or incur arising out of or in relation to any claim, legal proceeding or demand made by any third party due to or arising out of that Player's wrongful or negligent use of his Account, playing of the Games, access to the Site, or breach by that Player of these Terms and Conditions.
6.5 Decisions of the Company Binding
The Company’s decisions as to whether or not a Play is a winning Play or in respect of any other matter or dispute arising from the payment or awarding or non-payment or non-awarding of prizes shall be final and binding upon all Players and any other person or persons having any interest in the matter or dispute. In the event of a dispute in respect of a winning Play, Claim Form, or the payment or awarding of any prize, the Company may withhold payment of the prize and/or make an equivalent payment into court until the dispute has been resolved.
6.6 Law
These Rules and Terms & Conditions and the rights and obligations of the Company, Players and Direct Debit Players set out herein shall be governed by and construed in all respects in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts. 2 Definitions

‘Excluded Person’
means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. 'Game'
means The Health Lottery Game.
‘Quick Pick'
means a Selection consisting of five different numbers which, instead of being selected by a Player, are selected on a random basis by the Company's Central Computer System on behalf of that player.
‘Lottery Ticket’ and ‘Ticket’
means the ticket which is purchased by a Player in anticipation of a Health Lottery Draw and which carries the numbers selected by the Player for entry into the Lottery.
'Multi-draw'
means a facility to play the Game for a number of Draws with the purchase in advance of one Ticket, the number and frequency of such Draws available for selection by Retail Players using the facility being as determined by the Company from time to time.
'Direct Debit'
The entitlement to participate in Games for a multiple number of Draws in accordance with these Rules and Terms and Conditions.
'Direct Debit Player'
A person whose application to play Game by Direct Debit has been accepted by the Company.
‘Lottery Draw’ or ‘Draw’
means the weekly lottery draw conducted by The Health Lottery every Saturday after sales have been closed for each week’s draw;
‘Participating Retailer’
means a retailer or store that has agreed to sell Health Lottery tickets on behalf of THL and the CICs.
'Play Card'
means a printed card made available by the Company which may be issued by certain Retailers which can be used by players to make one or more number selections with which a Retail Player may make an entry into the Game at a Terminal.
'Play Card Selection'
means one set of five numbers chosen between 1-50 by a Player which have been associated with a Play Card.
'Player'
means a member of the Playing Public who purchases a ticket, who is eligible to play the Game in accordance the Terms and Conditions relating to this Game.
'Prize'
means a prize won by a Player in the Game.
'Retailer'
means any person, firm or company that sells Tickets and/or pays Prizes.
‘Retail Player’
means any Player who plays the game by purchasing a Ticket at a Retailer.
'Selection'
means one set of five numbers chosen by a Player which is recorded on a Ticket issued in accordance with the Rules, and includes a Quick Pick recorded on a Ticket and a set of five numbers chosen by a Player which is keyed in manually by a Retailer and which is recorded on a Ticket
'Terminal'
means the machine which allows Tickets to be printed.
'Valid Winning Ticket'
means a winning Ticket which meets all Ticket validation requirements as set out or referred to in the these Rules.
'Winning Numbers'
means the Numbers, used to determine the winning Entries.
'Winning Selection'
means a selection which entitles a Player to a Prize in the category applicable to the correct numbers selected. [top]
3. The Game
The game is called The Health Lottery Game. [top]
4. Draw
The Draw for the Game will take place using a Draw Machine to select the winning numbers. It will take place once a week on Saturdays, or at any other time as may be determined by the Company. [top]
5. Method of Play
5.1 Cost of Play
(a) Each Entry has a cost of £1.
(b) The cost of a Multi-draw Ticket will be the total cost of the Entries selected multiplied by the number of Game Draws the Player has requested.
5.2 Making a Selection
(i) Using a Play Card to purchase a Ticket
(a) On any one Play Card a Retail Player may play a minimum of one Selection and a maximum 10 selections where the numbers are provided by the Player to the Retailer.
(b) Each Selection is made by manually writing five numbers within white boxes printed on the Play Card. A maximum of 3 sets of 5 numbers can be written on the Play Card.
(c) A Retail Player using a completed Play Card to purchase a Ticket will submit the Play Card to the Retailer. The completed Play Card containing the Retail Players selected numbers will then be activated by the retailer and the numbers will be entered into the chosen number of Draws by the Retailer using the Retail Terminal, which will issue the Ticket recording each Selection written on the Play Card. It is the responsibility of the Player to check that the numbers printed on the Ticket are consistent with the numbers marked on the Players’ Play Card.
(d) Where the Retail Player would like to play for Multiple draws they will be required to inform the Retailer how many draws they wish their Ticket to be entered into during the process of placing the wager, where the Retail Terminal will prompt the Retailer to ask the player how many weeks they would like their Ticket to be entered for.
(ii) Purchasing a Ticket Using Quick Pick or manually via the Retailer
(a) A Retail Player may purchase a Ticket from a Terminal without completing a Play Card, by requesting the Retailer to key in a selection of numbers manually by specifying the five numbers required per entry into the Game, up to a maximum of 10 selections
(b) A Retail Player may purchase a Ticket from a Terminal, without completing a Play Card, by requesting the Retailer to issue a Ticket via Quick Pick.
(iii) Purchasing a Ticket or creating a Direct Debit using the Health Lottery Website
(a) A Player may enter the draw via the Website using the Direct Debit features provided. A player must first register to set up an account in accordance with the Terms and Conditions for playing Health Lottery on-line
(b) Any Play or Direct Debit that is not recorded on the Company's Central Computer System will not be valid, any print out or other representation of any Play captured by a Player that is not registered on the Company’s Computer System will not be valid.
(c) Players may not purchase a Play or set up a Direct Debit when physically located outside Great Britain.
5.3 Cancellation of a Ticket
(a) A Ticket bought at a Retailer may be cancelled only in exceptional circumstances such as
- The numbers entered into the Retail Terminal by the Retailer are not the same as the numbers written on the Play Card as selected by the Retail Player, or
- A ticket contains two or more Quick pick Selections comprising the same five numbers.
(b) A Ticket falling within the terms of paragraph 3 (a) above may only be cancelled:
- At e-pay and Payzone Retailers , and in Participating Retailers using their own EPOS system to sell Tickets within a 30 minute period after the original sale
- At Pay Point Retailers within 10 minutes of the original sale provided that no other transactions have been made in the interim.
In both instances this must be before the close of sales for the relevant Draw
(c) For the avoidance of doubt, a Retail Player may not seek cancellation of a Quick pick Ticket by reason only of the number selection(s) on the Ticket not being to their liking.
(d) Tickets purchased on-line may not be cancelled in any circumstances
(e) Direct Debits can be cancelled for any purchases that have not yet been placed in a draw. Direct Debit payments will be collected monthly on either the 1st of or the 15th day of the month, where that day falls on a bank holiday or weekend the payment will be taken on the next working day. In the event that a player who plays by Direct Debit chooses to cancel a Direct Debit the payment will be cancelled for the next collection cycle. Any plays for which money has been collected that have been entered into the draw cannot be cancelled under any circumstances.
5.4 Multi-draws
A Multi-draw Ticket shall not be capable of cancellation other than in accordance with paragraph 5.3 above and, in any event, prior to the first Draw in respect of which the Ticket has been issued.
5.5 Winning Selections
Subject to the Terms & Conditions and the game Rules for the Game, a Player who, has three or more numbers which match the Numbers drawn will be entitled to a Prize:
Match 3 category
Any Player who has correctly matched three numbers in any one selection from the five Numbers drawn.
Match 4 category
Any Player who has correctly matched four numbers in any one selection from the five Numbers drawn.
Match 5 category

6.2 The Company may from time to time undertake promotional activities that offer additional or enhanced prizes; separate Terms and Conditions and Rules will be made available to players via the Website which will set out the details of the promotion and the draw that it applies to. Players will be notified by way of advertising when Promotions are to take place. Promotions will be in addition to the prizes shown in 6.1. [top]
7. Refunds in Certain Circumstances
7.1 In the event of a Cancelled Draw the Company shall:
(a) refund a Retail Player who has purchased either a Ticket for the Cancelled Draw only or a Multi-draw Ticket for the Cancelled Draw and other Draws, an amount equal to that part of the Ticket purchase price as was paid in respect of and is attributable to the Cancelled Draw;
(b) refund to Direct Debit Players who hold a valid Direct Debit for Draws which include the Cancelled Draw that proportion of the amount previously paid by the Direct Debit Player for that Direct Debit as was paid in respect of and is attributable to the Cancelled Draw;
7.2 Any refund and payment under paragraph 7.1 (a) or (b) respectively must be claimed by the Retail Player. The methods of claiming, payment, the validation of claims and (subject to paragraph 7.3 below) the period within which such claims may be made shall be as determined by the Company in its absolute discretion from time to time but subject to the prior agreement of the Commission. A Retail Player will in any event be required to produce the Ticket before any refund or payment will be made.
7.3 The period referred to in paragraph 7.2 above shall be a period expiring not earlier than the day 90 days after the date on which the Cancelled Draw was to have taken place.
7.4 Any refund under paragraph 7.1 (b) above shall be made by such means and within such period as the Company shall in its absolute discretion determine from time to time but subject to the prior agreement of the Commission.
7.5 Neither the Company nor any Retailer shall in any circumstances be liable to pay interest in respect of refunds or payments made under this paragraph 7. [top]
8. Validation of Tickets
8.1 Before a Prize may be paid on any Ticket, it must be validated according to the Company’s validation procedure. The decision by the Company whether or not the ticket is valid shall be final and binding, foregoing, the Company shall be entitled to declare a Ticket invalid, and accordingly shall not be obliged to pay any prize if:
(a) The Ticket has been cancelled, whether in accordance with the Company’s procedure for cancellation or otherwise.
(b) The Ticket is counterfeit, has been forged in part or in whole or fails to pass the security test appropriated to the method of play.
(c) The ticket has been defaced, is damaged, defected, mutilated, altered, unreadable, and in-complete or tampered with in any manner.
(d) The Ticket has not been received by the Company within the Prize Claim Period as specified in these Rules or the Terms and Conditions relating to this Game.
(e) The Serial number on the Ticket does not appear on the Company’s list of Serial Numbers of Winning Tickets or is a Valid Winning Ticket of Ticket that has been paid previously.
(f) The Ticket does not appear on the list of Tickets sold for entry to the particular Draw, stored on the Company’s Computer System.
(g) Any number on the Ticket is not present in its entirety or is not fully legible.
(h) The Ticket has not been issued or sold in an authorised manner by the Company or by an authorised Retailer. [top]
9. Disputed Tickets
If a dispute arises between the Company and the owner of a Ticket or Claimant as to whether a Ticket is a Valid Winning Ticket, and the Ticket prize claimed has not been paid the Company may, solely at is option, reimburse the cost of the Ticket or replace the disputed Ticket with a Ticket of equivalent sale price for any current Game. This shall be the owner of the Ticket or Claimant’s sole and exclusive remedy, and such reimbursement or replacement shall fully discharge the Company from and liability in respect of such dispute. 10. Purchase and Prize Restrictions
10.1 There shall be no general right for any person to purchase a Ticket. In particular, but without limitation, no Ticket may be purchased or prize paid to
- Any minor whether acting on their own behalf or on behalf of another person
- Any director or an employee of THL, the CICs, Peoples Health Trust, or a key IT contractor or supplier, or any spouce or dependents of the same; and
For the avoidance of doubt any Participating Retailers who act as direct agents of the CICs and use Pay Point, e-pay or Payzone terminals and software to transact Lottery Tickets will not be deemed to be agents of THL for the purposes of this clause and will be entitled to buy Tickets and receive Prizes from THL.
10.2 In the event that a Prize is paid to a person in one of the classes in 10.1 such a prize shall be repayable by that person to the Company on demand.
10.3 The Company, in its sole discretion, may refuse to sell Tickets to any person or persons without giving reasons, but which may include circumstances in which, in its view, that person or persons are playing in a manner which it or it Retailers’ deems to be interfering with other Players’ reasonable access to that Game. 11. Prize Claim Period
Prizes for the Health Lottery Game must be claimed no later than 18.00hrs on the 180th day after the winning draw date. Any such prize not claimed within this period will be forfeited. If any prize is claimed by post, the Company must receive the Ticket and Claim form at the address shown on these Rules within this period.
12. Responsibility for Tickets
The player is responsible for the safe custody of the Ticket. [top]
13. Dissemination of Winning Numbers Information
The results of each draw will be issued to the national media and may also be made available in other manners from time to time. Winning numbers will be available via any Retailer outlet at the request of a Player, the information made available will include:
- The date of the draw
- The winning numbers
- The CIC(s) to which the draw relates[top]
14. Binding Decisions
The Company’s decisions as to whether or not a Ticket is a winning Ticket or in respect of any other matter or dispute arising from the payment or awarding or non-payment or non-awarding of prizes shall be final and binding upon all Players and any other person or persons having any interest in the matter or dispute. In the event of a dispute in respect of a winning Ticket, a Claim Form, or the payment or awarding of any prize, the Company may withhold payment of the prize and/or make an equivalent payment into court until the dispute has been resolved. 15. Law
These Rules and Terms & Conditions and the rights and obligations of the Company, Players and Direct Debit Players set out herein shall be governed by and construed in all respects in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts. Terms and Conditions Specific to the Health Lottery Direct Debit Promotion
1. The Game/Promotion
The Promotion is called the Direct Debit Promotion. This offer is available to new direct debit subscribers only. Offer limited to one direct debit submission per person. This promotion will be run between dates specified in advance by the Company at various times throughout the year. The Direct debit must have been submitted via The Health Lottery website between the dates specified and will close at 19.45hrs on the last day of each of the promotional periods.
The Health Lottery ELM Limited will pay back into the designated bank account two weeks of gameplay related to the direct debit upon completion of the first successful direct debit payment. For the avoidance of doubt this means that a full direct debit payment will be taken. Once this payment is confirmed a refund back into the bank account for the 2 weeks will be made. All other terms and conditions relating to playing The Health lottery remain unaffected.
The Health Lottery cannot be held responsible for any direct debit applications rejected during this time for whatever reason caused. A failed direct debit application will not be entitled to enter the above promotion and will automatically be removed.
