1 INTRODUCTION

1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for the lottery draw (the “Lottery”) which is promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies (“CICs”) listed on its website www.healthlottery.co.uk (the “Website”).

1.2 The correspondence address is The Health Lottery ELM Limited, Northern & Shell Building, 10 Lower Thames Street, London, EC3R 6EN.

1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence numbers 000-026057-R-309179 and 000-026057-N-309180.

1.4 The Health Lottery Scheme manages 51 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. They operate under the Gambling Act 2005, (“The Act”) each or all being referred to as “The Health Lottery”, depending on the context. 
Operating this way allows costs to be kept to a minimum so that larger sums of Society Lottery funding can be allocated to local health related Good Causes, and, unlike other lotteries, every single part of Great Britain gets their share of the appropriate proceeds.

1.5 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and proceeds are allocated according to ticket sales for each CIC that is open. Money is then donated to support health related ‘Good Causes’ within their respective local areas.

1.6 A complete list of the CICs promoting the society lotteries can be seen at Annex A.

1.7 Players should be aware that all the participating CICs are independent companies. THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and Good Causes they support is available. It should also be noted that the allocation of funds to Good Causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity People’s Health Trust and not by THL.

1.8 At least 20% of the proceeds of each Lottery shall be paid to health related Good Causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.

1.9 All entries into and participation in the Lottery is strictly governed by these T&Cs. By entering the Lottery, a Player agrees to be bound by the T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.

1.10 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the Website along with the Game Rules and Terms and Conditions for Playing Online and by Direct Debit, and THL will provide a copy by post on receipt of a stamped addressed envelope at the address in clause 1.2 above.  T&Cs booklets and copies of the shortened form of the T&Cs and Game Rules (the Player’s Guide) can be obtained on request from a Health Lottery Participating Retailer.

1.11 If and when changes are made to the T&Cs THL will use its database of Players that have registered online to notify all those Players for whom it has email details. THL will also distribute a revised version of its T&Cs to all Participating Retailers. The T&Cs may be amended by THL from time to time and will be published on the Website.

2 DEFINITIONS

ANY WORDS WITHIN THESE T&CS WHICH START WITH A CAPITAL LETTER SHALL HAVE THE FOLLOWING MEANINGS:

(a) “Bonus Ball’ number means the number drawn in addition to the 5 regular Winning Numbers  drawn for the lottery game.  This may also be referred to as the “Bonus Number” in marketing materials.

(b) “Claim Form” means a printed form provided by THL by mail or email to Players claiming a Prize of more than £50 in accordance with the THL postal claim procedure.  

(c) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

(d) “Fixed Prize” means a prize category below the Jackpot Prize where the winners will receive a set amount not shared by players subject to the limitations found at sections 6.15 and 6.16. Currently these prize categories are £10, £20,£50,£250 and £10,000.   

(e) “Game Rules” means the rules which are applicable to playing the draw based lottery game and which are published on THL’s website.

(f) “Good Causes” means the promotion of health for the public benefit by increasing and supporting sustainable health equality in and for disadvantaged communities and groups across England, Scotland and Wales.

(g) 'Hot Ticket Draw' means the promotional draw that may be conducted from time to time by the Company using a random number generator to select winning Hot Ticket Codes from all of the Codes that have been entered into the relevant Lottery Draw. Match 5 winning tickets from the main Draw will not be eligible to win a Prize in the Hot Ticket Draw. 

(h) 'Hot Ticket Code' means the Transaction Number provided by the eProvider to retail Players or by email to online Players which will be entered into the Hot Ticket Draw that the Company may conduct from time to time for promotional purposes for the chance to win additional Prizes as advertised.

(i) ‘Hot Ticket Prize’ means any prize be it a cash amount or a product offered by the Company as part of the Hot Ticket Draw it may run from time to time for promotional purposes.

(j) “Jackpot” or “Jackpot Prize” means the top prize in any Lottery Draw.

(k) “Lottery Draw” or “Draw” means the weekly lottery draw conducted by The Health Lottery every Wednesday and Saturday after 19:45, when sales will be closed for each week’s draw. The Health Lottery reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday or any other day deemed unsuitable for holding a Draw by Health Lottery Management.

(l) “Lottery Ticket” or “Ticket” means the ticket which is purchased by a Player in anticipation of a Lottery Draw and which carries the numbers selected by the Player for entry into the Lottery and which may contain more than one line of play;

(m) “Participating Retailer” means a retailer or store that has agreed to sell Health Lottery tickets on behalf of THL and the CICs.

(n) “Play” means any individual selection of 5 numbers entered into the Lottery.

(o) “Player” means an eligible person who purchases a Lottery Ticket in accordance with these T&Cs; and

(p) ‘Player’s Guide means the shortened Game Rules and Terms and Conditions printed by THL for use at retail locations.

(q) “Prize” means the prize monies, non cash Prizes or Free Ticket that may be won in the course of the Lottery draw or Hot Ticket draw in accordance with these T&Cs and any other rules of the Lottery.

(r) ‘Prize Ticket Promotion’ mean the promotion that the Health Lottery may run from time to time when a Quick Pick Ticket will be offered as a Prize paid for by the Health Lottery to Players who have matched two numbers in the Draw.  The opening and closing dates for this promotion will be stated clearly on the Health Lottery Website under the ‘Promotions’ tab and in print advertisements for the promotion.

(s)‘‘Prize Ticket” means a single Quick Pick entry for Play into a Lottery Draw issued as a prize for matching two Regular Numbers in a Lottery Draw whether for the same or another participating CIC at times when THL is offering a Prize Ticket Promotion.

(t) “Prize Capping” means the process that the Company may use to reduce the value of prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single draw exceeds £1m.

(u) ‘Quick Pick’ means a line of play where all numbers have been selected at random by the lottery system using a random number generator.

(v) ‘Winning Number’ or ‘Regular Number’ means the 5 numbers drawn before any Bonus Ball is drawn.

3 CONDITIONS OF ENTRY

3.1 To enter the Lottery and to be eligible to win a Prize, Players:

(a) Must be 16 years of age or over; and

(b) Must comply with these T&Cs and any other rules of the Lottery notified by THL.

3.2 Any corporate body incorporated and with a registered office address in Great Britain may purchase and claim prizes in the Lottery.

3.3 Excluded Persons are ineligible to participate in the Lottery and shall not be entitled to receive any Prizes. Players will have the option to self-exclude from a period of 6 months to 5 years. Once excluded, players will not be able to delete their account as a record of their exclusion must be kept.

3.4 All entry instructions communicated by THL shall form part of the Game Rules of the Lottery which are available on the Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2 above.

3.5 In purchasing a Ticket, Players acknowledge and agree that:

(a) They may be entered into a Lottery Draw which is not promoted by the CIC representing their geographic region; and

(b) A minimum of 20% of the Ticket price will go towards Good Causes.

3.6 By personally accepting the Prize from THL, Players warrant that they:

(a) Are not a director or an employee of THL, the CICs, People’s Health Trust, or a key IT contractor or IT supplier claiming a prize on their own behalf. A director or an employee of THL may however claim a prize on behalf of THL;

(b) Are not a spouse or dependent of any person described in 3.6(a); and

(c) Are eligible to win a Prize under clause 3.1; and

(d) Fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.

3.7 THL will have sole and absolute discretion as to whether to accept any entry to the Lottery and pay out any prizes. Its decision in the matter will be final and binding.

3.8 THL will rely on its own technical logs and records when determining whether the Player is eligible to receive a Prize.

3.9 The Player accepts that the Ticket they purchase in any week may not benefit directly the region in which they bought the Ticket. THL aims to ensure that different CICs representing different regions take it in turns to participate in The Health Lottery each week to ensure that across the course of a year, every participating region of the UK will benefit from monies raised as equally as possible.

3.10 Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Gambling Act 2005 and any relevant regulations made thereunder from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time and published on the THL Website.

4 HOW TO ENTER THE LOTTERY DRAW

4.1 Players enter the Lottery Draw either by purchasing a paper Ticket from a retailer authorised by THL or by using the Website to purchase an online Ticket. Tickets will normally cost £1 per line per Draw. At times when The Health Lottery offers a Prize Ticket Promotion, Players may also enter the Lottery Draw by way of having been issued a Prize Ticket for having matched 2 Winning Numbers in a previous Lottery Draw.

4.2 Participating Retailers may require proof of age or other identification to be shown before the Ticket will be sold. THL reserves the right to introduce new channels.

4.3 The Player must choose five different numbers, each of which must be between 1 and 50 inclusive, or may prefer to be allocated five different numbers in that range (a “Quick Pick”). In cases where a Player enters the Lottery by way of a Prize Ticket having been issued for matching two numbers in a previous Lottery Draw, the entry shall be issued by way of a Quick Pick only

4.4 The Player may choose to activate a Health Lottery Playcard (the “Playcard”) with their chosen five number selections for any play. Health Lottery Participating Retailers can activate a Playcard or Players may activate the Playcard by phoning the Contact Centre or using the Website. The activation of a Playcard will result in one or more selections of five numbers (up to a maximum of ten) being recorded on The Health Lottery account record designated by the unique number on the Playcard in question.

4.5 Following activation, a Playcard may be used to purchase Tickets for future Draws.

4.6 When available, a Playslip or Player’s Guide may also be used to purchase tickets.

4.7 A Ticket will be valid only for the Draw(s) to be held on the date(s) shown on the face of the Ticket. Players may choose to purchase a Ticket which enters the Player into the Lottery for up to eight weeks in advance.

4.8 It is the Player’s responsibility to check at the time of purchase that the date of the Draw and the numbers shown on the Ticket are those requested.

4.9 Cancellations are allowed only under exceptional circumstances. Any cancellation or reversal will need to be completed at the same location and on the same terminal as the original transaction. THL will allow cancellations and reversals for both a Ticket sale and a payout. In e-pay and Payzone Retailers, also in Participating Retailers using their own EPOS system to sell Tickets there will be a 30 minute window after which a reversal and cancellation cannot be performed at the terminal. PayPoint Retailers will only allow a cancellation within 10 minutes of the relevant transaction provided that no other transactions have been made in the interim.

4.10 For the avoidance of doubt, a Player may not seek cancellation of a Quick Pick Ticket if the numbers selected are not to his or her liking.

4.11 A Player may in certain circumstances request the repayment of their stake, should that Player have purchased a ticket in advance of a Draw that is subject to a change in these Terms and Conditions, prior to the point at which the changed Terms and Conditions have been published by the Company on their website. The Player must contact the Company in writing at Dept 399, 2nd Floor, Queensgate, Grange Road East, Birkenhead CH41 5FD, including enclosing the original ticket, name, address, and the bank details to which the refund should be credited. This communication and ticket must be received by the Company at least 72 hours in advance of the affected Draw subject to the limitations stated in clause 8.2. Online Players must notify the Company by email using their registered email address within the same 72 hour timeline in order to facilitate the refund. The Player accepts that if their application for a refund is accepted their ticket will be withdrawn from the applicable draw and will not be eligible for any prizes.

4.12 The Player is solely responsible for ensuring that the Ticket remains safe and in a good and legible condition. For Players having participated in the Draw by purchasing a Ticket from a Retailer, the Ticket is sole evidence of entry into the Draw and must be in the possession of the Player to enable them to claim a Prize. The Playcard or Playslip cannot be used to claim a Prize or be relied upon as evidence of entry into a Draw.

4.13 Subject always to clause 9.2, THL accepts no responsibility for lost, stolen, damaged or defaced tickets.

5 PLAYING THE LOTTERY DRAW ONLINE

5.1 Online Players of the Lottery Draw are required to provide THL with their name, date of birth, address, contact details and bank details before an online registration will be processed. In order to play in the Lottery Draw online on the Website of the Health Lottery Players must have a Great Britain registered debit card registered at a Great Britain address. Identity checks will be carried out to confirm that the player is at least 16 years old.

5.2 Registered online Players will be provided with an e-wallet in which they may deposit funds which they wish to use to participate in the Lottery Draws. Players can only make payments by Debit Card which will be made to Health Lottery Financial Ltd (“HLFL”), a sister company of THL which handles all financial transactions for THL and the CICs. Players who supply details of a jointly owned bank account accept that Prizes won will be paid into that account.

5.3 Online Players can play by subscription using Direct Debit (“Subscription Players”). The Direct Debit Guarantee applies to all Direct Debit arrangements set up by the Players. Direct Debits will be collected by HLFL.

5.4 No online Player may purchase more than £80 of Tickets for any single Lottery Draw. A Player purchasing Tickets on behalf of a syndicate may not purchase more than £80 of Tickets for any single Lottery Draw per member of the syndicate.

5.5 No online Player will be permitted to deposit more money if the balance in their e-wallet is more than £2,000.

5.6 THL reserves the right to impose such cooling-off periods on the use of deposited monies as it considers appropriate and will notify the same to Players before the deposit is accepted.

5.7 THL reserves the right to terminate a Player’s online account at any time, at its absolute discretion. Upon the termination of the online account, all monies held by THL on behalf of the Player will be returned to the Player’s bank account within 5 working days players may be asked if they wish to be contacted for advertising, promotional and marketing purposes. If Players wish to be removed from THL’s mailing list, they should click on the unsubscribe link shown on all Health Lottery e-mails or contact THL at unsubscribe@healthlottery.co.uk or call the Health Lottery Contact centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

5.8 Online entries are final and cannot be cancelled, reversed or refunded once completed.

5.9 In addition to these Terms and Conditions, Health Lottery online play is subject to the Terms and Conditions for Playing the Health Lottery Draw Game and Instant Lottery Game via the Internet and by Direct Debit published on The Health Lottery’s website.

6 THE LOTTERY DRAW AND PRIZES

6.1 The Lottery Draw will be broadcast, as advertised, on a weekly basis on Wednesdays and Saturdays. THL reserves the right to change the broadcast arrangements for the Draw from time to time and will notify Players of any such change either directly, if they are online players, or through notification posted on the ‘News’ page of its website. THL also reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday or any other day deemed unsuitable for holding a Draw by Health Lottery Management.

6.2 The names of the participating CICs which will benefit from the Draw in any one week will be displayed on the Website and the relevant CIC name will also appear on the Ticket. Tickets for more than one Draw will clearly display the date of all Draws and the relevant CIC for each Draw.

6.3 The results of any Lottery will be published on the Website or in any other source shall be for information purposes only and a Prize shall only be awarded to a winning ticket which has the number(s) recorded at the draw itself, by THL and an independent auditor. On-line players will be notified automatically to their registered e-mail address if they have won a prize.

6.4 In the Lottery Draw, five numbers will be drawn at random by an approved ball machine from the range between 1 and 50 inclusive (the “Winning Numbers”). An additional number, the Bonus Ball, will be drawn after all five main numbers have been drawn.

6.5 Only one Prize may be claimed in respect of each entry made to the Lottery Draw. Subject to this clause 6, Prizes paid to the holders of Tickets with Winning Numbers in the Lottery Draw will be as follows:

-From time to time when The Health Lottery is offering the Prize Ticket Promotion, if two Winning Numbers are matched the Player will win a Prize Ticket offering free entry into the next Lottery Draw after redemption. For the avoidance of doubt, matching one Winning Number and one Bonus Ball number will not entitle the player to a Prize.

- If two Winning Numbers and the Bonus Ball are matched on the player’s ticket, the Player will win one Prize of £10.

- If three of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £20.

-If three of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £50.

- If four of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £250.

-If four of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £10,000.

Jackpot Prize

-In the Saturday Draw, if five of the Winning Numbers are matched on a Player’s Ticket, the Player will win one share of a Prize of £100,000. The player’s share of the £100,000 Saturday Jackpot Prize will be calculated dividing the £100,000 prize by the number of Tickets having matched 5 numbers in the Saturday draw. For example, if the Prize is £100,000 and there are two winners, each Ticket having matched 5 numbers will win £50,000.  Prizes will be rounded up to the nearest pound if required.

-In the Wednesday Draw if five of the Winning Numbers are matched on a Player’s Ticket, the Player will win one share of a Prize equivalent to 10% of the total proceeds of the Draw, subject to a maximum Prize of £100,000. The player’s share of the Wednesday Jackpot Prize will be calculated dividing an amount equivalent to 10% of proceeds by the number of Tickets having matched 5 numbers in the Wednesday draw. For example, if the Jackpot Prize is £50,000 and there are two winners, each Ticket having matched 5 numbers will win £25,000. Prizes will be rounded up to the nearest pound if required.

6.6 Players who win a Prize Ticket or a cash Prize of up to £50 inclusive with a paper Ticket may collect their Prize from any Participating Retailer which sells Tickets for the Lottery Draw. Players who win a Prize of up to and including £250 may collect their funds at any Post Office location or any other location identified on the Health Lottery Website as allowing the redemption a £250 prize. Players who win a Prize in excess of £250 with a paper Ticket must contact THL on 0844 375 55 55 in order to claim their Prize.

6.7 Players who accumulate multiple Prizes of £10 or £20 on the same ticket must also contact THL to claim their Prize if the total amount accumulated exceeds £250.Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary. THL will only pay out cash Prizes in excess of £50 by cheque or electronic transfer to a UK bank account. THL reserves the right to pay cash Prizes in excess of £50 by means of any new payment method that becomes available in the future.

6.8 The Player is responsible for ensuring that the correct Prize is paid by the Retailer for a match 2,  match 2 balls plus Bonus Ball win, match 3 balls win, match 3 balls plus bonus ball win or match 4 at the time the Ticket is validated.

6.9 Hot Ticket Prizes can be claimed up to 180 days after the draw. Players must contact the Health Lottery on 0844 375 5555 in order to claim their prize. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

6.10 No Prize will be paid on a Ticket that has been forged, altered, damaged or defaced in any way.

6.11 No Prize will be paid on a Ticket that fails THL’s validation process.

6.12 Online players may collect their Prize(s) of up to £2,000 in the Lottery Draw through their Health Lottery online account. For Online Prize Ticket winners, a Quick Pick will be issued automatically for entry into the next Draw after which the Prize Ticket was won. Other Prizes for higher amounts must be claimed by contacting The Health Lottery on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

6.13 Online Players who win a Prize or a combination of Prizes in excess of £2,000 in the Lottery Draw must contact The Health Lottery on 0844 375 55 55 in order to claim their Prize. Subscription Players will automatically receive notification from THL of their Prize.

6.14 By claiming and accepting a Prize Players agree to publicity which will be carried out at the sole discretion of the Company.

6.15 Should the total sum of Prizes due for payment in respect of any Lottery Draw exceed £1,000,000, THL reserves the right to implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, THL may reduce all prize categories in proportion so as to bring the total Prize payout to a minimum of £1,000,000.

6.16 In the event that the total Prize payout exceeds £1,000,000 when a Prize Ticket Promotion is being offered THL reserves the right to cancel this promotion and refuse to issue free tickets to Players having matched two main numbers in the Draw.

6.17 The Prize Pool for each weeks Lottery is calculated once the winning numbers have been entered into the system. All prizes on the Health Lottery will be paid in full unless Prize Capping is required.

6.18 THL reserves the right to change the Prize sums paid to Players without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.

6.19 Winning Players may be required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.

6.20 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned immediately to THL.

6.21 THL will use its reasonable endeavours to provide the Prize payment to the Player within fourteen days of receiving the Player’s identification documents but will not be liable for late delivery. Prizes for the Health Lottery Game must be claimed no later than 18.00 hours on the 180th day following the day of the draw. Any Prize not claimed within this period will be forfeited. If any Prize is claimed by post, THL must receive the Ticket and Claim Form at the address shown on the Claim Form within this period.

6.22 Each winning Player is responsible for paying any and all taxes on any Prize won.

6.23 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their written consent.

7 SELF EXCLUSION

7.1 Any Player may opt at any time to be excluded from purchasing Tickets for future Lottery Draws by visiting the Website or a Participating Retailer. For online Players at the start of the period of self-exclusion (the “Exclusion Term”), all monies held by THL in the Player’s e-wallet will be returned to the Player and the online account will be suspended.

7.2 Players may choose the length of the Exclusion Term, subject to a minimum period of six months. During the Exclusion Term, they will not be permitted to access their online account held with THL or to purchase any Tickets using that account.

7.3 THL will not contact the Player at the expiration of the Exclusion Term. The Player may reinstate the account held with THL by contacting info@healthlottery.co.uk, although a cooling-off period of one week will be imposed by THL before the account becomes active.

7.4 The Player may choose to enter another Exclusion Term at any time.

7.5 Players may choose to enter an opt-out scheme under which they will not receive marketing materials from THL. Where THL communicates with its Players by email, each message will include a brief description of the way that the recipient may notify THL that they wish communications to cease.

7.6 THL will remove from its marketing lists the details of any Player who, upon receipt of unwanted marketing material, calls THL’s Contact Centre or email unsubscribe@healthlottery.co.uk. A Player may also use the unsubscribe link at the bottom of any marketing email to stop any further marketing communications.

7.7 Players should play responsibly. Information on how to gamble responsibly and how to access information about, and help in respect of, problem gambling can be found on the website or be sending a stamped addressed envelope to the address in clause 1.2 above. Alternatively information is available from www.gamcare.org.uk.

8 LIMITATION OF THE HEALTH LOTTERY’S LIABILITY AND RESERVATION OF RIGHTS

8.1 Nothing in these T&Cs shall exclude or limit THL’s liability:

(a) For death or personal injury resulting from THL’s negligence; or

(b) For fraudulent misrepresentation; or

(c) For liability that cannot be excluded or limited by law.

8.2 Subject always to clause 8.1 neither THL nor any of the societies participating in the Health Lottery from time to time shall be liable to a Player for any loss or damage suffered by a Player arising from:

(a) Any failures or delays in any delivery methods (including postal services) used by THL or the Player from time to time.

(b) Retailer error or incorrect or misuse of retailer terminal (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize).

(c) Any event which is beyond THL’s or the societies’ reasonable control.

And in addition;

(d) The Lottery is provided on an “as is” and “as available” basis and no representations or endorsements of any kind are made; and

(e) All warranties, conditions and guarantees relating to the Lottery made by or on behalf of THL, whether express or implied by law, in the course of dealing or otherwise, are excluded to the maximum extent permitted by law.

8.3 THL is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Lottery for:

(a) Loss of revenue, contract, profits, business or anticipated savings or loss of data;

(b) Any special or indirect or consequential losses; or

(c) Any loss of goodwill or reputation.

8.4 THL does not guarantee that use of the Website, telephone system, broadcast or live transmission will be uninterrupted, timely and / or error-free.

8.5 Subject to clause 8.1, THL’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player.

8.6 THL is not responsible for any websites which may be visited via hyperlinks provided on the Website. Visitors to and transactions made on such websites are conducted entirely at the site user’s own risk.

8.7 THL reserves the right to exclude any Player from the Lottery in the event that THL believes in its sole discretion that the Player may be using technology to gain an unfair advantage over other Players of the Lottery.

9 LIABILITY OF PLAYERS

 9.1 Players agree to fully indemnify THL in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by THL due to the Player’s misuse of the Website.

9.2 Nothing contained in these T&Cs shall affect the statutory rights of any Player. THL’s Complaints Procedure is available on request by writing to the address in 1.2, by emailing THL on help@healthlottery.co.uk or by calling the Contact Centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

10. COMPLAINTS

In the event of a complaint or to express any dissatisfaction with any aspect of The Health Lottery Players should email THL on help@healthlottery.co.uk or call the Contact Centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

11 DISPUTE RESOLUTION

If a complaint is not resolved to a Player’s satisfaction by the use of THL’s Complaints Procedure, and subject to the dispute meeting the criteria detailed in the Gambling Commission’s Code of Practice, the Player may request information as to how to refer their complaint to an independent adjudicator. Further information regarding the referral of a complaint to an independent adjudicator is contained in The Health Lottery Complaints procedure, published on the Terms and Conditions page of the Health Lottery website.

12 INTELLECTUAL PROPERTY

All intellectual property rights generated as a result of the operation of the Lottery shall be the property of THL and Players agree to take all steps (at THL’s cost) to vest in THL any intellectual property which the Player creates in the course of entering the Lottery.

13 DATA PROTECTION

All information provided by Players to THL for the purposes of the Lottery will be stored, managed and used in accordance with current Data Protection legislation and also with the THL’s Privacy Statement as posted on the Website. THL’s Privacy Statement forms part of these T&Cs.

14 GOVERNING LAW

These T&Cs are governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.

15 INSOLVENCY

The lottery monies managed by THL and HLFL on behalf of the CICs are ring-fenced and covered by a Declaration of Trust of which the CICs and the Players are the beneficiaries. In the event that THL or HLFL are declared insolvent, the lottery funds are protected and the creditors of THL or HLFL will have no recourse to the lottery funds held on trust for the CICs and the Players.

ANNEX A COMMUNITY INTEREST COMPANIES:

The Health Lottery Scheme manages 51 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. The 51 Community Interest Companies were established and are conducted to tackle health inequalities in their respective local area.

Health Lottery Terms and Conditions valid for draws from 16th September to 31st December 2013

1 INTRODUCTION

1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for the lottery draw (the “Lottery”) which is promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies (“CICs”) listed on its website www.healthlottery.co.uk (the “Website”).

1.2 The correspondence address is The Health Lottery ELM Limited, Northern & Shell Building, 10 Lower Thames Street, London, EC3R 6EN.

1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence numbers 000-026057-R-309179 and 000-026057-N-309180.

1.4 The Health Lottery Scheme manages 51 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. They operate under the Gambling Act 2005, (“The Act”) each or all being referred to as “The Health Lottery”, depending on the context. 
Operating this way allows costs to be kept to a minimum so that larger sums of Society Lottery funding can be allocated to local health related Good Causes, and, unlike other lotteries, every single part of Great Britain gets their share of the appropriate proceeds.

1.5 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and proceeds are allocated according to ticket sales for each CIC that is open. Money is then donated to support health related ‘Good Causes’ within their respective local areas.

1.6 A complete list of the CICs promoting the society lotteries can be seen at Annex A.

1.7 Players should be aware that all the participating CICs are independent companies. THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and Good Causes they support is available. It should also be noted that the allocation of funds to Good Causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity People’s Health Trust and not by THL.

1.8 At least 20% of the proceeds of each Lottery shall be paid to health related Good Causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.

1.9 All entries into and participation in the Lottery is strictly governed by these T&Cs. By entering the Lottery, a Player agrees to be bound by the T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.

1.10 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the Website along with the Game Rules, and THL will provide a copy by post on receipt of a stamped addressed envelope at the address in clause 1.2 above.  T&Cs and booklets and copies of the shortened form of the T&Cs and Game Rules (the Player’s Guide) can be obtained on request from a Health Lottery Participating Retailer.

1.11 If and when changes are made to the T&Cs THL will use its database of Players that have registered online to notify all those Players for whom it has email details. THL will also distribute a revised version of its T&Cs to all Participating Retailers. The T&Cs may be amended by THL from time to time and will be published on the Website.

2 DEFINITIONS

ANY WORDS WITHIN THESE T&CS WHICH START WITH A CAPITAL LETTER SHALL HAVE THE FOLLOWING MEANINGS:

(a)“Bonus Ball’ number means the number drawn in addition to the 5 regular Winning Numbers drawn for the lottery game.  This may also be referred to as the “Bonus Number” in marketing materials

(b) “Claim Form” means a printed form provided by THL by mail or email to Players claiming a Prize of more than £50 in accordance with the THL postal claim procedure.  

(c) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

(d) ‘‘Prize Ticket” means a single Quick Pick entry for Play into a Lottery Draw issued as a prize for matching two numbers in a Lottery Draw whether for the same or another participating CIC at times when THL is offering a Prize Ticket Promotion.

(e) “Game Rules” means the rules which are applicable to playing the draw based lottery game and which are published on THL’s website.

(f) “Good Causes” means the promotion of health for the public benefit by increasing and supporting sustainable health equality in and for disadvantaged communities and groups across England, Scotland and Wales.

(g) 'Hot Ticket Draw' means the promotional draw that may be conducted from time to time by the Company using a random number generator to select winning Hot Ticket Codes from all of the Codes that have been entered into the relevant Lottery Draw. Match 5 winning tickets from the main Draw will not be eligible to win a Prize in the Hot Ticket Draw.

(h) 'Hot Ticket Code' means the Transaction Number provided by the eProvider to retail Players or by email to online Players which will be entered into the Hot Ticket Draw that the Company may conduct from time to time for promotional purposes for the chance to win additional Prizes as advertised.

(i) ‘Hot Ticket Prize’ means any prize be it a cash amount or a product offered by the Company as part of the Hot Ticket Draw it may run from time to time for promotional purposes. A product offered as a prize as part of this promotion may not be substituted for cash.

(j) “Jackpot” or “Jackpot Prize” means the top prize in any Lottery Draw.

(k) “Lottery Draw” or “Draw” means the weekly lottery draw conducted by The Health Lottery every Wednesday and Saturday after 19:45, when sales will be closed for each week’s draw;

(l) “Lottery Ticket” or “Ticket” means the ticket which is purchased by a Player in anticipation of a Lottery Draw and which carries the numbers selected by the Player for entry into the Lottery and which may contain more than one line of play;

(m) “Participating Retailer” means a retailer or store that has agreed to sell Health Lottery tickets on behalf of THL and the CICs.

(n) “Play” means any individual selection of 5 numbers entered into the Lottery.

(o) “Player” means an eligible person who purchases a Lottery Ticket in accordance with these T&Cs; and

(p) ‘Player’s Guide means the shortened Game Rules and Terms and Conditions printed by THL for use at retail locations.

(q) “Prize” means the prize monies, non cash Prizes or Free Ticket that may be won in the course of the Lottery draw or Hot Ticket draw in accordance with these T&Cs and any other rules of the Lottery.

(r) ‘Prize Ticket Promotion’ mean the promotion that the Health Lottery may run from time to time when a Quick Pick Ticket will be offered as a Prize paid for by the Health Lottery to Players who have matched two numbers in the Draw.  The opening and closing dates for this promotion will be stated clearly on the Health Lottery Website under the ‘Promotions’ tab and in print advertisements for the promotion.

(s) “Prize Capping” means the process that the Company may use to reduce the value of prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single draw exceeds £15m.

(t) ‘Quick Pick’ means a line of play where all numbers have been selected at random by the lottery system using a random number generator.

(u)‘Winning Number’ or ‘Regular Number’ means the 5 numbers drawn before any Bonus Ball is drawn.

3 CONDITIONS OF ENTRY

3.1 To enter the Lottery and to be eligible to win a Prize, Players:

(a) Must be 16 years of age or over; and

(b) Must comply with these T&Cs and any other rules of the Lottery notified by THL.

3.2 Any corporate body incorporated and with a registered office address in Great Britain may purchase and claim prizes in the Lottery.

3.3 Excluded Persons are ineligible to participate in the Lottery and shall not be entitled to receive any Prizes. Players will have the option to self-exclude from a period of 6 months to 5 years. Once excluded, players will not be able to delete their account as a record of their exclusion must be kept.

3.4 All entry instructions communicated by THL shall form part of the Game Rules of the Lottery which are available on the Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2 above.

3.5 In purchasing a Ticket, Players acknowledge and agree that:

(a) They may be entered into a Lottery Draw which is not promoted by the CIC representing their geographic region; and

(b) A minimum of 20% of the Ticket price will go towards Good Causes.

3.6 By personally accepting the Prize from THL, Players warrant that they:

(a) Are not a director or an employee of THL, the CICs, People’s Health Trust, or a key IT contractor or supplier claiming a prize on their own behalf. A director or an employee of THL may however claim a prize on behalf of THL;

(b) Are not a spouse or dependent of any person described in 3.6(a); and

(c) Are eligible to win a Prize under clause 3.1; and

(d) Fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.

3.7 THL will have sole and absolute discretion as to whether to accept any entry to the Lottery and pay out any prizes. Its decision in the matter will be final and binding.

3.8 THL will rely on its own technical logs and records when determining whether the Player is eligible to receive a Prize.

3.9 The Player accepts that the Ticket they purchase in any week may not benefit directly the region in which they bought the Ticket. THL aims to ensure that different CICs representing different regions take it in turns to participate in The Health Lottery each week to ensure that across the course of a year, every participating region of the UK will benefit from monies raised as equally as possible.

3.10 Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Gambling Act 2005 and any relevant regulations made thereunder from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time and published on the THL Website.

4 HOW TO ENTER THE LOTTERY DRAW

4.1 Players enter the Lottery Draw either by purchasing a paper Ticket from a retailer authorised by THL or by using the Website to purchase an online Ticket. Tickets will normally cost £1 per line per Draw. At times when The Health Lottery offers a Prize Ticket Promotion, Players may also enter the Lottery Draw by way of having been issued a Prize Ticket for having matched 2 numbers in a previous Lottery Draw.

4.2 Participating Retailers may require proof of age or other identification to be shown before the Ticket will be sold. THL reserves the right to introduce new channels.

4.3 The Player must choose five different numbers, each of which must be between 1 and 50 inclusive, or may prefer to be allocated five different numbers in that range (a “Quick Pick”). In cases where a Player enters the Lottery by way of a Prize Ticket having been issued for matching two numbers in a previous Lottery Draw, the entry shall be issued by way of a Quick Pick only

4.4 The Player may choose to activate a Health Lottery Playcard (the “Playcard”) with their chosen five number selections for any play. Health Lottery Participating Retailers can activate a Playcard or Players may activate the Playcard by phoning the Contact Centre or using the Website. The activation of a Playcard will result in one or more selections of five numbers (up to a maximum of ten) being recorded on The Health Lottery account record designated by the unique number on the Playcard in question.

4.5 Following activation, a Playcard may be used to purchase Tickets for future Draws.

4.6 When available, a Playslip or Player’s Guide may also be used to purchase tickets.

4.7 A Ticket will be valid only for the Draw(s) to be held on the date(s) shown on the face of the Ticket. Players may choose to purchase a Ticket which enters the Player into the Lottery for up to eight weeks in advance.

4.8 It is the Player’s responsibility to check at the time of purchase that the date of the Draw and the numbers shown on the Ticket are those requested.

4.9 Cancellations are allowed only under exceptional circumstances. Any cancellation or reversal will need to be completed at the same location and on the same terminal as the original transaction. THL will allow cancellations and reversals for both a Ticket sale and a payout. In e-pay and Payzone Retailers, also in Participating Retailers using their own EPOS system to sell Tickets there will be a 30 minute window after which a reversal and cancellation cannot be performed at the terminal. PayPoint Retailers will only allow a cancellation within 10 minutes of the relevant transaction provided that no other transactions have been made in the interim.

4.10 For the avoidance of doubt, a Player may not seek cancellation of a Quick Pick Ticket if the numbers selected are not to his or her liking.

4.11 A Player may in certain circumstances request the repayment of their stake, should that Player have purchased a ticket in advance of a Draw that is subject to a change in these Terms and Conditions, prior to the point at which the changed Terms and Conditions have been published by the Company on their website. The Player must contact the Company in writing at Dept 399, 2nd Floor, Queensgate, Grange Road East, Birkenhead CH41 5FD, including enclosing the original ticket, name, address, and the bank details to which the refund should be credited. This communication and ticket must be received by the Company at least 72 hours in advance of the affected Draw subject to the limitations stated in clause 8.2. Online Players must notify the Company by email using their registered email address within the same 72 hour timeline in order to facilitate the refund. The Player accepts that if their application for a refund is accepted their ticket will be withdrawn from the applicable draw and will not be eligible for any prizes.

4.12 The Player is solely responsible for ensuring that the Ticket remains safe and in a good and legible condition. For Players having participated in the Draw by purchasing a Ticket from a Retailer, the Ticket is sole evidence of entry into the Draw and must be in the possession of the Player to enable them to claim a Prize. The Playcard or Playslip cannot be used to claim a Prize or be relied upon as evidence of entry into a Draw.

4.13 Subject always to clause 9.2, THL accepts no responsibility for lost, stolen, damaged or defaced tickets.

5 PLAYING THE LOTTERY DRAW ONLINE

5.1 Online Players of the Lottery Draw are required to provide THL with their name, date of birth, address, contact details and bank details before an online registration will be processed. In order to play in the Lottery Draw online on the Website of the Health Lottery Players must have a Great Britain registered debit card registered at a Great Britain address. Identity checks will be carried out to confirm that the player is at least 16 years old.

5.2 Registered online Players will be provided with an e-wallet in which they may deposit funds which they wish to use to participate in the Lottery Draws. Players can only make payments by Debit Card which will be made to Health Lottery Financial Ltd (“HLFL”), a sister company of THL which handles all financial transactions for THL and the CICs. Players who supply details of a jointly owned bank account accept that Prizes won will be paid into that account.

5.3 Online Players can play by subscription using Direct Debit (“Subscription Players”). The Direct Debit Guarantee applies to all Direct Debit arrangements set up by the Players. Direct Debits will be collected by HLFL.

5.4 No online Player may purchase more than £80 of Tickets for any single Lottery Draw. A Player purchasing Tickets on behalf of a syndicate may not purchase more than £80 of Tickets for any single Lottery Draw per member of the syndicate.

5.5 No online Player will be permitted to deposit more money if the balance in their e-wallet is more than £2,000.

5.6 THL reserves the right to impose such cooling-off periods on the use of deposited monies as it considers appropriate and will notify the same to Players before the deposit is accepted.

5.7 THL reserves the right to terminate a Player’s online account at any time, at its absolute discretion. Upon the termination of the online account, all monies held by THL on behalf of the Player will be returned to the Player’s bank account within 5 working days players may be asked if they wish to be contacted for advertising, promotional and marketing purposes. If Players wish to be removed from THL’s mailing list, they should click on the unsubscribe link shown on all Health Lottery e-mails or contact THL at unsubscribe@healthlottery.co.uk or call the Health Lottery Contact centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

6 THE LOTTERY DRAW AND PRIZES

6.1 The Lottery Draw will be broadcast, as advertised, on a weekly basis on Wednesdays and Saturdays. THL reserves the right to change the broadcast arrangements for the Draw from time to time and will notify Players of any such change either directly, if they are online players, or through notification posted on the ‘News’ page of its website.

6.2 The names of the participating CICs which will benefit from the Draw in any one week will be displayed on the Website and the relevant CIC name will also appear on the Ticket. Tickets for more than one Draw will clearly display the date of all Draws and the relevant CIC for each Draw.

6.3 The results of any Lottery will be published on the Website or in any other source shall be for information purposes only and a Prize shall only be awarded to a winning ticket which has the number(s) recorded at the draw itself, by THL and an independent auditor. On-line players will be notified automatically to their registered e-mail address if they have won a prize.

6.4 In the Lottery Draw, five numbers will be drawn at random by an approved ball machine from the range between 1 and 50 inclusive (the “Winning Numbers”). An additional number, the Bonus Ball, will be drawn after all five main numbers have been drawn.

6.5 Only one Prize may be claimed in respect of each entry made to the Lottery Draw. Subject to this clause 6, Prizes paid to the holders of Tickets with Winning Numbers in the Lottery Draw will be as follows:

-From time to time when The Health Lottery is offering the Prize Ticket Promotion, if two Winning Numbers are matched the Player will win a Prize Ticket offering free entry into the next Lottery Draw after redemption. For the avoidance of doubt, matching one Winning Number and one Bonus Ball number will not entitle the player to a Prize.

- If two Winning Numbers and the Bonus Ball are matched on the player’s ticket, the Player will win one Prize of £10.

- If three of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £20.

-If three of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £50.

- If four of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £250.

-If four of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £10,000.

-If five of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of up to an amount of £100,000, subject to the limitations in Clause 6.16 which state that the Jackpot cannot exceed 10% of proceeds. Therefore in the event that the total value of Tickets sold of any constituent lottery in the Lottery Draw are less than £1,000,000 the Jackpot Prize for a Player’s Ticket in which five of the Winning Numbers are matched will be the greater of £25,000 or 10% of the total value of Tickets sold of that particular lottery.

6.6 Players who win a Prize Ticket or a cash Prize of up to £50 inclusive with a paper Ticket may collect their Prize from any Participating Retailer which sells Tickets for the Lottery Draw. Players who win a Prize of up to and including £250 may collect their funds at any Post Office location or any other location identified on the Health Lottery Website as allowing the redemption a £250 prize. Players who win a Prize in excess of £250 with a paper Ticket must contact THL on 0844 375 55 55 in order to claim their Prize.

6.7 Players who accumulate multiple Prizes of £10 or £20 on the same ticket must also contact THL to claim their Prize if the total amount accumulated exceeds £250.Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary. THL will only pay out cash Prizes in excess of £50 by cheque or electronic transfer to a UK bank account. THL reserves the right to pay cash Prizes in excess of £50 by means of any new payment method that becomes available in the future.

6.8 The Player is responsible for ensuring that the correct Prize is paid by the Retailer for a match 2,  match 2 balls plus Bonus Ball win, match 3 balls win, match 3 balls plus bonus ball win or match 4 at the time the Ticket is validated.

6.9 Hot Ticket Prizes can be claimed up to 180 days after the draw. Players must contact the Health Lottery on 0844 375 5555 in order to claim their prize. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

6.10 No Prize will be paid on a Ticket that has been forged, altered, damaged or defaced in any way.

6.11 No Prize will be paid on a Ticket that fails THL’s validation process.

6.12 Online players may collect their Prize(s) of up to £2,000 in the Lottery Draw through their Health Lottery online account. For Online Prize Ticket winners, a Quick Pick will be issued automatically for entry into the next Draw after which the Prize Ticket was won. Other Prizes for higher amounts must be claimed by contacting The Health Lottery on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

6.13 Online Players who win a Prize or a combination of Prizes in excess of £2,000 in the Lottery Draw must contact The Health Lottery on 0844 375 55 55 in order to claim their Prize. Subscription Players will automatically receive notification from THL of their Prize.

6.14 By claiming and accepting a Prize Players agree to publicity which will be carried out at the sole discretion of the Company.

6.15 Should the total sum of Prizes due for payment in respect of any Lottery Draw exceed £15,000,000, THL reserves the right implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, THL will reduce the Jackpot , £10,000 and £250 Prizes in proportion so as to bring the total Prize payout to a minimum of £15,000,000.

6.16 In the event that the aggregate of the Match 2 + Bonus Ball and Match 3 Prizes due for payment in respect of any Lottery Draw exceeds £12,000,000, and the total Prize payout exceeds £15,000,000, THL reserves the right to implement Prize Capping to reduce the Jackpot, the £10,000, the £250, the £50, the £20 and the £10 Prizes in proportion in order to bring the total sum of Prizes paid to a minimum of £15,000,000.

6.17 In the event that the total value of Tickets sold of any constituent lottery in the Lottery Draw are less than £1,000,000 the Jackpot Prize for a Player’s Ticket in which five of the Winning Numbers are matched will be the greater of £25,000 or 10% of the total value of Tickets sold of that particular lottery. 
6.18 The Prize Pool for each weeks Lottery is calculated once the winning numbers have been entered into the system. All prizes on the Health Lottery will be paid in full unless Prize Capping is required.

6.19 THL reserves the right to change the Prize sums paid to Players without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.

6.20 Winning Players may be required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.

6.21 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned immediately to THL.

6.22 THL will use its reasonable endeavours to provide the Prize payment to the Player within fourteen days of receiving the Player’s identification documents but will not be liable for late delivery. Prizes for the Health Lottery Game must be claimed no later than 18.00 hours on the 180th day following the day of the draw. Any Prize not claimed within this period will be forfeited. If any Prize is claimed by post, THL must receive the Ticket and Claim Form at the address shown on the Claim Form within this period.

6.23 Each winning Player is responsible for paying any and all taxes on any Prize won.

6.24 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their written consent.

7 SELF EXCLUSION

7.1 Any Player may opt at any time to be excluded from purchasing Tickets for future Lottery Draws by visiting the Website or a Participating Retailer. For online Players at the start of the period of self-exclusion (the “Exclusion Term”), all monies held by THL in the Player’s e-wallet will be returned to the Player and the online account will be suspended.

7.2 Players may choose the length of the Exclusion Term, subject to a minimum period of six months. During the Exclusion Term, they will not be permitted to access their online account held with THL or to purchase any Tickets using that account.

7.3 THL will not contact the Player at the expiration of the Exclusion Term. The Player may reinstate the account held with THL by contacting info@healthlottery.co.uk, although a cooling-off period of one week will be imposed by THL before the account becomes active.

7.4 The Player may choose to enter another Exclusion Term at any time.

7.5 Players may choose to enter an opt-out scheme under which they will not receive marketing materials from THL. Where THL communicates with its Players by email, each message will include a brief description of the way that the recipient may notify THL that they wish communications to cease.

7.6 THL will remove from its marketing lists the details of any Player who, upon receipt of unwanted marketing material, calls THL’s Contact Centre or sends an email with the relevant details to unsubscribe@healthlottery.co.uk. If players no longer wish to receive SMS based marketing, they must text the word STOP to 63456.

7.7 Players should play responsibly. Information on how to gamble responsibly and how to access information about, and help in respect of, problem gambling can be found on the website or be sending a stamped addressed envelope to the address in clause 1.2 above. Alternatively information is available from www.gamcare.org.uk.

8 LIMITATION OF THE HEALTH LOTTERY’S LIABILITY AND RESERVATION OF RIGHTS

8.1 Nothing in these T&Cs shall exclude or limit THL’s liability:

(a) For death or personal injury resulting from THL’s negligence; or

(b) For fraudulent misrepresentation; or

(c) For liability that cannot be excluded or limited by law.

8.2 Subject always to clause 8.1 neither THL nor any of the societies participating in the Health Lottery from time to time shall be liable to a Player for any loss or damage suffered by a Player arising from:

(a) Any failures or delays in any delivery methods (including postal services) used by THL or the Player from time to time.

(b) Retailer error or incorrect or misuse of retailer terminal (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize).

(c) Any event which is beyond THL’s or the societies’ reasonable control.

And in addition;

(d) The Lottery is provided on an “as is” and “as available” basis and no representations or endorsements of any kind are made; and

(e) All warranties, conditions and guarantees relating to the Lottery made by or on behalf of THL, whether express or implied by law, in the course of dealing or otherwise, are excluded to the maximum extent permitted by law.

8.3 THL is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Lottery for:

(a) Loss of revenue, contract, profits, business or anticipated savings or loss of data;

(b) Any special or indirect or consequential losses; or

(c) Any loss of goodwill or reputation.

8.4 THL does not guarantee that use of the Website, telephone system, broadcast or live

transmission will be uninterrupted, timely and / or error-free.

8.5 Subject to clause 8.1, THL’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player.

8.6 THL is not responsible for any websites which may be visited via hyperlinks provided on the Website. Visitors to and transactions made on such websites are conducted entirely at the site user’s own risk.

8.7 THL reserves the right to exclude any Player from the Lottery in the event that THL believes in its sole discretion that the Player may be using technology to gain an unfair advantage over other Players of the Lottery.

9 LIABILITY OF PLAYERS

 9.1 Players agree to fully indemnify THL in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by THL due to the Player’s misuse of the Website.

9.2 Nothing contained in these T&Cs shall affect the statutory rights of any Player. THL’s Complaints Procedure is available on request by writing to the address in 1.2, by emailing THL on help@healthlottery.co.uk or by calling the Contact Centre on 0844 375 55 55. 10. COMPLAINTS

In the event of a complaint or to express any dissatisfaction with any aspect of The Health Lottery Players should email THL on help@healthlottery.co.uk or call the Contact Centre on 0844 375 55 55. 11 DISPUTE RESOLUTION

If a complaint is not resolved to a Player’s satisfaction by the use of THL’s Complaints Procedure, and subject to the dispute meeting the criteria detailed in the Gambling Commission’s Code of Practice, the Player may request information as to how to refer their complaint to an independent adjudicator. Further information regarding the referral of a complaint to an independent adjudicator is contained in The Health Lottery Complaints procedure, published on the Terms and Conditions page of the Health Lottery website.

12 INTELLECTUAL PROPERTY
All intellectual property rights generated as a result of the operation of the Lottery shall be the property of THL and Players agree to take all steps (at THL’s cost) to vest in THL any intellectual property which the Player creates in the course of entering the Lottery.

13 DATA PROTECTION

All information provided by Players to THL for the purposes of the Lottery will be stored, managed and used in accordance with current Data Protection legislation and also with the THL’s Privacy Statement as posted on the Website. THL’s Privacy Statement forms part of these T&Cs.

14 GOVERNING LAW

These T&Cs are governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.

15 INSOLVENCY

The lottery monies managed by THL and HLFL on behalf of the CICs are ring-fenced and covered by a Declaration of Trust of which the CICs and the Players are the beneficiaries. In the event that THL or HLFL are declared insolvent, the lottery funds are protected and the creditors of THL or HLFL will have no recourse to the lottery funds held on trust for the CICs and the Players.

Health Lottery Terms and Conditions valid for draws from 11th May 2013 to 15th September 2013

1. Introduction

1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for the lottery draw (the “Lottery”) which is promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies (“CICs”) listed on its website www.healthlottery.co.uk (the “Website”).

1.2 The correspondence address is The Health Lottery ELM Limited, Northern & Shell Building, 10 Lower Thames Street, London, EC3R 6EN.

1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence numbers 000-026057-R-309179 and 000-026057-N-309180.

1.4 The Health Lottery Scheme manages 51 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. They operate under the Gambling Act 2005, (“The Act”) each or all being referred to as “The Health Lottery”, depending on the context. 
Operating this way allows costs to be kept to a minimum so that larger sums of Society Lottery funding can be allocated to local health related Good Causes, and, unlike other lotteries, every single part of Great Britain gets their share of the appropriate proceeds.

1.5 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and proceeds are allocated according to ticket sales for each CIC that is open. Money is then donated to support health related ‘Good Causes’ within their respective local areas.

1.6 A complete list of the CICs promoting the society lotteries can be seen at Annex A.

1.7 Players should be aware that all the participating CICs are independent companies. THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and Good Causes they support is available. It should also be noted that the allocation of funds to Good Causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity People’s Health Trust and not by THL.

1.8 At least 20% of the proceeds of each Lottery shall be paid to health related Good Causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.

1.9 All entries into and participation in the Lottery is strictly governed by these T&Cs. By entering the Lottery, a Player agrees to be bound by the T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.

1.10 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the Website along with the Game Rules, and THL will provide a copy by post on receipt of a stamped addressed envelope at the address in clause 1.2 above.  T&Cs and booklets and copies of the shortened form of the T&Cs and Game Rules can be obtained on request from a Health Lottery Participating Retailer.

1.11 If and when changes are made to the T&Cs THL will use its database of Players that have registered online to notify all those Players for whom it has email details. THL will also distribute a revised version of its T&Cs to all Participating Retailers. The T&Cs may be amended by THL from time to time and will be published on the Website.

2 DEFINITIONS

ANY WORDS WITHIN THESE T&CS WHICH START WITH A CAPITAL LETTER SHALL HAVE THE FOLLOWING MEANINGS:

(a) “Bonus Ball’ means the number drawn in addition to the 5 regular numbers draw for the lottery game.  This may also be referred to as the “Bonus Number” in marketing materials.

(b) “Claim Form” means a printed form provided by THL by mail or email to Players claiming a Prize of more than £50 in accordance with the THL postal claim procedure.  

(c) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

(d) “Game Rules” means the rules which are applicable to playing the draw based lottery game and which are published on THL’s website.

(e) “Good Causes” means the promotion of health for the public benefit by increasing and supporting sustainable health equality in and for disadvantaged communities and groups across England, Scotland and Wales.

(f) 'Hot Ticket Draw' means the promotional draw that may be conducted from time to time by the Company using a random number generator to select winning Hot Ticket Codes from all of the Codes that have been entered into the relevant Lottery Draw. Match 5 winning tickets from the main Draw will not be eligible to win a Prize in the Hot Ticket Draw.

(g) 'Hot Ticket Code' means the Transaction Number provided by the eProvider to retail Players or by email to online Players which will be entered into the Hot Ticket Draw that the Company may conduct from time to time for promotional purposes for the chance to win additional Prizes as advertised.

(h) ‘Hot Ticket Prize’ means any prize be it a cash amount or a product offered by the Company as part of the Hot Ticket Draw it may run from time to time for promotional purposes. A product offered as a prize as part of this promotion may not be substituted for cash.

 (i) “Jackpot” or “Jackpot Prize” means the top prize in any Lottery Draw.

(j) “Lottery Draw” or “Draw” means the weekly lottery draw conducted by The Health Lottery every Wednesday and Saturday after 19:45, when sales will be closed for each week’s draw;

(k) “Lottery Ticket” or “Ticket” means the ticket which is purchased by a Player in anticipation of a Lottery Draw and which carries the numbers selected by the Player for entry into the Lottery and which may contain more than one line of play;

(l) “Participating Retailer” means a retailer or store that has agreed to sell Health Lottery tickets on behalf of THL and the CICs.

(m) “Play” means any individual selection of 5 numbers entered into the Lottery.

(n) “Player” means an eligible person who purchases a Lottery Ticket in accordance with these T&Cs; and

(o) “Prize” means the prize monies or non cash Prizes that may be won in the course of the Lottery draw or Hot Ticket draw in accordance with these T&Cs and any other rules of the Lottery.

(p) “Prize Capping” means the process that the Company may use to reduce the value of prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single draw exceeds £15m.

3 CONDITIONS OF ENTRY

3.1 To enter the Lottery and to be eligible to win a Prize, Players:

(a) Must be 16 years of age or over; and

(b) Must comply with these T&Cs and any other rules of the Lottery notified by THL.

3.2 Any corporate body incorporated and with a registered office address in Great Britain may purchase and claim prizes in the Lottery.

3.3 Excluded Persons are ineligible to participate in the Lottery and shall not be entitled to receive any Prizes. Players will have the option to self-exclude from a period of 6 months to 5 years. Once excluded, players will not be able to delete their account as a record of their exclusion must be kept.

3.4 All entry instructions communicated by THL shall form part of the Game Rules of the Lottery which are available on the Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2 above.

3.5 In purchasing a Ticket, Players acknowledge and agree that:

(a) They may be entered into a Lottery Draw which is not promoted by the CIC representing their geographic region; and

(b) A minimum of 20% of the Ticket price will go towards Good Causes.

3.6 By personally accepting the Prize from THL, Players warrant that they:

(a) Are not a director or an employee of THL, the CICs, People’s Health Trust, or a key IT contractor or supplier claiming a prize on their own behalf. A director or an employee of THL may however claim a prize on behalf of THL;

(b) Are not a spouse or dependent of any person described in 3.5(a); and

(c) Are eligible to win a Prize under clause 3.1; and

(d) Fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.

3.7 THL will have sole and absolute discretion as to whether to accept any entry to the Lottery and pay out any prizes. Its decision in the matter will be final and binding.

3.8 THL will rely on its own technical logs and records when determining whether the Player is eligible to receive a Prize.

3.9 The Player accepts that the Ticket they purchase in any week may not benefit directly the region in which they bought the Ticket. THL aims to ensure that different CICs representing different regions take it in turns to participate in The Health Lottery each week to ensure that across the course of a year, every participating region of the UK will benefit from monies raised as equally as possible.

3.10 Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Act and any relevant regulations made there under from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time and published on the THL Website.

4 HOW TO ENTER THE LOTTERY

4.1 Players enter the Lottery either by purchasing a paper Ticket from a retailer authorised by THL or by using the Website to purchase an online Ticket. Tickets will normally cost £1 per line per Draw. Participating Retailers may require proof of age or other identification to be shown before the Ticket will be sold. THL reserves the right to introduce new channels.

4.2 The Player must choose five different numbers, each of which must be between 1 and 50 inclusive, or may prefer to be allocated five different numbers in that range (a “Quick Pick”). The Player may choose to activate a Health Lottery Playcard (the “Playcard”) with their chosen five number selections for any play. Health Lottery Participating Retailers can activate a Playcard or Players may activate their Playcard by SMS, phoning the Contact Centre or on the Website. The activation of a Playcard will result in one or more selections of five numbers (up to a maximum of ten) being recorded on The Health Lottery account record designated by the unique number on the Playcard in question.

4.3 Following activation, a Playcard may be used to purchase Tickets for future Draws.

4.4 A Ticket will be valid only for the Draw(s) to be held on the date(s) shown on the face of the Ticket. Players may choose to purchase a Ticket which enters the Player into the Lottery for up to eight weeks in advance.

4.5 It is the Player’s responsibility to check at the time of purchase that the date of the Draw and the numbers shown on the Ticket are those requested.

4.6 Cancellations are allowed only under exceptional circumstances. Any cancellation or reversal will need to be completed at the same location and on the same terminal as the original transaction. THL will allow cancellations and reversals for both a Ticket sale and a payout. In e-pay and Payzone Retailers, also in Participating Retailers using their own EPOS system to sell Tickets there will be a 30 minute window after which a reversal and cancellation cannot be performed at the terminal. PayPoint Retailers will only allow a cancellation within 10 minutes of the relevant transaction provided that no other transactions have been made in the interim.

4.7 For the avoidance of doubt, a Player may not seek cancellation of a Quick Pick Ticket if the numbers selected are not to his or her liking.

4.8 A Player may in certain circumstances request the repayment of their stake, should that Player have purchased a ticket in advance of a Draw that is subject to a change in these Terms and Conditions, prior to the point at which the changed Terms and Conditions have been published by the Company on their website. The Player must contact the Company in writing at Dept 399, 2nd Floor, Queensgate, Grange Road East, Birkenhead CH41 5FD, including enclosing the original ticket, name, address, and the bank details to which the refund should be credited. This communication and ticket must be received by the Company at least 72 hours in advance of the affected Draw subject to the limitations stated in clause 8.2. Online Players must notify the Company by email using their registered email address within the same 72 hour timeline in order to facilitate the refund. The Player accepts that if their application for a refund is accepted their ticket will be withdrawn from the applicable draw and will not be eligible for any prizes.

4.9 The Player is solely responsible for ensuring that the Ticket remains safe and in a good and legible condition. For Players having participated in the Draw by purchasing a Ticket from a Retailer, the Ticket is sole evidence of entry into the Draw and must be in the possession of the Player to enable them to claim a Prize. The Playcard cannot be used to claim a Prize or be relied upon as evidence of entry into a Draw.

4.10 Subject always to clause 9.2, THL accepts no responsibility for lost, stolen, damaged or defaced tickets.

5 PLAYING THE LOTTERY ONLINE

5.1 Online Players of the Lottery are required to provide THL with their name, date of birth, address, contact details and bank details before an online registration will be processed. In order to play online Players must have a GB registered debit card registered at a GB address. Identity checks will be carried out to confirm that the player is at least 16 years old.

5.2 Registered online Players will be provided with an e-wallet in which they may deposit funds which they wish to use to participate in the Lottery Draws. No more than £500 may be deposited in the e-wallet in a single transaction. Players can only make payments by Debit Card which will be made to Health Lottery Financial Ltd (“HLFL”), a sister company of THL which handles all financial transactions for THL and the CICs. Players who supply details of a jointly owned bank account accept that Prizes won will be paid into that account.

5.3 Online Players can play by subscription using Direct Debit (“Subscription Players”). The Direct Debit Guarantee applies to all Direct Debit arrangements set up by the Players. Direct Debits will be collected by HLFL.

5.4 No online Player may purchase more than £40 of Tickets for any single Lottery Draw.

5.5 No online Player will be permitted to deposit more money if the balance in their e-wallet is more than £2,000.

5.6 THL reserves the right to impose such cooling-off periods on the use of deposited monies as it considers appropriate and will notify the same to Players before the deposit is accepted.

5.7 THL reserves the right to terminate a Player’s online account at any time, at its absolute discretion. Upon the termination of the online account, all monies held by THL on behalf of the Player will be returned to the Player’s bank account within 5 working days players may be asked if they wish to be contacted for advertising, promotional and marketing purposes. If Players wish to be removed from THL’s mailing list, they should click on the unsubscribe link shown on all Health Lottery e-mails or contact THL at unsubscribe@healthlottery.co.uk or call the Health Lottery Contact centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

6 THE LOTTERY DRAW AND PRIZES

6.1 The Lottery Draw will be broadcast, as advertised, on a weekly basis on Wednesdays and Saturdays. THL reserves the right to change the broadcast arrangements for the Draw from time to time and will notify Players of any such change either directly, if they are online players, or through notification posted on the ‘News’ page of its website.

6.2 The names of the participating CICs which will benefit from the Draw in any one week will be displayed on the Website and the relevant CIC name will also appear on the Ticket. Tickets for more than one Draw will clearly display the date of all Draws and the relevant CIC for each Draw.

6.3 The results of any Lottery will be published on the Website or in any other source shall be for information purposes only and a Prize shall only be awarded to a winning ticket which has the number(s) recorded at the draw itself, by THL and an independent auditor. On-line players will be notified automatically to their registered e-mail address if they have won a prize.

6.4 In the Lottery Draw, five numbers will be drawn at random by an approved ball machine from the range between 1 and 50 inclusive (the “Winning Numbers”). An additional number, the Bonus Ball, will be drawn after all five main numbers have been drawn.

6.5 Only one Prize may be claimed in respect of each entry made to the Lottery Draw. Subject to this clause 6, Prizes paid to the holders of Tickets with Winning Numbers in the Lottery Draw will be as follows:

- If two Winning Numbers and the Bonus Ball are matched on the player’s ticket, the Player will win one Prize of £10.

- If three of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £20.

-If three of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £50.

- If four of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £250.

-If four of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £10,000.

-If five of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of up to an amount of £100,000, subject to the limitations in Clause 6.16 which state that the Jackpot cannot exceed 10% of proceeds. Therefore in the event that the total value of Tickets sold of any constituent lottery in the Lottery Draw are less than £1,000,000 the Jackpot Prize for a Player’s Ticket in which five of the Winning Numbers are matched will be the greater of £25,000 or 10% of the total value of Tickets sold of that particular lottery.

6.6 Players who win a cash Prize of up to £50 inclusive with a paper Ticket may collect their Prize from any Participating Retailer which sells Tickets for the Lottery Draw. Players who win a Prize in excess of £50 with a paper Ticket must contact THL on 0844 375 55 55 in order to claim their Prize. Players who accumulate multiple Prizes of £10 or £20 on the same ticket must also contact THL to claim their Prize if the total amount accumulated exceeds £50, as a Retailer will not pay winnings over £50 per ticket. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary. THL will only pay out cash Prizes in excess of £50 by cheque or electronic transfer to a UK bank account. THL reserves the right to pay cash Prizes in excess of £50 by means of any new payment method that becomes available in the future.

6.7 The Player is responsible for ensuring that the correct Prize is paid by the Retailer for a match 2 balls plus Bonus Ball win or a match 3 balls win or match 3 balls plus bonus ball win at the time the Ticket is validated.

6.8 Hot Ticket Prizes can be claimed up to 180 days after the draw. Players must contact the Health Lottery on 0844 375 5555 in order to claim their prize. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

6.9 No Prize will be paid on a Ticket that has been forged, altered, damaged or defaced in any way.

6.10 No Prize will be paid on a Ticket that fails THL’s validation process.

6.11 Online players may collect their Prize(s) of up to £250 through their Health Lottery online account. Other Prizes for higher amounts must be claimed by contacting The Health Lottery on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 5p per minute from a BT landline. Charges from other service providers will vary.

6.12 Online Players who win a Prize in excess of £250 must contact The Health Lottery on 0844 375 55 55 in order to claim their Prize. Subscription Players will automatically receive notification from THL of their Prize.

6.13 By claiming and accepting a Prize Players agree to publicity which will be carried out at the sole discretion of the Company.

6.14 Should the total sum of Prizes due for payment in respect of any Lottery Draw exceed £15,000,000, THL reserves the right implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, THL will reduce the Jackpot , £10,000 and £250 Prizes in proportion so as to bring the total Prize payout to a minimum of £15,000,000.

6.15 In the event that the aggregate of the Match 2 + Bonus Ball and Match 3 Prizes due for payment in respect of any Lottery Draw exceeds £12,000,000, and the total Prize payout exceeds £15,000,000, THL reserves the right to implement Prize Capping to reduce the Jackpot, the £10,000, the £250, the £50, the £20 and the £10 Prizes in proportion in order to bring the total sum of Prizes paid to a minimum of £15,000,000.

6.16 In the event that the total value of Tickets sold of any constituent lottery in the Lottery Draw are less than £1,000,000 the Jackpot Prize for a Player’s Ticket in which five of the Winning Numbers are matched will be the greater of £25,000 or 10% of the total value of Tickets sold of that particular lottery.

6.17 The Prize Pool for each weeks Lottery is calculated once the winning numbers have been entered into the system. All prizes on the Health Lottery will be paid in full unless Prize Capping is required.

6.18 THL reserves the right to change the Prize sums paid to Players without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.

6.19 Winning Players may be required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.

6.20 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned immediately to THL.

6.21 THL will use its reasonable endeavours to provide the Prize payment to the Player within fourteen days of receiving the Player’s identification documents but will not be liable for late delivery. Prizes for the Health Lottery Game must be claimed no later than 18.00 hours on the 180th day following the day of the draw. Any Prize not claimed within this period will be forfeited. If any Prize is claimed by post, THL must receive the Ticket and Claim Form at the address shown on the Claim Form within this period.

6.22 Each winning Player is responsible for paying any and all taxes on any Prize won.

6.23 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their written consent.

7 SELF EXCLUSION

7.1 Any Player may opt at any time to be excluded from purchasing Tickets for future Lottery Draws by visiting the Website or a Participating Retailer. For online Players at the start of the period of self-exclusion (the “Exclusion Term”), all monies held by THL in the Player’s e-wallet will be returned to the Player and the online account will be suspended.

7.2 Players may choose the length of the Exclusion Term, subject to a minimum period of six months. During the Exclusion Term, they will not be permitted to access their online account held with THL or to purchase any Tickets using that account.

7.3 THL will not contact the Player at the expiration of the Exclusion Term. The Player may reinstate the account held with THL by contacting info@healthlottery.co.uk, although a cooling-off period of one week will be imposed by THL before the account becomes active.

7.4 The Player may choose to enter another Exclusion Term at any time.

7.5 Players may choose to enter an opt-out scheme under which they will not receive marketing materials from THL. Where THL communicates with its Players by email, each message will include a brief description of the way that the recipient may notify THL that they wish communications to cease.

7.6 THL will remove from its marketing lists the details of any Player who, upon receipt of unwanted marketing material, calls THL’s Contact Centre or sends an email with the relevant details to unsubscribe@healthlottery.co.uk. If players no longer wish to receive SMS based marketing, they must text the word STOP to 63456.

7.7 Players should play responsibly. Information on how to gamble responsibly and how to access information about, and help in respect of, problem gambling can be found on the website or be sending a stamped addressed envelope to the address in clause 1.2 above. Alternatively information is available from www.gamcare.org.uk.

8 LIMITATION OF THE HEALTH LOTTERY’S LIABILITY AND RESERVATION OF RIGHTS

8.1 Nothing in these T&Cs shall exclude or limit THL’s liability:

(a) For death or personal injury resulting from THL’s negligence; or

(b) For fraudulent misrepresentation; or

(c) For liability that cannot be excluded or limited by law.

8.2 Subject always to clause 8.1 neither THL nor any of the societies participating in the Health Lottery from time to time shall be liable to a Player for any loss or damage suffered by a Player arising from:

(a) Any failures or delays in any delivery methods (including postal services) used by THL or the Player from time to time.

(b) Retailer error or incorrect or misuse of retailer terminal (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize).

(c) Any event which is beyond THL’s or the societies’ reasonable control.

And in addition;

(d) The Lottery is provided on an “as is” and “as available” basis and no representations or endorsements of any kind are made; and

(e) All warranties, conditions and guarantees relating to the Lottery made by or on behalf of THL, whether express or implied by law, in the course of dealing or otherwise, are excluded to the maximum extent permitted by law.

8.3 THL is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Lottery for:

(a) Loss of revenue, contract, profits, business or anticipated savings or loss of data;

(b) Any special or indirect or consequential losses; or

(c) Any loss of goodwill or reputation.

8.4 THL does not guarantee that use of the Website, telephone system, broadcast or live

transmission will be uninterrupted, timely and / or error-free.

8.5 Subject to clause 8.1, THL’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player.

8.6 THL is not responsible for any websites which may be visited via hyperlinks provided on the Website. Visitors to and transactions made on such websites are conducted entirely at the site user’s own risk.

8.7 THL reserves the right to exclude any Player from the Lottery in the event that THL believes in its sole discretion that the Player may be using technology to gain an unfair advantage over other Players of the Lottery.

9 LIABILITY OF PLAYERS

9.1 Players agree to fully indemnify THL in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by THL due to the Player’s misuse of the Website.

9.2 Nothing contained in these T&Cs shall affect the statutory rights of any Player. 10. COMPLAINTS

11 DISPUTE RESOLUTION

If a complaint is not resolved to a Player’s satisfaction by the use of THL’s Complaints Procedure, and subject to the dispute meeting the criteria detailed in the Gambling Commission’s Code of Practice, the Player may request information as to how to refer their complaint to an independent adjudicator. Further information regarding the referral of a complaint to an independent adjudicator is contained in The Health Lottery Complaints procedure, published on the Terms and Conditions page of the Health Lottery website.

12 INTELLECTUAL PROPERTY

All intellectual property rights generated as a result of the operation of the Lottery shall be the property of THL and Players agree to take all steps (at THL’s cost) to vest in THL any intellectual property which the Player creates in the course of entering the Lottery.

13 DATA PROTECTION

All information provided by Players to THL for the purposes of the Lottery will be stored, managed and used in accordance with current Data Protection legislation and also with the THL’s Privacy Statement as posted on the Website. THL’s Privacy Statement forms part of these T&Cs.

14 GOVERNING LAW

These T&Cs are governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.

15 INSOLVENCY

The lottery monies managed by THL and HLFL on behalf of the CICs are ring-fenced and covered by a Declaration of Trust of which the CICs and the Players are the beneficiaries. In the event that THL or HLFL are declared insolvent, the lottery funds are protected and the creditors of THL or HLFL will have no recourse to the lottery funds held on trust for the CICs and the Players.

ANNEX A COMMUNITY INTEREST COMPANIES:

The Health Lottery Scheme manages 51 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. The 51 Community Interest Companies were established and are conducted to tackle health inequalities in their respective local area.

Health Lottery Game Rules valid for draws from 1st January 2014

1. Introduction

1.1 The Game Rules below set out the rules for the lottery draw (the “Lottery”) which is promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies (“CICs”) listed on its website www.healthlottery.co.uk (the “Website”).

1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence numbers 000-026057-R-309179 and 000-026057-N-309180.

1.4 The Health Lottery Scheme manages 51 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. They operate under the Gambling Act 2005, (“The Act”) each or all being referred to as ”The Health Lottery”, depending on the context. Operating this way allows costs to be kept to a minimum so that larger sums of Society Lottery funding can be allocated to local health related Good Causes, and, unlike other lotteries, every single part of Great Britain gets their share of the appropriate proceeds.

1.5 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and proceeds are allocated according to ticket sales for each CIC that is open. Money is then donated to support health related ‘Good Causes’ within their respective local areas.

1.6 A complete list of the CICs promoting the society lotteries can be seen at Annex A of the Terms and Conditions (T&Cs) published on THL’s website and available from Retailers.

1.7 Players should be aware that all the participating CICs are independent companies. THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and Good Causes they support is available. It should also be noted that the allocation of funds to Good Causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity People’s Health Trust and not by THL.

1.8 At least 20% of the proceeds of each Lottery shall be paid to health related Good Causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.

1.9 All entries into and participation in the Lottery is strictly governed by these Game Rules and the T&Cs. By entering the Lottery, a Player agrees to be bound by the Game Rules and T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these Game Rules or T&Cs have been breached.

1.10 THL reserves the right to amend these Game Rules from time to time. The current Game Rules will be posted on the Website, and THL will provide a copy by post on receipt of a stamped addressed envelope at the address in 1.2.    The Health Lottery Game played at a Retailer, via the Health Lottery Website or by Online or Offline Direct Debit is governed by the Terms & Conditions and these Game Rules.

2 Definitions
Any words within these Rules which start with a capital letter shall have the following meanings:

Bonus Ball’ means the number drawn in addition to the 5 Regular Numbers draw for the lottery game.  This may also be referred to as the ‘Bonus Number’ in marketing materials.

‘Cancelled Draw' means any Draw which does not take place by reason only of the expiry, suspension or revocation of either the Company's Licence from the Gambling Commission.

'Central Computer System' means the computer systems used by the Company from time to time to operate Health Lottery games.

'Claimant' means a Player or Direct Debit Player who submits a claim for a prize payment within the applicable claim period.

'Commission' means the Gambling Commission, being the body that regulates the Lottery.

'Company' means The Health Lottery ELM Limited, Northern & Shell Building, 10 Lower Thames Street, London, EC3R 6EN.

‘Claim Form’ means the form that will be supplied to a claimant to be completed as part of the process for claiming a prize.

‘Defective Ticket’ means a ticket which at the time of purchase is damaged, defaced, illegible or incomplete or which contains the words ‘void’ or ‘not for sale’ or similar wording.

'Direct Debit' means the entitlement to participate in Games for a multiple number of Draws in accordance with these Game Rules and the T&Cs.

'Direct Debit Player’ means a person whose application to play Game by Direct Debit has been accepted by the Company.

‘Draw Machine’ means the device used to select Winning numbers.

'Entry' means a chance or entry/entries in the Game which has been registered as an entry on the Central Computer System.

‘Excluded Person’ means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

'Game' means The Health Lottery Game.

'Hot Ticket Draw' means the promotional draw that may be conducted from time to time by the Company using a random number generator to select winning Hot Ticket Codes from all of the Codes that have been entered into the relevant Lottery Draw. Match 5 winning tickets from the main Draw will not be eligible to win a Prize in the Hot Ticket Draw.

'Hot Ticket Code' means the Transaction Number provided by the eProvider to retail Players or by email to online Players which will be entered into the Hot Ticket Draw that the Company may conduct from time to time for promotional purposes for the chance to win additional Prizes as advertised.

‘Hot Ticket Prize’ means any prize be it a cash amount or a product offered by the Company as part of the Hot Ticket Draw it may run from time to time for promotional purposes. A product offered as a prize as part of this promotion may not be substituted for cash.

‘Lottery Draw’ or ‘Draw’ means the weekly lottery draw conducted by The Health Lottery every Wednesday and Saturday after sales have been closed for each week’s draw;

‘Lottery Ticket’ and ‘Ticket’ means the ticket which is purchased by a Player in anticipation of a Health Lottery Draw and which carries the numbers selected by the Player for entry into the Lottery.

'Multi-draw' means a facility to play the Game for a number of Draws with the purchase in advance of one Ticket, the number and frequency of such Draws available for selection by Players using the facility being as determined by the Company from time to time.
‘Participating Retailer’ means a retailer or store that has agreed to sell Health Lottery tickets on behalf of THL and the CICs.

'Play Card Selection' means one set of five numbers chosen between 1-50 by a Player which have been associated with a Play Card.

'Player' means a member of the Playing Public who purchases a ticket, who is eligible to play the Game in accordance the Terms and Conditions relating to this Game.

'Prize' means a prize won by a Player in the Game.

'Quick Pick' means a Selection consisting of five different numbers which, instead of being selected by a Player, are selected on a random basis by the Company's Central Computer System on behalf of that player.

‘Regular Number’ means the 5 numbers drawn before the Bonus Ball in the Draw.

'Retailer' means any person, firm or company that sells Tickets and/or pays Prizes.

‘Retail Player’ means any Player who plays the game by purchasing a Ticket at a Retailer.

'Selection' means one set of five numbers chosen by a Player which is recorded on a Ticket issued in accordance with the Rules, and includes a Quick Pick recorded on a Ticket and a set of five numbers chosen by a Player which is keyed in manually by a Retailer and which is recorded on a Ticket

'Terminal' means the machine which allows Tickets to be printed.

'Valid Winning Ticket' means a winning Ticket which meets all Ticket validation requirements as set out or referred to in these Rules.

'Winning Numbers' means the Numbers, used to determine the winning Entries.

'Winning Selection' means a selection which entitles a Player to a Prize in the category applicable to the correct numbers selected.

3. The Game

The game is called The Health Lottery Game.

4. Draw

The Draw for the Game will take place using a Draw Machine to select the winning numbers. It will take place twice a week on Wednesday and Saturday or at any other time as may be determined by the Company. From time to time the Draw may be held on a different day if a Bank holiday falls on a Wednesday or a Saturday. Changing the day of the draw will be decided at The Health Lottery’s sole discretion.

4.1 Hot Ticket Draw

In addition to the Draw for the game, the Company may undertake from time to time, using a random number generator to select a number of winning Hot Ticket Codes from all the codes that have been entered into the relevant Lottery Draw. Match 5 winning tickets from the main Draw will not be eligible to win a Prize in the Hot Ticket Draw.

5. Method of Play

5.1 Cost of Play

(a) Each Entry has a cost of £1.

(b) The cost of a Multi-draw Ticket will be the total cost of the Entries selected multiplied by the number of Draws the Player has requested.

5.2 Making a Selection

(i) Using a Play Card to purchase a Ticket

(a) On any one Play Card a Retail Player may play a minimum of one Selection and a maximum 10 selections where the numbers are provided by the Player to the Retailer.

(b) Each Selection is made by manually writing five numbers within white boxes printed on the Play Card. A maximum of 4 selections of 5 numbers can be written on the Play Card. Additional line may be added by asking the retailer at the time of purchase, up to a limit of 10 lines per Play Card.

(c) A Retail Player using a completed Play Card to purchase a Ticket will submit the Play Card to the Retailer. The completed Play Card containing the Retail Players selected numbers will then be activated by the retailer and the numbers will be entered into the chosen number of Draws by the Retailer using the Retail Terminal, which will issue the Ticket recording each Selection written on the Play Card. It is the responsibility of the Player to check that the numbers printed on the Ticket are consistent with the numbers marked on the Players’ Play Card.

(d) Where the Retail Player would like to play for Multiple draws they will be required to inform the Retailer how many draws they wish their Ticket to be entered into during the process of placing their selection, where the Retail Terminal will prompt the Retailer to ask the player how many weeks they would like their Ticket to be entered for.

(ii) Purchasing a Ticket Using Quick Pick or manually via the Retailer

(a) A Retail Player may purchase a Ticket from a Terminal without completing a Play Card, by requesting the Retailer to key in a selection of numbers manually by specifying the five numbers required per entry into the Game, up to a maximum of 10 selections

(b) A Retail Player may purchase a Ticket from a Terminal, without completing a Play Card, by requesting the Retailer to issue a Ticket via Quick Pick.

(iii) Purchasing a Ticket or creating a Direct Debit using the Health Lottery Website

Player may enter the draw via the Website using the Direct Debit features provided. A player must first register to set up an account in accordance with the Terms and Conditions for playing Health Lottery on-line.

(a) The Company will confirm the Direct Debit entry by email to the Players registered email address confirming the entry into the Draw(s), the numbers selected, the name of the CIC(s) participating in the Draw (s), the date of the Draw and the amount paid.

(b) Any Play or Direct Debit that is not recorded on the Company's Central Computer System will not be valid, any print out or other representation of any Play captured by a Player that is not registered on the Company’s Computer System will not be valid.

(c) Players may not purchase a Play or set up a Direct Debit when physically located outside Great Britain.

5.3 Cancellation of a Ticket

(a) A Ticket bought at a Retailer may be cancelled only in exceptional circumstances such as the numbers entered into the Retail Terminal by the Retailer are not the same as the numbers written on the Play Card as selected by the Retail Player, or a ticket contains two or more Quick pick Selections comprising the same five numbers.

(b) A Ticket falling within the terms of paragraph 3 (a) above may only be cancelled:

• At e-pay and Payzone Retailers, and in Participating Retailers using their own EPOS system to sell Tickets within a 30 minute period after the original sale

• At Pay Point Retailers within 10 minutes of the original sale provided that no other transactions have been made in the interim.

In both instances this must be before the close of sales for the relevant Draw

(c) For the avoidance of doubt, a Retail Player may not seek cancellation of a Quick pick Ticket by reason only of the number selection(s) on the Ticket not being to their liking.

(d) Tickets purchased on-line may not be cancelled in any circumstances .

(e) Direct Debits can be cancelled for any purchases that have not yet been placed in a draw. Direct Debit payments will be collected monthly on either the 1st of or the 15th day of the month, where that day falls on a bank holiday or weekend the payment will be taken on the next working day. In the event that a player who plays by Direct Debit chooses to cancel a Direct Debit the payment will be cancelled for the next collection cycle. Any plays for which money has been collected that have been entered into the draw cannot be cancelled under any circumstances.

5.4 Multi-draws

A Multi-draw Ticket shall not be capable of cancellation other than in accordance with paragraph 5.3 above and, in any event, prior to the first Draw in respect of which the Ticket has been issued.

5.5 Winning Selections

Subject to the Terms & Conditions and the Game Rules for the Game, a Player who, has the following combination of numbers which match the Numbers drawn will be entitled to a Prize.

Match 2 main balls and the Bonus Ball category
Any Player who has correctly matched two numbers in any one selection from the five Numbers drawn and has correctly matched the Bonus Ball number.

Match 3 category
Any Player who has correctly matched three numbers in any one selection from the five Numbers drawn.

Match 3 main balls and the Bonus Ball category
Any Player who has correctly matched three numbers in any one selection from the five Numbers drawn and has correctly matched the Bonus Ball number.

Match 4 category
Any Player who has correctly matched four numbers in any one selection from the five Numbers drawn.

Match 4 main balls and the Bonus Ball category
Any Player who has correctly matched four numbers in any one selection from the five Numbers drawn and has correctly matched the Bonus Ball number.

Match 5 category
Any Player who has correctly matched five numbers in any one selection from the five Numbers drawn.

6.2 The Company may from time to time undertake promotional activities that offer additional or enhanced prizes; separate Terms and Conditions and Rules will be made available to players via the Website under the ‘Promotions’ tab which will set out the details of the promotion and the draw that it applies to. Players will be notified by way of advertising when Promotions are to take place. Promotions will be in addition to the prizes shown in 6.1 and may include an increase of the top prize for matching 5 numbers, subject to a limit of 10% of proceeds. Promotions may also from time to time include a prize for matching 2 numbers.

7. Refunds in Certain Circumstances

7.1 In the event of a Cancelled Draw the Company shall:

(a) refund a Retail Player who has purchased either a Ticket for the Cancelled Draw only or a Multi-draw Ticket for the Cancelled Draw and other Draws, an amount equal to that part of the Ticket purchase price as was paid in respect of and is attributable to the Cancelled Draw;

(b) refund to Direct Debit Players who hold a valid Direct Debit for Draws which include the Cancelled Draw that proportion of the amount previously paid by the Direct Debit Player for that Direct Debit as was paid in respect of and is attributable to the Cancelled Draw;

(c) A Player may in certain circumstances request the repayment of their stake, should that Player have purchased a ticket in advance of a Draw that is subject to a change in the Terms and Conditions, prior to the point at which the changed Terms and Conditions have been published by the Company on their website. The Player must contact the Company in writing at Dept 399, 2nd Floor, Queensgate, Grange Road East, Birkenhead CH41 5FD, including enclosing the original ticket, name, address, and the bank details to which the refund should be credited. This communication and ticket must be received by the Company at least 72 hours in advance of the affected Draw subject to the limitations stated in clause 8.2 of the Company’s T&Cs. Online Players must notify the Company by email using their registered email address within the same 72 hour timeline in order to facilitate the refund. The Player accepts that if their application for a refund is accepted their ticket will be withdrawn from the applicable draw and will not be eligible for any prizes.

7.2 Any refund and payment under paragraph 7.1 (a) or (b) respectively must be claimed by the Retail Player. The methods of claiming, payment, the validation of claims and (subject to paragraph 7.3 below) the period within which such claims may be made shall be as determined by the Company in its absolute discretion from time to time.. A Retail Player will in any event be required to produce the Ticket before any refund or payment will be made.

7.3 The period referred to in paragraph 7.2 above shall be a period expiring not earlier than the day 90 days after the date on which the Cancelled Draw was to have taken place.

7.4 Any refund under paragraph 7.1 (b) above shall be made by such means and within such period as the Company shall in its absolute discretion determine from time to time.

7.5 Neither the Company nor any Retailer shall in any circumstances be liable to pay interest in respect of refunds or payments made under this paragraph 7.

8. Validation of Tickets

8.1 Before a Prize may be paid on any Ticket, it must be validated according to the Company’s validation procedure. The decision by the Company whether or not the ticket is valid shall be final and binding, foregoing, the Company shall be entitled to declare a Ticket invalid, and accordingly shall not be obliged to pay any prize if:

(a) The Ticket has been cancelled, whether in accordance with the Company’s procedure for cancellation or otherwise.

(b) The Ticket is counterfeit, has been forged in part or in whole or fails to pass the security test appropriated to the method of play.

(c) The ticket has been defaced, is damaged, defected, mutilated, altered, unreadable, and in-complete or tampered with in any manner.

(d) The Ticket has not been received by the Company within the Prize Claim Period as specified in these Rules or the Terms and Conditions relating to this Game.

(e) The Serial number on the Ticket does not appear on the Company’s list of Serial Numbers of Winning Tickets or is a Valid Winning Ticket of Ticket that has been paid previously.

(f) The Ticket does not appear on the list of Tickets sold for entry to the particular Draw, stored on the Company’s Computer System.

(g) Any number on the Ticket is not present in its entirety or is not fully legible.

(h) The Ticket has not been issued or sold in an authorised manner by the Company or by an authorised Retailer.

(i) The Ticket has been refunded under clause 7.1 (c) of these Game Rules

9. Disputed Tickets

If a dispute arises between the Company and the owner of a Ticket or Claimant as to whether a Ticket is a Valid Winning Ticket, and the Ticket prize claimed has not been paid the Company may, solely at is option, reimburse the cost of the Ticket or replace the disputed Ticket with a Ticket of equivalent sale price for any current Game. This shall be the owner of the Ticket or Claimant’s sole and exclusive remedy, and such reimbursement or replacement shall fully discharge the Company from and liability in respect of such dispute.

10. Purchase and Prize Restrictions

10.1 There shall be no general right for any person to purchase a Ticket. In particular, but without limitation, no Ticket may be purchased or prize paid to

• Any minor whether acting on their own behalf or on behalf of another person

• Any director or an employee of THL, the CICs, Peoples Health Trust, or a key IT contractor or supplier, or any spouse or dependents of the same; and

For the avoidance of doubt any Participating Retailers who act as direct agents of the CICs and use Pay Point, e-pay or Payzone terminals and software to transact Lottery Tickets will not be deemed to be agents of THL for the purposes of this clause and will be entitled to buy Tickets and receive Prizes from THL.

10.2 In the event that a Prize is paid to a person in one of the classes in 10.1 such a prize shall be repayable by that person to the Company on demand.

10.3 The Company, in its sole discretion, may refuse to sell Tickets to any person or persons without giving reasons, but which may include circumstances in which, in its view, that person or persons are playing in a manner which it or its Retailers deems to be interfering with other Players’ reasonable access to that Game.

11. Prize Claim Period

Prizes for the Health Lottery Game and any related Promotion must be claimed no later than 18.00hrs on the 180th day after the winning draw date. Any such prize not claimed within this period will be forfeited. If any prize is claimed by post, the Company must receive the Ticket and Claim form at the address shown on these Rules within this period.

12. Responsibility for Tickets

The player is responsible for the safe custody of the Ticket.

13. Dissemination of Winning Numbers Information

The results of each draw, will be issued to the national media and may also be made available in other manners from time to time. Winning numbers will be available via any Retailer outlet at the request of a Player, the information made available will include:

-The date of the draw
-The winning numbers 
-The CIC(s) to which the draw relates

14. Binding Decisions

The Company’s decisions as to whether or not a Ticket is a winning Ticket or in respect of any other matter or dispute arising from the payment or awarding or non-payment or non-awarding of prizes shall be final and binding upon all Players and any other person or persons having any interest in the matter or dispute. In the event of a dispute in respect of a winning Ticket, a Claim Form, or the payment or awarding of any prize, the Company may withhold payment of the prize and/or make an equivalent payment into court until the dispute has been resolved.

15. Law

These Rules and Terms & Conditions and the rights and obligations of the Company, Players and Direct Debit Players set out herein shall be governed by and construed in all respects in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

Health Lottery Game Rules valid for draws from 11th May 2013 to 31st December 2013

1. Introduction

1.1 The Game Rules below set out the rules for the lottery draw (the “Lottery”) which is promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies (“CICs”) listed on its website www.healthlottery.co.uk (the “Website”).

1.2 The correspondence address is The Health Lottery ELM Limited, Northern & Shell Building, 10 Lower Thames Street, London, EC3R 6EN.

1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence numbers 000-026057-R-309179 and 000-026057-N-309180.

1.4 The Health Lottery Scheme manages 51 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. They operate under the Gambling Act 2005, (“The Act”) each or all being referred to as ”The Health Lottery”, depending on the context. Operating this way allows costs to be kept to a minimum so that larger sums of Society Lottery funding can be allocated to local health related Good Causes, and, unlike other lotteries, every single part of Great Britain gets their share of the appropriate proceeds.

1.5 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and proceeds are allocated according to ticket sales for each CIC that is open. Money is then donated to support health related ‘Good Causes’ within their respective local areas.

1.6 A complete list of the CICs promoting the society lotteries can be seen at Annex A of the Terms and Conditions (T&Cs) published on THL’s website and available from Retailers.

1.7 Players should be aware that all the participating CICs are independent companies. THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and Good Causes they support is available. It should also be noted that the allocation of funds to Good Causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity People’s Health Trust and not by THL.

1.8 At least 20% of the proceeds of each Lottery shall be paid to health related Good Causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.

1.9 All entries into and participation in the Lottery is strictly governed by these Game Rules and the T&Cs. By entering the Lottery, a Player agrees to be bound by the Game Rules and T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these Game Rules or T&Cs have been breached.

1.10 THL reserves the right to amend these Game Rules from time to time. The current Game Rules will be posted on the Website, and THL will provide a copy by post on receipt of a stamped addressed envelope at the address in 1.2.    The Health Lottery Game played at a Retailer, via the Health Lottery Website or by Online or Offline Direct Debit is governed by the Terms & Conditions and these Game Rules.

2 Definitions
Any words within these Rules which start with a capital letter shall have the following meanings:

Bonus Ball’ means the number drawn in addition to the 5 regular numbers draw for the lottery game.  This may also be referred to as the ‘Bonus Number’ in marketing materials.

‘Cancelled Draw' means any Draw which does not take place by reason only of the expiry, suspension or revocation of either the Company's Licence from the Gambling Commission.

'Central Computer System' means the computer systems used by the Company from time to time to operate Health Lottery games.

'Claimant' means a Player or Direct Debit Player who submits a claim for a prize payment within the applicable claim period.

'Commission' means the Gambling Commission, being the body that regulates the Lottery.

'Company' means The Health Lottery ELM Limited, Northern & Shell Building, 10 Lower Thames Street, London, EC3R 6EN.

‘Claim Form’ means the form that will be supplied to a claimant to be completed as part of the process for claiming a prize.

‘Defective Ticket’ means a ticket which at the time of purchase is damaged, defaced, illegible or incomplete or which contains the words ‘void’ or ‘not for sale’ or similar wording.

'Direct Debit' means the entitlement to participate in Games for a multiple number of Draws in accordance with these Game Rules and the T&Cs.

'Direct Debit Player’ means a person whose application to play Game by Direct Debit has been accepted by the Company.

‘Draw Machine’ means the device used to select Winning numbers.

'Entry' means a chance or entry/entries in the Game which has been registered as an entry on the Central Computer System.

‘Excluded Person’ means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

'Game' means The Health Lottery Game.

'Hot Ticket Draw' means the promotional draw that may be conducted from time to time by the Company using a random number generator to select winning Hot Ticket Codes from all of the Codes that have been entered into the relevant Lottery Draw. Match 5 winning tickets from the main Draw will not be eligible to win a Prize in the Hot Ticket Draw.

'Hot Ticket Code' means the Transaction Number provided by the eProvider to retail Players or by email to online Players which will be entered into the Hot Ticket Draw that the Company may conduct from time to time for promotional purposes for the chance to win additional Prizes as advertised.

‘Hot Ticket Prize’ means any prize be it a cash amount or a product offered by the Company as part of the Hot Ticket Draw it may run from time to time for promotional purposes. A product offered as a prize as part of this promotion may not be substituted for cash.

‘Lottery Draw’ or ‘Draw’ means the weekly lottery draw conducted by The Health Lottery every Wednesday and Saturday after sales have been closed for each week’s draw;

‘Lottery Ticket’ and ‘Ticket’ means the ticket which is purchased by a Player in anticipation of a Health Lottery Draw and which carries the numbers selected by the Player for entry into the Lottery.

'Multi-draw' means a facility to play the Game for a number of Draws with the purchase in advance of one Ticket, the number and frequency of such Draws available for selection by Players using the facility being as determined by the Company from time to time.
‘Participating Retailer’ means a retailer or store that has agreed to sell Health Lottery tickets on behalf of THL and the CICs.

'Play Card Selection' means one set of five numbers chosen between 1-50 by a Player which have been associated with a Play Card.

'Player' means a member of the Playing Public who purchases a ticket, who is eligible to play the Game in accordance the Terms and Conditions relating to this Game.

'Prize' means a prize won by a Player in the Game.

'Quick Pick' means a Selection consisting of five different numbers which, instead of being selected by a Player, are selected on a random basis by the Company's Central Computer System on behalf of that player.

'Retailer' means any person, firm or company that sells Tickets and/or pays Prizes.

‘Retail Player’ means any Player who plays the game by purchasing a Ticket at a Retailer.

'Selection' means one set of five numbers chosen by a Player which is recorded on a Ticket issued in accordance with the Rules, and includes a Quick Pick recorded on a Ticket and a set of five numbers chosen by a Player which is keyed in manually by a Retailer and which is recorded on a Ticket

'Terminal' means the machine which allows Tickets to be printed.

'Valid Winning Ticket' means a winning Ticket which meets all Ticket validation requirements as set out or referred to in these Rules.

'Winning Numbers' means the Numbers, used to determine the winning Entries.

'Winning Selection' means a selection which entitles a Player to a Prize in the category applicable to the correct numbers selected.

3. The Game

The game is called The Health Lottery Game.

4. Draw

The Draw for the Game will take place using a Draw Machine to select the winning numbers. It will take place twice a week on Wednesday and Saturday or at any other time as may be determined by the Company.

4.1 Hot Ticket Draw

In addition to the Draw for the game, the Company may undertake from time to time, using a random number generator to select a number of winning Hot Ticket Codes from all the codes that have been entered into the relevant Lottery Draw. Match 5 winning tickets from the main Draw will not be eligible to win a Prize in the Hot Ticket Draw.

5. Method of Play

5.1 Cost of Play

(a) Each Entry has a cost of £1.

(b) The cost of a Multi-draw Ticket will be the total cost of the Entries selected multiplied by the number of Draws the Player has requested.

5.2 Making a Selection

(i) Using a Play Card to purchase a Ticket

(a) On any one Play Card a Retail Player may play a minimum of one Selection and a maximum 10 selections where the numbers are provided by the Player to the Retailer.

(b) Each Selection is made by manually writing five numbers within white boxes printed on the Play Card. A maximum of 4 selections of 5 numbers can be written on the Play Card. Additional line may be added by asking the retailer at the time of purchase, up to a limit of 10 lines per Play Card.

(c) A Retail Player using a completed Play Card to purchase a Ticket will submit the Play Card to the Retailer. The completed Play Card containing the Retail Players selected numbers will then be activated by the retailer and the numbers will be entered into the chosen number of Draws by the Retailer using the Retail Terminal, which will issue the Ticket recording each Selection written on the Play Card. It is the responsibility of the Player to check that the numbers printed on the Ticket are consistent with the numbers marked on the Players’ Play Card.

(d) Where the Retail Player would like to play for Multiple draws they will be required to inform the Retailer how many draws they wish their Ticket to be entered into during the process of placing their selection, where the Retail Terminal will prompt the Retailer to ask the player how many weeks they would like their Ticket to be entered for.

(ii) Purchasing a Ticket Using Quick Pick or manually via the Retailer

(a) A Retail Player may purchase a Ticket from a Terminal without completing a Play Card, by requesting the Retailer to key in a selection of numbers manually by specifying the five numbers required per entry into the Game, up to a maximum of 10 selections

(b) A Retail Player may purchase a Ticket from a Terminal, without completing a Play Card, by requesting the Retailer to issue a Ticket via Quick Pick.

(iii) Purchasing a Ticket or creating a Direct Debit using the Health Lottery Website

Player may enter the draw via the Website using the Direct Debit features provided. A player must first register to set up an account in accordance with the Terms and Conditions for playing Health Lottery on-line.

(a) The Company will confirm the Direct Debit entry by email to the Players registered email address confirming the entry into the Draw(s), the numbers selected, the name of the CIC(s) participating in the Draw (s), the date of the Draw and the amount paid.

(b) Any Play or Direct Debit that is not recorded on the Company's Central Computer System will not be valid, any print out or other representation of any Play captured by a Player that is not registered on the Company’s Computer System will not be valid.

(c) Players may not purchase a Play or set up a Direct Debit when physically located outside Great Britain.

5.3 Cancellation of a Ticket

(a) A Ticket bought at a Retailer may be cancelled only in exceptional circumstances such as the numbers entered into the Retail Terminal by the Retailer are not the same as the numbers written on the Play Card as selected by the Retail Player, or a ticket contains two or more Quick pick Selections comprising the same five numbers.

(b) A Ticket falling within the terms of paragraph 3 (a) above may only be cancelled:

• At e-pay and Payzone Retailers, and in Participating Retailers using their own EPOS system to sell Tickets within a 30 minute period after the original sale

• At Pay Point Retailers within 10 minutes of the original sale provided that no other transactions have been made in the interim.

In both instances this must be before the close of sales for the relevant Draw

(c) For the avoidance of doubt, a Retail Player may not seek cancellation of a Quick pick Ticket by reason only of the number selection(s) on the Ticket not being to their liking.

(d) Tickets purchased on-line may not be cancelled in any circumstances .

(e) Direct Debits can be cancelled for any purchases that have not yet been placed in a draw. Direct Debit payments will be collected monthly on either the 1st of or the 15th day of the month, where that day falls on a bank holiday or weekend the payment will be taken on the next working day. In the event that a player who plays by Direct Debit chooses to cancel a Direct Debit the payment will be cancelled for the next collection cycle. Any plays for which money has been collected that have been entered into the draw cannot be cancelled under any circumstances.

5.4 Multi-draws

A Multi-draw Ticket shall not be capable of cancellation other than in accordance with paragraph 5.3 above and, in any event, prior to the first Draw in respect of which the Ticket has been issued.

5.5 Winning Selections

Subject to the Terms & Conditions and the Game Rules for the Game, a Player who, has the following combination of numbers which match the Numbers drawn will be entitled to a Prize.

Match 2 main balls and the Bonus Ball category
Any Player who has correctly matched two numbers in any one selection from the five Numbers drawn and has correctly matched the Bonus Ball number.


Match 3 category

Any Player who has correctly matched three numbers in any one selection from the five Numbers drawn.

• Any director or an employee of THL, the CICs, Peoples Health Trust, or a key IT contractor or supplier, or any spouse or dependents of the same; and

For the avoidance of doubt any Participating Retailers who act as direct agents of the CICs and use Pay Point, e-pay or Payzone terminals and software to transact Lottery Tickets will not be deemed to be agents of THL for the purposes of this clause and will be entitled to buy Tickets and receive Prizes from THL.

10.2 In the event that a Prize is paid to a person in one of the classes in 10.1 such a prize shall be repayable by that person to the Company on demand.

10.3 The Company, in its sole discretion, may refuse to sell Tickets to any person or persons without giving reasons, but which may include circumstances in which, in its view, that person or persons are playing in a manner which it or its Retailers deems to be interfering with other Players’ reasonable access to that Game.

11. Prize Claim Period

Prizes for the Health Lottery Game and any related Promotion must be claimed no later than 18.00hrs on the 180th day after the winning draw date. Any such prize not claimed within this period will be forfeited. If any prize is claimed by post, the Company must receive the Ticket and Claim form at the address shown on these Rules within this period.

12. Responsibility for Tickets

The player is responsible for the safe custody of the Ticket.

13. Dissemination of Winning Numbers Information

The results of each draw, will be issued to the national media and may also be made available in other manners from time to time. Winning numbers will be available via any Retailer outlet at the request of a Player, the information made available will include:

-The date of the draw
-The winning numbers 
-The CIC(s) to which the draw relates

14. Binding Decisions

The Company’s decisions as to whether or not a Ticket is a winning Ticket or in respect of any other matter or dispute arising from the payment or awarding or non-payment or non-awarding of prizes shall be final and binding upon all Players and any other person or persons having any interest in the matter or dispute. In the event of a dispute in respect of a winning Ticket, a Claim Form, or the payment or awarding of any prize, the Company may withhold payment of the prize and/or make an equivalent payment into court until the dispute has been resolved.

15. Law

These Rules and Terms & Conditions and the rights and obligations of the Company, Players and Direct Debit Players set out herein shall be governed by and construed in all respects in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

1.      Definitions

1.1 Definitions

Any words within these Terms and Conditions which start with a capital letter shall have the following meanings:

‘Act’

means the Gambling Act 2005

‘Age Verification Process’

means the automatic process conducted during player registration in order to verify that a player is aged 16 or over.

Claim Form’

means the form that will be supplied to a claimant to be completed as part of the process for claiming certain large Prizes in the Lottery Draw Game or Instant Lottery Games.

'Direct Debit'

The entitlement to participate in some Draw-Based Games for a multiple number of Draws by setting a recurring payment method.

'Entry'
means a chance or entry in the Lottery Draw Game which has been registered as an entry on the Health Lottery Computer System.

‘Excluded Person’

means all persons who do not meet the eligibility criteria set out in clause 4.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC  and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

‘Game(s)’

means either the Lottery Draw Game or an Instant Lottery Game.'Health Lottery'

‘Health Lottery Computer System’

means the computer system operated by the Health Lottery or its software suppliers for the purpose of recording and entering online entries into the Lottery Draw Game and the purchase and playing of Instant Lottery Games.

 ‘Instant Lottery Game’

means an instant win Health Lottery product offered to Players via the Website.

 ‘Instant Lottery Game Rules’

means Game Rules published on the Health Lottery website specifically for each Instant Lottery product in a ‘How to Play’ section accompanying each game.

‘Key IT Contractor’

means contractors involved in the development and support of the Health Lottery Computer System software and infrastructure

'Lottery Draw Game'

means The Health Lottery draw of 5 main numbers and a bonus number conducted on Wednesdays and Saturdays.

‘Lottery Draw Game Rules’

means The Health Lottery Draw Game Rules published on the Health Lottery website. ‘Main Health Lottery Terms and Conditions’

means the Terms and Conditions published separately on the Health Lottery’s website and applying to both retail and online sales of the Health Lottery Draw Game.

'Player'

means a member of the playing public who after successfully completing registration and accessing a Game,  purchases a ticket, and is eligible to play the Game in accordance the Terms and Conditions relating to this Game.

'Prize'

means a prize listed in the official prize structure of the Game and which has been has been won by a Player. 

‘Self Excluded Person’

Means any person who has chosen to exclude themselves from the Lottery for any reason, either via the Website, Contact Centre or in a Retailer in accordance with the Act.

‘Website’

The website of the Health Lottery at www.healthlottery.co.uk   

2. The Health Lottery and the Games

2.1 The Terms and Conditions set out below for playing by remote means of the Health Lottery Draw Game and Instant Lottery Games which are promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies listed on its website www.healthlottery.co.uk.  All the intellectual property rights including copyright and trademarks used on the Health Lottery website are owned by the Health Lottery. The Health Lottery may change these Terms and Conditions from time to time, these changes take effect immediately upon publication to the Health Lottery website and shall be binding on all Players.

2.2 The Health Lottery Draw Game is played at a retailer, via the Health Lottery Website or by Online Direct Debit and is governed by these Terms and Conditions for Playing the Health Lottery Draw Game and Instant Lottery Games via the Internet and by Direct Debit as well as the Main Health Lottery Terms & Conditions and the Game Rules. The Main Health Lottery Terms and Conditions and Game rules are published on the Health Lottery website and may be changed from time to time, any changes taking immediate effect upon publication.

2.3 The Health Lottery Instant Lottery Games are played are played solely via the Health Lottery Website and are governed by these Terms and Conditions. The Health Lottery Instant Lottery Games are also subject to the Instant Lottery Game Rules published on the Health Lottery Website in a ‘How to Play’ section specific to each Instant Lottery Game.

2.4 The Health Lottery  operates as a series of society lotteries under the Gambling Act 2005, (“The Act”) each or all being referred to as ”The Health Lottery” or “THL”, depending on the context. Operating this way allows costs to be kept to a minimum so that larger sums of Society Lottery funding can be allocated to local health related Good Causes, and, unlike other lotteries, every single part of Great Britain gets their share of the appropriate proceeds.

2.5  Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and proceeds are allocated according to ticket sales for each CIC that is open. Money is then donated to support health related ‘Good Causes’ within their respective local areas.

2.6 Players should be aware that all the participating CICs are independent companies.  THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and good causes they support is available.  It should also be noted that the allocation of funds to good causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity People’s Health Trust and not by THL.

2.7 At least 20% of the proceeds of each Lottery of the Lottery Draw Game shall be paid to health related good causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.  

2.8 For Instant Lottery Games, 20% of the proceeds of every Game shall be paid to health related good causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted. 

2.9 All entries into and participation in the Games are strictly governed by these Terms and Conditions and the Game Rules. By entering the Lottery Draw Game or an Instant Lottery Game, a Player agrees to be bound by the Terms and Conditions in force on that date. THL reserves the right to refuse any Entry to the Lottery Draw Game and Instant Lottery Games or to withhold any Prize if it has reasonable grounds to believe that the Game Rules & Terms and Conditions have been breached.

2.10 THL reserves the right to amend these Terms and Conditions from time to time. The current version will be posted on the Website, and THL will provide a copy by post on receipt of a stamped address envelope at the address in 1.1. Alternatively a copy of the shortened form of the Terms and Conditions can be obtained on request from a Health Lottery Participating Retailer. 

2.11 These Terms and Conditions apply to all Games played via the Health Lottery Website, or via Direct Debit.

2.12 Only by Registering to Play and accepting the Terms and Conditions, can a Player access Games on the Health Lottery Website or play by Direct Debit.

2.13 The Player warrants that once registered they will play the Game in compliance with the Terms and Conditions and will not use the Health Lottery website for malicious purposes including but not limited to the transmission of offensive content or computer viruses.

2.14 By accepting the Prize from THL, Players warrant that they:

a) are not a director or an employee of THL claiming a prize on their own behalf .

b) an employee of the CICs, People’s Health Trust or a key IT contractor or supplier;

c) are not a spouse or dependent  of any person described above in a) and b). 

3. The Health Lottery Instant Lottery Games

3.1 The Instant Lottery Games are offered on the Health Lottery’s Website and form part of the Health Lottery scheme, offered through its Remote Operating Licence issued by the Gambling Commission (Licence number 000-026057-R-309179).

3.2 The Health Lottery may at any time announce the opening or the closing of an Instant Lottery Game. The announcement of the closing of a particular Game shall be displayed in the ‘News’ section of the website. This announcement will include the exact closing date and the date and the date by which Prize claims for that particular Game must be received to be valid.

3.3 The Health Lottery may close a Game without notice or compensation should the integrity of the Game be questioned or subject to a complaint by a Player, the Commission or any interested party such as law enforcement agency.

3.4 In order to access and play any Instant Lottery Game, a Player will need to have completed his account registration in accordance with section 4 below and accepted these Terms and Conditions.

3.5 The result of each Instant Lottery Game shall be pre-determined at the time of purchase and shall not include any element of skill. The Health Lottery Computer System will determine prizes based on the probabilities and not from a limited pool of prizes.  

3.6 The chances of winning a Prize will be exactly the same at the point of purchase and shall not be affected by previous wins in the same Game or other Prizes previously paid in other Instant Lottery Games . The advertised prize structure shall remain in place at all times, with each prize tier always available for a win as the Instant Lottery Games do not use a limited pool.

3.7 Prizes for Instant Lottery Games are limited to £25,000, unless the proceeds of a Game shall be greater than £250,000, in which case the prize may be increased to an amount up to £400,000 or 10% of the proceeds, whichever is lower.

3.8 The Game Rules for each Instant Lottery Game shall be contained  in a clearly visible ‘How to Play’ section which shall contain for each game the name of the Game, the price of entry, the play symbols, the Prize structure and the odds of winning for each Prize tier.

3.9 Instant Lottery Games are available on a sample basis in “Try Me” mode. When the games are played in this mode the player will not be charged to play the game, neither will any prizes displayed be payable. Players will need to complete the Age Verification Process in order to access ‘Try Me’ mode.

3.10 If a player purchases but fails to complete an Instant Lottery Game for any reason this Instant Lottery Game will be available to resume when the player reconnects to the Health Lottery Computer System.

3.11 An Instant Lottery Game is considered complete when its outcome status in the Health Lottery Computer System shows whether or not a Prize has been won. An Instant Lottery Game is considered incomplete when for any reason it has not been possible, after play has been purchased, to determine whether a Prize has been won or not.  Players will have the opportunity to resume an incomplete game upon reconnecting to the Health Lottery Computer System.

3.12 Any Game purchased but not played shall be completed automatically upon closure of this Game, following a notice to players pursuant to section 3.

3.13 If the Health Lottery Computer System shows an Instant Lottery Game as being complete, its result shall stand and the system record of this shall prevail, whether or not the Player has witnessed the completion of the Game.

3.14 The result of all completed Games will be available in the Player’s account history once logged in to the Website.

4. Player Registration

4.1 Registration requirements  

(a) Any person wishing to play the Health Lottery On-line and or set up a direct debit to play must be located in Great Britain. Players and Direct Debit Players agree that playing the Games after registration whilst located in any jurisdiction other than the Great Britain is strictly prohibited.  The Health Lottery has the right to terminate a Player's Account and withhold any Prize to any Player or Direct Debit Player in respect of any Games played whilst located in any jurisdiction other than Great Britain.

(b) Any person wishing to play the Health Lottery must aged 16 years or older;

(c) Any person wishing to play the Health Lottery On-line must supply their debit card details which must be linked to bank account (or building society) that is based in Great Britain (GB) for which they are an authorised user, and must also be linked to a GB address. Players who supply details of a jointly owned bank accept that Prizes won may be paid into that account.

(d) When registering, the bank card referred to in (c) above must not have been reported as lost or stolen and cannot be used to open any more than one Account;

(e) The Health Lottery reserves the right to exclude persons who do not meet the eligibility criteria set out above. Excluded Persons may also include persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC  and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

4.1.1 The Health Lottery reserves the right to refuse a Registration at its absolute discretion.

4.1.2 The Health Lottery reserves the right to carry out checks or request information from Players during or after registration to verify that the Players and the information supplied by Players meet the criteria set out in this clause. No Prizes will be paid to a Player if the criteria set out in this are not met, or if they are ineligible to play for any reason. In carrying out these checks, personal information provided may be disclosed to a credit reference agency, which may make a record of that search. These checks will also be conducted when a postal claim is made and in the event our electronic checks cannot verify player details we may request physical documentation such as driving licence or passport to prove eligibility to claim prize

4.1.3 In order for the Health Lottery to decide whether the Player is eligible to play, the player will need to provide their name, home address details, date of birth, debit card detail and e-mail address.

4.1.4 Once the Health Lottery has verified the information supplied during the Registration process detailed above you will be asked to enter a User Name and Password.

4.1.5 On successful completion of this you will be able to play Games. If the Health Lottery subsequently discovers that a Player was not or is no longer eligible to open an Account, the Health Lottery reserves the right to suspend or terminate that Account.  

4.1.6 The Player is responsible for keeping login details secure. You must inform the Health Lottery immediately of any unauthorised access to your Account. Should a player forget their password, the Player must follow the instruction details on the registration or login page in order to obtain a new password.

4.1.7 By completing registration the Player agrees to indemnify the Health Lottery against all costs, damages, claims, liability, expenses, losses and payments incurred by or awarded against the Health Lottery arising directly or indirectly from the Player’s negligent conduct, omission or malicious use of their account.

5. Payment and Funding of Accounts

5.1. Once registered, you will be able to place £5 as a minimum and £500 maximum into your Account at any one time and in any one transaction.

5.2 The Health Lottery will check at the point that you attempt to place money into your account using the debit card details that you supply whether or not you have sufficient funds in your bank (or Building Society) account,

5.3 You will only be permitted to place a maximum of £500 into your wallet at any time or 24 hour period using your Debit Card.  You will not be permitted to place any more than £2000 into your On-line account. 

5.4 You will be limited to £40 for any one Lottery Draw Game. You will be limited to £500 worth of play on Instant Lottery Games per day. Players may reduce these limits at their discretion. A reduction we take effect immediately, any subsequent increase requested by the player will be subject to a cooling off period.

5.5 You will be only be permitted to withdraw Funds from your on-line account back onto the Debit Card registered with the Health Lottery.  The minimum withdrawal amount is £10 unless your account balance is less than £10 in which case you will be able to withdraw the whole balance.

5.6 Should your debit card be lost or should you wish to change your registered debit card before it has expired you will be required to contact the Health Lottery Contact Centre on 0844 375 5555. Before your new cards details can be added you will need to withdraw any funds in your account. Should your debit card expire you may update your account with the details of your new card through your account on the website.

5.7 A Player may close an Account at any time, at which time the Health Lottery will return any funds to the bank (or building society) account registered on the Health Lottery Computer system, or by other means should that bank account no longer be active for any reason. Players may close their account online using the 'Close Account' function, or alternatively call the Health Lottery Contact Centre on 0844 375 55 55 to confirm the closure of the account verbally. Players will also have the opportunity to self-exclude from a period of 6 months to 5 years. Self Excluded Persons who have excluded themselves using a form in a retail point and notified The Health Lottery of their exclusion may be blocked from playing online. THL reserves the right to retain personal details for its own reasonable purposes after an account is closed. Reasons may include, but are not limited to, compliance with anti-money laundering legislation and any other record keeping requirements for legal or regulatory compliance.

5.8 If the Health Lottery is unable to return funds to the registered bank account or by any other agreed means, the Health Lottery will retain the funds for a period of 3 years.  At the end of that period the Health Lottery reserves the right to donate the funds to the Peoples Health Trust or any other good cause as determined by the Health Lottery.  The Player may contact the Health Lottery at any point in that three year period, at which time the Health Lottery will use all reasonable endeavours to refund the player providing proof of ownership and identity can be established.

5.9 A Direct Debit Player may cease playing by Direct Debit at any time. Direct Debits can be cancelled for any purchases that have not yet been placed in a draw.  Direct Debit payments will be collected monthly on either the 1st of or the 15th day of the month, where that day falls on a bank holiday or weekend the payment will be taken on the next working day.  In the event that a player who plays by Direct Debit chooses to cancel a Direct Debit the payment will be cancelled for the next collection cycle.  Any plays for which money has been collected that have been entered into the draw cannot be cancelled under any circumstances. Players should check their transaction history to establish if any entries have been made before cancelling the Direct Debit.

6. Operation of Accounts

6.1 The Health Lottery may terminate, vary or suspend the provision of the Games, access to a Player's Account’s without prior notice:-

(a) on breach of these Terms and Conditions, the relevant Game  Rules; or

(b) for maintenance work required to upgrade or update the Health Lottery Computer System; or

(c) if the Health Lottery ceases to offer the Games; or

(d) for any other reason at the Health Lottery's sole discretion.

6.2 On termination of an Account, the Health Lottery will return the Player's Funds to the bank (or building society) account, details of which are held by the Health Lottery on the Health Lottery Computer System in respect of that Player, or return the Funds to the relevant Player by other appropriate means using all reasonable endeavours. In the event that a refund cannot be made the provisions made in Clause 5.3 will apply.

6.3 The Health Lottery’s decisions as to whether or not a Play is a winning Play or in respect of any other matter or dispute arising from the payment or awarding or non-payment or non-awarding of prizes shall be final and binding upon all Players and any other person or persons having any interest in the matter or dispute. In the event of a dispute in respect of a winning Play, Claim Form, or the payment or awarding of any prize, the Health Lottery may withhold payment of the Prize and/or make an equivalent payment into court until the dispute has been resolved. In the case of Instant Lottery Games only the result held on the THL Computer System will be deemed as the final result. If the images displayed on a players screen do not match the record on the Computer System this will be deemed a display error and the result on the Computer System will stand.

6.4 If a Player informs any bank (or building society) that unauthorised use of a debit card has been undertaken in relation to an Account and the bank (or building society) requests that the relevant sums be returned by the Health Lottery to the relevant Player's bank (or building society) account ("Chargeback"), the Health Lottery will suspend the Player's Account and ask the Player to contact the Contact Centre on 0844 375 5555.

6.5 The Health Lottery reserves the right to debit the Player's Account with the amount of the Chargeback together with any funds that the Player has utilised that are subject to that Chargeback. If that debit results in a negative balance in the relevant Player's Account, the Health Lottery reserves the right to recover that balance from the Player at which point the Health Lottery will terminate that Account.

6.6 If an Account becomes Dormant and there are funds on that Account, the Health Lottery may at its discretion, return the Funds, to the bank (or building society) supplied by the Player using the debit card details as held by the Health Lottery .

6.7 It is the responsibility of the Player to ensure that the information supplied to register to play the Health Lottery On-line is kept up to date.

7. Applicable Law

These Rules and Terms & Conditions and the rights and obligations of the Health Lottery, Players and Direct Debit Players set out herein shall be governed by and construed in all respects in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

Terms and Conditions Specific to the Health Lottery Regular Play Direct Debit Promotion

1. The Game/Promotion

The Promotion is called the Direct Debit Promotion. This offer is available to new direct debit subscribers only. Offer limited to one direct debit submission per person. This promotion will be run between dates specified in advance in the ‘News’ and /or ‘Promotions’ section of the website and/or on Facebook and/or various emails to players sent by the Company at various times throughout the year.  The Direct debit must have been submitted via The Health Lottery website between the dates specified and will close at 20.00hrs on the last day of each of the promotional periods.

The Health Lottery ELM Limited will pay back into the designated bank account one week of gameplay related to the direct debit upon completion of the first successful direct debit payment. For the avoidance of doubt this means that a full direct debit payment will be taken. Once this payment is confirmed a refund back into the bank account for the 1 week of play will be made. All other terms and conditions relating to playing The Health lottery remain unaffected.

Game Rules & Terms and Conditions Specific to the Health Lottery Second Chance Guaranteed Winner Promotion

1. The Game/Promotion

The Promotion is called the Second Chance Guaranteed Winner Promotion.

2. The Draw

The Draw will take place when specified by the Company; results will be published at a time to be specified by the Company during the Promotion.  The Draw will be undertaken by the Company to select one winning play from all of the plays that have been entered in the Lottery Draw usually held on a Saturday, on the date as specified by the Company for the Promotion.

4. Method of Play

All non Match 5 winning tickets specified in the Promotion Period will be eligible to participate in the Second Chance Guaranteed Winner Promotion

3. Winning Selections

Subject to the Game Rules and the Terms & Conditions, a Player who has a ticket that matches the selected Winning Ticket Number/internet ID/Direct Debit ticket ID will be eligible to win a prize of up to £100,000.

4. Second Chance Guaranteed Winner Promotion - Approximate Odds of Winning and Prize Structure

The odds of winning a prize will be determined by the total number of entries in the week of the Promotional Draw as specified by the Company.

The winning Ticket Number/internet ID/Direct Debit will be paid up to £100,000.

5. Payment of Prizes & Prize Capping

Game Rules and Terms and Conditions Specific to the Health Lottery Hot Ticket Raffle Promotion

These Game Rules & Terms and Conditions are in addition to, and must be read in conjunction with, The Health Lottery Terms and Conditions and Game Rules.

1. Hot Ticket Raffle Promotional Draw

The Hot Ticket Draw will take place weekly following the Lottery Draw; results will be published by the Company via the Health Lottery Website, and selected publications. The Hot Ticket Draw will be undertaken by the Company in the presence of an independent auditor and using a random number generator to select a number of winners from all of the Hot Ticket Codes that have been entered in the Lottery Draw usually held on Saturdays and Wednesdays. The start and end date of the promotion will be states on the 'Promotions' tab of the Company's website. The Company reserved the right to end the Hot Ticket Raffle at any time. The Company also reserves the right to extend the promotion at its discretion.

2. Method of Play

All Tickets entered into the Lottery Draws will be eligible to participate in the Hot Ticket Draw for that particular week. Players will be required to retain their ticket in order to redeem any prizes that are won in the Hot Ticket Draw.

3. Winning Selections

3.1 Subject to the Company’s Game Rules and Terms and Conditions, any Player who has not matched 5 numbers from the Saturday or Wednesday draw, who does match a Hot Ticket Code drawn for that draw, will be eligible to win a prize.

3.2 Players can claim their Hot Ticket Code Prize by following the Company’s normal Prize claim process by contacting the Company on 0844 375 55 55* and registering a claim. Once the claim has been successfully validated by
the Company the Player will be notified in writing. Subscription Players will automatically receive notification to their registered email account.

4. Approximate Odds of Winning

After each lottery Draw and in the presence of an independent auditor, a random number generator will be used by the company to select a number of winning Hot Ticket Codes which have been assigned to each lottery ticket and online entry. The odds of winning a prize will be determined by the total number of entries in the week of the draw.

5. Prize Amounts and Payment of Prizes 

5.1 Hot ticket Code Prizes may take the form of both cash and non cash Prizes. Hot Ticket Code Cash Prizes shall be:

5.2 Cash Prizes will be administered and processed in line with the Company’s Terms and Conditions and Game Rules.

5.3 Cash Prizes offered in the Saturday Draw may differ from those offered in the Wednesday draw.

5.4 When in addition to Cash Prizes Non cash Prizes are offered, these may take the form of a car, holiday, shopping vouchers or any other similar prizes which may vary from week to week at the discretion of the Company. Players will be aware of the Prizes on offer each week prior to the lottery Tickets going on sale.

5.5 Age restriction on certain types of non-cash prizes may apply. In the event that a winner is under age (but is still an eligible winner) for any non-cash prize which has an age restriction attached by the supplier, the Company reserves the right to administer the prize to a legal guardian or parent.

6. Rules Relating to Car Prizes

6.1 Value of Car

When a Car is offered, the ‘on the road’ value of any car won will be approximately £10,000 (inclusive of VAT) this may fluctuate dependent on market rates and conditions. The value will include 12 months road tax and delivery but will be exclusive of insurance. The Winner is responsible for arranging their own insurance. A cash equivalent of £10,000 will be offered to all Car winners. 

6.2  The Company will use reasonable endeavours to locate the advertised car but reserves the right to substitute the advertised car with a car of equal or greater value or offer a cash alternative o £10,000 in the event of any part of the Prize becoming unavailable. 

6.3 The Company makes no representations or warranties as to the quality/suitability of any of the vehicles offered as prizes.

6.4 The Company reserves the right to choose the colour of the car and accessories (if any)

7. Except for liability for death or personal injury caused by the negligence of the Company, the Company shall not be liable for any loss suffered or sustained to person or property including not limited to, consequential (including economic) loss by reason of any act or omission by the Company, or its servants or agents, in connection with the arrangement for supply, or the supply, of any Vehicles, holiday or gift voucher by any person to the prize-winner and where applicable to any family/persons accompanying the winner or in connection with any of the Prizes awarded by the Company.

The Health Lottery Complaints Procedure

We want you to enjoy playing the Health Lottery; providing excellent customer service is important to us and in the vast majority of cases this is exactly what you will receive. However, just occasionally, something goes wrong and a customer, unfortunately, has cause to complain.

In the first instance your complaint should be registered with us by calling 0844 375 55 55 where a member of our Customer Services team will endeavour to address the issue and resolve the query immediately or, if you prefer, you may write to us at the addresses shown at the bottom.

If an immediate solution cannot be achieved because further investigation is necessary, we will let you know straight away.

Should our investigation take longer than anticipated, which will only happen if the circumstances are particularly complex, we will explain why and we will make sure you are provided with regular updates. We will not normally allow any complaint to be unresolved for more than 4 weeks, as we will always agree a course of action with you within this time.

Any investigation will be overseen by a specially selected and trained staff member who will stay in contact with you throughout the investigatory period

In the unlikely event that you are still unhappy with how your complaint is being handled or resolved, we have in place an escalation procedure which means that you can request the involvement of an appropriate manager by writing to us the addresses show at the bottom.

If at any time you are unhappy with the progress or outcome of our investigations, please do not   hesitate to contact the staff member handling your complaint.

If, at the end of this process, you still remain dissatisfied with the outcome further review can be requested and a full review of the dispute and outcome will be conducted by THL Compliance Department.

In the unlikely event you remain dissatisfied with the outcome and subject to your dispute meeting the criteria detailed in the Gambling Commission's Codes of Practice, you may request information from the THL Compliance Department in relation to the process of referring your complaint to an independent adjudicator for further investigation and review.

The independent adjudicator will consider your complaint totally impartially and we are bound by their decision. The request for third party adjudication information should be made in writing to the address shown below.

We do hope, however, that your complaint will have been resolved much earlier and you will not find it necessary to take this action.
