The Mobile Lottery (“TML”) Terms and Conditions

Version 4.0 January 2017 – Launch 23rd March 2017

1 INTRODUCTION

1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for The Mobile Lottery (“TML”) draws which are promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies (“CICs”) listed on www.themobilelottery.co.uk (the “TML Website”) and www.healthlottery.co.uk (the “THL Website”).

1.2 The correspondence address is The Mobile Lottery, Department 485, Queensgate, Grange Road East, Birkenhead CH41 5FD.

1.3 TML is operated by THL which is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk).  The Gambling Commission has issued licence numbers 000-026057-R-309179 and 000-026057-N-309180 to THL.

1.4 The Health Lottery Scheme manages 51 society lotteries that operate in rotation and each represents
a different geographical region of Great Britain. They operate under the Gambling Act 2005, (“The Act) each or all being referred to as “The Health Lottery”, depending on the context. Operating this way allows every single part of Great Britain to get their share of the appropriate proceeds.

1.5 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each month and proceeds from TML are allocated according to entry sales for each CIC that is open. Money is then donated to support health related ‘Good Causes’ within their respective local areas.

1.6 A complete list of the CICs promoting the society lotteries can be seen at Annex A of these Terms and Conditions.

1.7 Players should be aware that all the participating CICs are independent companies. TML will
provide a link on its website to each of the individual CICs where information about each of the CICs,
the regions they represent and Good Causes they support is available. It should also be noted that the
allocation of funds to Good Causes raised through TML for the CICs is determined by the relevant CICs and their partner charity People’s Health Trust and not by THL.

1.8 At least 20% of the proceeds of TML shall be paid to health related Good Causes within the
territorial boundaries of the participating CIC on whose behalf TML is being promoted.

1.9 All entries into and participation in TML is strictly governed by these T&Cs. By entering TML, a Player agrees to be bound by the T&Cs in force on the day of subscription. THL reserves the right to refuse any entry to TML or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.

1.10 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the
TML Website along with the Game Rules, and will provide a copy by post on receipt of a stamped
addressed envelope at the address in clause 1.2 above.

1.11 If and when changes are made to the T&Cs THL will use its database of Players that have registered
to notify all those Players for whom it has SMS text details and/or email addresses. The T&Cs may be amended by THL from time to time and will be published on the TML Website.

2 DEFINITIONS

ANY WORDS WITHIN THESE T&CS WHICH START WITH A CAPITAL LETTER SHALL HAVE THE FOLLOWING MEANINGS:

(a) “TML” or “TML Game” means The Mobile Lottery game consisting of three weekly lottery draws and one weekly raffle draw, all of which currently take place on a Saturday, the cost of which is currently £2 each calendar week.

(b) “THL” means The Health Lottery (ELM); an external lottery management company that is licenced by The Gambling Commission to promote and manage draws on behalf of the 51 Community Interest Companies (“CICs”) ”) listed on the “TML Website”

(c) “Mobile Lottery Draws” or “TML Draws” means the TML Game with 3 lottery draws normally held each Saturday. Sales will be closed for these draws at 19.45 each Saturday. THL reserves the right to hold a Draw on an alternative day should the Draw occur on a Bank Holiday or any other day deemed unsuitable for holding a Draw by Health Lottery Management.

(d) “Mobile Raffle Draw” or “TML Raffle” means TML’s raffle which is linked to the Mobile Lottery Draw with draws normally held every Saturday.  The Health Lottery reserves the right to hold the Raffle draw on an alternative day should the draw occur on a Bank Holiday or any other day deemed unsuitable for holding a draw by Health Lottery Management. Only Players who have successfully subscribed to TML shall be eligible for entry in the appropriate weekly TML Raffle draw.

(e) “Pay As You Go” or “PAYG” means a mobile phone for which credit is purchased in advance of service use. The purchased credit is used to pay for mobile phone services at the time the service is accessed or consumed.

(f) “Contract Phone” means that Players pay a single monthly fee to a mobile network provider for a fixed period of time.

(g) “SMS Message” means an electronic text message sent or received via an electronic mobile device.

(h) “PINGIT” account” means the mobile/online payment service provided by Barclays Bank plc which is available by downloading the PINGIT app for smart-phones or by registering online at www.pingit.com/

(i) “PayM” means the mobile payment service which links a Player’s bank account to their mobile phone and enables TML to pay out prizes electronically via PINGIT. Details can be found at www.paym.co.uk

(j) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters TML but who does not comply with these T&Cs shall be considered an Excluded Person.

(k) “Fixed Prize” means that the winners will receive a set Prize amount not shared by Players subject to the same limitations in exceptional circumstances found at sections 6.12 and 6.13. These prize categories are:

Match 5 numbers in the correct order = £25                        
Match 6 numbers in the correct order = £250
Match 7 numbers in the correct order = £5,000
Match 8 numbers in the correct order = £25,000

(l) “TML Raffle Prize” means one Prize which is the equivalent of £2,000 or 10% of that week’s TML sales up to a maximum of £50,000 whichever is the greater, drawn from all current TML participants.

(m) “Supercharge” means the ability for winners of a £2 Prize to elect not to collect their Prize but to reinvest it in the next available TML Draw.  This has the effect of a Player’s Numbers being entered twice into the next available Draw only with the possibility of winning two lots of Prizes e.g. a Player wins £2 in Draw A. They elect to Supercharge their win.  In Draw B they match 4 numbers in the correct order and win £10.  Due to the Supercharge, they receive £20.  They also receive 2 chances in the Draw B TML Raffle Draw.  Players may only elect to Supercharge when their total winnings in a single draw is £2.

(n) “Game Rules” means the rules which are applicable to playing the Mobile Lottery draw-based lottery and raffle game and which are published on “the TML Website”

(o) “Good Causes” means the promotion of health for the public benefit by increasing and supporting sustainable health equality in and for disadvantaged communities and groups across England, Scotland and Wales.

(p) “Player Numbers” or “Numbers” means the final 8 digits of the Player’s mobile phone number (in the order in which they appear) which is registered by a Player in anticipation of participating in TML. Players are not able to select their own numbers to play TML.

(q) “Player” means an eligible person who subscribes to TML in accordance with these T&Cs. See 3.1 and 3.5.

(r) “Prize” means the prize monies that may be won in the course of the TML Game in accordance with these T&Cs and any other rules of TML.

(s) “Prize Capping” means the process that the Company may use to reduce the value of Prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single draw exceeds £1m.

3 CONDITIONS OF ENTRY

3.1 To enter TML and to be eligible to win a Prize, Players:

(a) must be 18 years of age or over; and

(b) must be a resident of Great Britain (England, Wales and Scotland only).  Players that are not a resident of Great Britain (England, Wales and Scotland only) will not be eligible to claim prizes but may still be charged.

(c) must be located in Great Britain (England, Wales and Scotland only) at the time of sign-up in order to successfully register.  TML has engaged geo-blocking technology for cellular and web-based IP addresses meaning that anyone attempting to join TML from outside Great Britain will receive a message advising them that they are unable to play.  Players are therefore asked to note that their location will be used to determine eligibility to play, although this information will not be disclosed.

(d) must comply with these T&Cs and any other rules of TML notified by THL.

3.2 Excluded Persons are ineligible to participate in TML and shall not be entitled to receive any Prizes. Players will have the option to self-exclude for a period of 6 months to 5 years. Players who have self-excluded from TML will not be able to subscribe to THL and vice versa.

3.3 All entry instructions communicated by THL shall form part of the Game Rules of the TML Draw which are available on the TML Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2 above.

3.4 In registering to play, Players acknowledge and agree that:

(a) the chances they purchase in any month may not benefit directly the region in which they live. THL aims to ensure that different CICs representing different regions take it in turns to participate in TML each month to ensure that every participating region of the Great Britain will benefit from monies raised as equally as possible.

(b) Any Player that attempts to play and does not have sufficient funds available to do so will receive an SMS text message or email requesting that they contact their Network Provider (for mobile contracts) or top-up their mobile phone (for PAYG) and try again.

(c) A minimum of 20% of the entry price will go towards Good Causes.

3.5 By personally accepting a Prize from TML, Players warrant that they:

(a) Are not a director or an employee of THL, the CICs, People’s Health Trust, or a key IT contractor or supplier claiming a Prize on their own behalf.

(b) Are eligible to win a Prize under clause 3.1.

(c) Fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.

3.6 THL will have sole and absolute discretion as to whether to accept any entry to the TML Game and pay out any Prizes. Its decision in the matter will be final and binding.

3.7 THL will rely on its own technical logs and records when determining whether the Player is eligible to receive a Prize.

3.8. Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Gambling Act 2005 and any relevant regulations made thereunder from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter TML and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time and published on the TML Website.

4 HOW TO ENTER THE MOBILE LOTTERY VIA MOBILE PHONE

4.1 Players are required to send ‘WIN’ via SMS text message to the short code 82828. Messages will be charged at the standard network rate. This will activate an automated age verification process through the Player’s mobile network to confirm that the Player is at least 18 years old. This will leave a soft footprint on the Player’s credit file for 12 months.

If the Player’s mobile phone has been registered and the owner is age verified as 18+ the player will receive an automated SMS message confirming that registration has been successful and that they are now subscribed to TML.  This SMS text message will;

(a) include a link to the TML website and full T&Cs

(b) confirm the Players financial commitment of £2 per week until the Player cancels (in the case of those with a Contract Phone, taken at source from the Player’s network provider) and will appear on the Player’s mobile phone statement; in the case of PAYG customers, taken from available credit on the Player’s mobile phone each week;

(c) confirm which CIC is benefitting from TML Draws taking place in the current month

(d) confirm that Players wishing to cease playing TML must create a new text message and send the word ‘STOP’ to 82828 at any time. Players should note that replying to a Mobile Lottery message with the word ‘STOP’ will not unsubscribe them.

4.2 The last eight digits of the Player’s mobile phone number, in the order that they appear, will be entered into subsequent TML Draws until the Player elects to cancel their subscription.

4.3 Players are restricted to one entry per mobile phone number.  Each Player’s Numbers shall be entered into each eligible TML Draw once.

4.4 Confirmation via SMS text message of a successful entry means that the Player has committed to a subscription of £2 per week (deducted via the Player’s mobile phone network provider, or registered debit card)

4.5 The £2 per week subscription entitles the Player entry into three “Mobile Lottery Draws” and one “Mobile Lottery Raffle” each week which usually take place on a Saturday.

4.6 Players may cancel their TML subscription by creating a new text message and sending the word ‘STOP’ to 82828 at any time. Players should note that replying to a Mobile Lottery message with the word ‘STOP’ will not unsubscribe them.  An SMS text message will then be sent confirming that the Player will be removed from the next available TML Draw and that no further payments will be taken.  Players should be aware that in order not to be entered into the next available Saturday draws, they must text STOP to 82828 before 09:00am on the Monday of that draw week.  If a player texts STOP after 09:00am on Monday the funds will be collected and they will be entered into the draws on the Saturday of that week only.

4.7 The Player accepts that by cancelling, their “Numbers” will be withdrawn from all future TML Draws and will not be eligible for any Prizes.

4.8 If a Player’s mobile phone has not been verified then alternative age verification is required before the Player can be subscribed.  An SMS text message will be sent requesting that the Player call their mobile operator in order to verify their phone, or that they should follow a web link to the TML Website where an age verification check can be carried out.

4.9 If a Player changes their mobile phone number, they must cancel their Mobile Lottery subscription and re-register for the Mobile Lottery using their new mobile telephone number.  Age verification checks will be carried out again as described in 4.1. The final 8 digits of the Player’s new mobile phone number shall become the Player’s new Numbers.

5 HOW TO ENTER THE MOBILE LOTTERY VIA THE WEBSITE

5.1 Players may enter The Mobile Lottery via the TML Website at www.themobilelottery.co.uk. Once on the Home page, Players are required to enter their mobile phone number where indicated and press the Play button.  A five digit Entry Code is then automatically sent to the Player’s mobile phone via SMS text message.  This is to confirm that the person accessing the website is in possession of the mobile phone associated with that number.  The Player must then enter this Code into the field presented on the Website and click on Verify.  The Player will then be age verified and, if successful, be subscribed into the TML Game.  An automated SMS message will be sent to the Player’s mobile phone confirming entry. This SMS text message will;

(a) include a link to the TML website and full T&Cs

(b) confirm the Players financial commitment of £2 per week until the Player cancels (in the case of those with a Contract Phone, taken at source from the Player’s network provider) and will appear on the Player’s mobile phone statement; in the case of PAYG customers, taken from available credit on the Player’s mobile phone each week;

(c) confirm which CIC is benefitting from TML Draws taking place in the current month

(d) confirm that Players wishing to cease playing TML must create a new text message and send the word ‘STOP’ to 82828 at any time. Players should note that replying to a Mobile Lottery message with the word ‘STOP’ will not unsubscribe them.

5.2 The last eight digits of the Player’s mobile phone number, in the order that they appear, will be entered into subsequent TML Draws until the Player elects cancel their subscription.

5.3 Players are restricted to one entry per mobile phone number.  Each Player’s Numbers shall be entered into each eligible TML Draw once.

Players should note that replying to a Mobile Lottery message with the word ‘STOP’ will not unsubscribe them.  An SMS text message will then be sent confirming that the Player will be removed from the next available TML Draw and that no further payments will be taken.

5.7 The Player accepts that by cancelling, their “Numbers” will be withdrawn from all future TML Draws and will not be eligible for any Prizes.

5.8 Players are given the option to complete a simple registration form which requests name, postal address, mobile phone number, date of birth and email address to be supplied.  Registration is not mandatory.

5.9 THL reserves the right to terminate a Player’s subscription at any time, at its absolute discretion.

5.10 Online entries are final and cannot be cancelled, reversed or refunded once completed.

5.11 Players may cancel their TML subscription by creating a new text message and sending the word ‘STOP’ to 82828 at any time. Players should note that replying to a Mobile Lottery message with the word ‘STOP’ will not unsubscribe them.

5.12 If a Player changes their mobile phone number, they must cancel their Mobile Lottery subscription and re-register for the Mobile Lottery using their new mobile telephone number.  Age verification checks will be carried out again as described in 4.1.  The final 8 digits of the Player’s new mobile phone number shall become the Player’s new Numbers.

5.13 The name of the participating CIC which will benefit from TML Draws in any one month will be displayed on the Website and will be visible to the Player prior to sign-up.

6 THE MOBILE LOTTERY DRAWS AND PRIZES

6.1 The Lottery Draws will take place on a weekly basis on Saturdays for the three TML Lottery Draws and one TML Raffle Draw. THL reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday or any other day deemed unsuitable for holding a Draw by Health Lottery Management.

6.2 Winners will be sent an SMS message confirming that they have won a prize.  The message will contain the options for redeeming any Prize.

6.3 For all unpaid Prizes totalling £50 or less the redemption options are currently:

(a) Players may opt to have any Prizes won totalling £50 and below paid to them electronically via Barclays Bank plc’s PINGIT which is available by downloading the PINGIT app for smart-phones or by registering online at www.pingit.com/.  Players simply reply to the TML SMS message with the word ‘PINGIT’ to receive full details.

(b) Players may register their mobile phone with PayM which is a mobile payment service that links a Player’s bank account to their mobile phone.  This enables TML to pay out prizes electronically via PINGIT. Details can be found at www.paym.co.uk

(c) Players may elect to have a Prize paid to their debit card by completing a simple registration process.  This can be completed online or via mobile phone.

6.4 For all unpaid Prizes totalling in excess of £50 Players must contact The Mobile Lottery Helpline on 0333 313 1000 or by email at help@themobilelottery.co.uk in order to claim their Prize.  Calls to The Mobile Lottery Helpline will be charged at 5p per minute plus your telephone provider’s access charge.

6.5 THL may introduce additional redemption methods. Players will be notified of these additional options as they become available via the winners SMS text message.

6.6 Winners will be notified by SMS text message and Players can check if they have won by using the results checker on the TML Website and mobile site.

6.7 In the “Mobile Lottery Draw”, eight numbers will be drawn at random by an approved Random Number Generator (RNG) from the range between 0 and 9 inclusive.

6.8 Prizes paid to the holders of Winning Numbers in the Mobile Lottery Draw will be as follows:

Each Player matching three Winning Numbers in the correct order, shall win a Prize of £2
Each Player matching four Winning Numbers in the correct order, shall will win a Prize of £10
Each Player matching five Winning Numbers in the correct order, shall win a Prize of £25
Each Player matching six Winning Numbers in the correct order, shall win a Prize of £250
Each Player matching seven Winning Numbers in the correct order, shall win a Prize of £5,000
Each Player matching eight Winning Numbers in the correct order, shall win a Prize of £25,000

6.9 In the TML Raffle Draw, one TML player will be drawn each week and shall receive one prize of not less than £2,000 or 10% of sales for that week up to a maximum of £50,000 whichever is greater.  e.g. if sales for a given week are 10,000 then the raffle prize shall be £2,000.  If sales for a given week are 500,000 then the raffle prize shall be £50,000; and if sales are 800,000 then the raffle prize shall be capped at £50,000.

6.10 By claiming and accepting a Prize, Players agree to publicity which will be carried out at the sole discretion of the Company.

6.11 Should the total sum of Prizes due for payment in respect of any TML Draw exceed £1,000,000, THL reserves the right to implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, THL may reduce all prize categories in proportion so as to bring the total Prize payout to a minimum of £1,000,000.

6.12 The Prize Pool for each weeks Lottery is calculated once the winning numbers have been entered into the system. All prizes on The TML Game will be paid in full unless Prize Capping is required.

6.13 THL reserves the right to change the Prize sums paid to Players without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.

6.14 Winning Players may be required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.

6.15 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned
immediately to THL.  If a player has successfully subscribed to The Mobile Lottery and won a prize, but has self-excluded before the prize has been paid out, they shall still be eligible to claim that prize.

6.16 THL will use its reasonable endeavours to provide the Prize payment to the Player within fourteen days
of receiving the Player’s identification documents but will not be liable for late delivery.

6.17 Prizes for The TML Game must be claimed no later than 18.00 hours on the 180th day following the day of the draw. Any Prize not claimed within this period will be forfeited.

6.18 Each winning Player is responsible for paying any and all taxes on any Prize won.

6.19 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their written consent.

6.20 Calls to The Mobile Lottery Helpline will be charged at 5p per minute plus your telephone provider’s access charge.

7 SELF EXCLUSION

7.1 Any Player may opt at any time to be excluded from participating the TML by visiting the TML Website. At the start of the period of self-exclusion (the “Exclusion Term”), at which point the Player’s subscription will be suspended.

7.2 Players may choose the length of the Exclusion Term, subject to a minimum period of six months. During the Exclusion Term, Players will not be permitted to access TML or any gaming product offered by The Health Lottery.

7.3 THL will not contact the Player at the expiration of the Exclusion Term. The Player may recommence their TML subscription by contacting info@themobilelottery.co.uk, although a cooling-off period of one week will be imposed by THL before the account becomes active.

7.4 The Player may choose to enter another Exclusion Term at any time.

7.5 Players may choose to enter an opt-out scheme under which they will not receive marketing materials from TML. Where TML communicates with its Players by SMS, each message will include a brief description of the way that the recipient may notify THL that they wish communications to cease.

7.6 THL will remove from its marketing lists the details of any Player who, upon receipt of unwanted marketing material, calls to the TML Helpline or messages ‘STOP’ to 82828. A Player may also use the unsubscribe link at the bottom of any marketing email to stop any further marketing communications.

7.7 Players should play responsibly. Information on how to gamble responsibly and how to access information about, and help in respect of, problem gambling can be found on the website or be sending a stamped addressed envelope to the address in clause 1.2 above. Alternatively information is available from GamCare at www.gamcare.org.uk and GambleAware at www.gambleaware.co.uk.

8 LIMITATION OF THE HEALTH LOTTERY’S LIABILITY AND RESERVATION OF RIGHTS

8.1 Nothing in these T&Cs shall exclude or limit THL’s liability:

(a) For death or personal injury resulting from THL’s negligence; or

(b) For fraudulent misrepresentation; or

(c) For liability that cannot be excluded or limited by law.

8.2 Subject always to clause 8.1 neither THL nor any of the societies participating in the TML Game from time to time shall be liable to a Player for any loss or damage suffered by a Player arising from:

(a) Any failures or delays in any delivery methods (including postal services) used by THL or the Player from time to time.

(b) Failure of delivery or receipt of any SMS message as a result of failure or error on the part of a Network Provider and/or telecommunications systems.

(c) Any event which is beyond THL’s or the societies’ reasonable control.

And in addition;

(d) The TML Game is provided on an “as is” and “as available” basis and no representations or endorsements of any kind are made; and

(e) All warranties, conditions and guarantees relating to the TML Game made by or on behalf of THL, whether express or implied by law, in the course of dealing or otherwise, are excluded to the maximum extent permitted by law.

8.3 THL is not liable in contract, tort (including but not limited to negligence) or otherwise in connection
with the TML Game for:

(a) Loss of revenue, contract, profits, business or anticipated savings or loss of data;

(b) Any special or indirect or consequential losses; or

(c) Any loss of goodwill or reputation.

8.4 THL does not guarantee that use of the TML Website or internal and external telephone systems will be uninterrupted, timely and / or error-free.

8.5 Subject to clause 8.1, THL’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player.

8.6 THL is not responsible for any websites which may be visited via hyperlinks provided on the TML Website. Visitors to and transactions made on such websites are conducted entirely at the site user’s own risk.

8.7 THL reserves the right to exclude any Player from the TML Game in the event that THL believes
in its sole discretion that the Player may be using technology to gain an unfair advantage over other Players of the TML Game.

9 LIABILITY OF PLAYERS

9.1 Players agree to fully indemnify THL in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by THL due to the Player’s misuse of the TML Website.

9.2 Nothing contained in these T&Cs shall affect the statutory rights of any Player. TML’s Complaints Procedure is available on request by writing to the address in 1.2, by emailing TML on help@themobilelottery.co.uk or by calling the TML Helpline on 0333 313 1000. Calls to The Mobile Lottery Helpline will be charged at 5p per minute plus your telephone provider’s access charge.

10 COMPLAINTS

In the event of a complaint or to express any dissatisfaction with any aspect of TML, Players should email TML on help@themobilelottery.co.uk or call the TML Helpline on 0333 313 1000. Calls to The Mobile Lottery Helpline will be charged at 5p per minute plus your telephone provider’s access charge.

11 DISPUTE RESOLUTION

If a complaint is not resolved to a Player’s satisfaction by the use of TML’s Complaints Procedure, and subject to the dispute meeting the criteria detailed in the Gambling Commission’s Code of Practice, the Player may request information as to how to refer their complaint to an independent adjudicator for further investigation and review. This independent adjudicator, namely the Independent Betting Adjudication Service (IBAS), is specialised in the resolution of gaming disputes.

12 INTELLECTUAL PROPERTY

All intellectual property rights generated as a result of the operation of the TML Game shall be the property of THL and Players agree to take all steps (at THL’s cost) to vest in THL any intellectual property which the Player creates in the course of entering the Lottery.

13 DATA PROTECTION

All information provided by Players to THL for the purposes of the TML Game will be stored, managed and used in accordance with current Data Protection legislation and also with TML’s Privacy Statement as posted on the TML Website. The TML Privacy Statement forms part of these T&Cs.

14 GOVERNING LAW

These T&Cs are governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.

15 INSOLVENCY

We are required by our licence to inform Players about what happens to funds which we hold on account for you, and the extent to which funds are protected in the event of insolvency www.gamblingcommission.gov.uk/consumers/protection_of_customer_funds.aspx The TML monies managed by THL and HLFL on behalf of the CICs are ring-fenced and covered by a Declaration of Trust of which the CICs and the Players are the beneficiaries. In the event that THL or HLFL are declared insolvent, the TML Game funds are protected and the creditors of THL or HLFL will have no recourse to the TML Game funds held on trust for the CICs and the Players. This meets the Gambling Commission’s requirements for the segregation of customer funds at the level: high protection.
