1. INTRODUCTION

1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for all society lottery draws (the Lottery) which are promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies (“CICs”) listed on its website www.healthlottery.co.uk (the “Website”).

1.2 The correspondence address is The Health Lottery ELM Limited, Dept. 399, 2nd Floor, Queensgate, Grange Road East, Birkenhead CH41 5FD.

1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence numbers 000-026057-R-309179 and 000-026057-N-309180.

1.4 The Health Lottery Scheme manages 12 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. They operate under the Gambling Act 2005, (“The Act”) each or all being referred to as “The Health Lottery”, depending on the context. Operating this way allows every single part of Great Britain to receive their share of the appropriate proceeds.

1.5 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each month and proceeds are allocated according to Ticket sales for each CIC that is open. Money is then donated to health related ‘Good Causes’ within their respective local areas.

1.6 A complete list of the CICs promoting the society lotteries can be seen at Annex A of these Terms and Conditions.

1.7 Players should be aware that all the participating CICs are independent companies. THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and Good Causes they support is available. It should also be noted that the allocation of funds to Good Causes within the relevant CIC area is determined by the CICs’ partner charity, People’s Health Trust

1.8 At least 20% of the proceeds of each Lottery shall be paid to health related Good Causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.

1.9 All entries into and participation in the Lottery is strictly governed by these T&Cs. By entering the Lottery, a Player agrees to be bound by the T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.

1.10 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the Website along with the Game Rules, and THL will provide a copy by post if requested to do so on receipt of a stamped addressed envelope at the address in clause 1.2 above. T&Cs booklets and copies of the shortened form of the T&Cs and Game Rules (the Player’s Guide) can be obtained from a Health Lottery Participating Retailer.

1.11 If and when changes are made to the T&Cs, THL will use its database of Players that have registered online to notify all those Players for whom it has email details. THL will also distribute a revised version of its T&Cs to all Participating Retailers.

2. DEFINITIONS

Any words within these T&Cs which start with a capital letter shall have the following meanings:

(a) “Main Lottery Game” means The Heath Lottery product consisting of lottery  draws which are normally held on Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays and each entry into which includes an additional entry into an associated monthly Raffle Draw (such frequency may be subject to change) and for which the combined cost of each lottery and Raffle entry is £1. The amount of each £1 that will be applied to Main Lottery Game shall be clearly stated on the ticket.

(b) “Quick Pick Game” means the Health Lottery product offered by THL consisting of lottery draws which are normally held on Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays and each entry into which includes an additional entry into an associated monthly Raffle Draw ( such frequency may be subject to change).  The combined cost of each lottery and Raffle entry is £1 and lottery numbers are selected automatically at random. The amount of each £1 that will be applied to Main Lottery Game shall be clearly stated on the ticket.

(c) “Bonus Ball” means the number drawn in addition to the 5 regular numbers in the draw for the Main Lottery Game. This may also be referred to as the “Bonus Number” in marketing materials referring to the Main Lottery Game.

(d) “Claim Form” means a form provided by THL by mail or email to Players claiming a Prize of more than £50 in accordance with the THL postal claim procedure.

(e) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

(f) “Fixed Prize” means a prize category below the Jackpot Prize where the winners will receive a set amount not shared with other players subject to the same limitations in exceptional circumstances found at sections 6.15 and 6.16 of these T&Cs. These prize categories are: a free £1 ticket, £5, £10, £50, £250 and £10,000.

(g) “Game Rules” means the rules which are applicable to playing the draw based lottery game (Main Lottery Game) and which are published on THL’s website.

(h) “Good Causes” means the promotion of health for the public benefit by increasing and supporting sustainable health equality in and for disadvantaged communities and groups across England, Scotland and Wales.

(i) “Raffle Draw” means the Draw which is conducted on the first day of each month selected from all eligible Raffle Codes.  The amount of each £1 that will be applied to Raffle Draw shall be clearly stated on the ticket.

(j) “Raffle Code” means the Transaction Number provided by the terminal provider to retail Players or by email to online Players which will be entered into the Raffle Draw that THL  conducts on the first day of each month.

(k) “Raffle Prize” means the cash amount offered by THL in its monthly Raffle Draw. This is currently one prize each month of £250,000.  THL reserves the right to change the prize amount at its absolute discretion by providing advance notice on its Website.

(l) “Jackpot” or “Jackpot Prize” means the top prize in any Main Lottery Game Lottery Draw.

(m) “Lottery Draw” or “Draw” means the weekly lottery draws conducted by THL every Tuesday, Wednesday, Thursday, Friday and Saturday for the Main Lottery Game. Sales will be closed for these draws at 19.45 on each draw day. THL reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday or any other day deemed unsuit­able for holding a Draw by Health Lottery Management, in its discretion.

(n) “Lottery Ticket” or “Ticket” means the Ticket which is purchased by a Player in anticipation of a Lottery Draw and which carries the numbers selected by the Player (or in the case of a Quick Pick Ticket the numbers selected randomly) for entry into the Lottery and which may contain more than one line of play, together with the associated entries into the appropriate monthly Raffle Draw;

(o) “Participating Retailer” means a retailer or store that has agreed to sell Health Lottery Tickets on behalf of THL and the CICs.

(p) “Play” means any individual selection of 5 numbers entered into the Lottery.

(q) “Player” means an eligible person who purchases a Lottery Ticket in accordance with these T&Cs; and

(r) “Player’s Guide” means the shortened Game Rules and Terms and Conditions printed by THL for use at retail locations.

(s) “Prize” means the prize monies, non-cash Prizes or Free Ticket that may be won in the course of the Lottery draw or Raffle Draw in accordance with these T&Cs and any other rules of the Lottery.

(t) “Prize Ticket Promotion” means any promotion that the Health Lottery may run from time to time offering the chance to win a Quick Pick Ticket as a Prize to Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion. The opening and closing dates for these promotions will be stated clearly on the Health Lottery Website under the ‘Promotions’ tab and in print advertisements for the promotion.

(u) “Prize Ticket” means a single Quick Pick entry for Play into a Lottery Draw and appropriate Raffle Draw issued as a prize for Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion, whether for the same or another participating CIC at times when THL is offering a Prize Ticket Promotion.

(v) “Prize Capping” means the process that may be applied, if required by The Health Lottery to reduce the value of prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single draw of the Main Lottery Game exceeds £1m.

(w) “Quick Pick” means a line of play where all numbers have been selected at random by the lottery system using a random number generator.

(x) “Winning Number” or “Regular Number” means the 5 numbers drawn in the Main Lottery Game before any Bonus Ball is drawn.

(y) “Ticket” means a paid for entry into the Main Lottery Game. This is defined in (n) above.

 

3. CONDITIONS OF ENTRY

3.1 To enter the Lottery and to be eligible to win a Prize, Players:

(a) Must be 16 years of age or over; and

(b) Must comply with these T&Cs and any other rules of the Lottery notified by THL.

3.2 Any corporate body incorporated and with a registered office address in Great Britain may purchase and claim prizes in the Lottery.

3.3 Excluded Persons are ineligible to participate in the Lottery and shall not be entitled to receive any Prizes. Players will have the option to self-exclude for a period of 6 months to 5 years. Once excluded, Players will not be able to delete their account as a record of their exclusion must be kept.

3.4 All entry instructions communicated by THL shall form part of the Game Rules of the Lottery which are available on the Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2 above.

3.5 In purchasing a Ticket, Players acknowledge and agree that:

(a) They may be entered into a Lottery Draw which is not promoted by the CIC representing their geographic region; and

(b) A minimum of 20% of the Ticket price will go towards Good Causes.

3.6 By personally accepting the Prize from THL, Players warrant that they:

(a) Are not a director or an employee of THL, the CICs, or a key IT contractor or supplier claiming a prize on their own behalf. A director or an employee of THL may however claim a prize on behalf of THL;

(b) Are not a spouse or dependent of any person described in 3.6(a); and

(c) Are eligible to win a Prize under clause 3.1; and

(d) Fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.

3.7 THL will have sole and absolute discretion as to whether to accept any entry to the Lottery and pay out any Prizes. Its decision in the matter will be final and binding.

3.8 THL will rely on its own technical logs and records when determining whether a Player is eligible to receive a Prize.

3.9 The Player accepts that the Ticket they purchase in any week may not benefit directly the region in which they bought the Ticket. THL aims to ensure that different CICs representing different regions take it in turns to partici­pate in The Health Lottery each month to ensure, where possible, that across the course of a year, every participating region of Great Britain will benefit from monies raised as equally as possible.

3.10 Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Gambling Act 2005 and any relevant regulations made thereunder from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time and published on the THL Website.

4. HOW TO ENTER THE LOTTERY & MONTHLY RAFFLE

4.1 Players enter the Lottery Draw and relevant monthly Raffle Draw either by purchasing a paper Ticket from a retailer authorised by THL or by using the Website to purchase an online Ticket. Tickets will normally cost £1 per entry for combined entry into a Tuesday, Wednesday, Thursday, Friday and Saturday draw and appropriate monthly Raffle Draw. Tickets shall clearly state the amount of each £1 that is allocated to entry into the Main Lottery Game and the amount allocated to entry into the monthly Raffle Draw.

4.2 Participating Retailers may require proof of age or other identification to be shown before the Ticket will be sold. THL reserves the right to introduce new channels.

4.3 For the Main Lottery Game, the Player must choose five different lottery numbers, each of which must be between 1 and 50 inclusive, or may prefer to be allocated five different numbers in that range (a “Quick Pick”). A single Raffle Draw number is automatically generated for each transaction and this same number is entered the appropriately number of times and into the appropriate monthly Raffle Draw. This Raffle Draw number appears on the ticket receipt in retail and on the email confirmation for online Players.

4.4 For the Main Lottery Game the Player may choose to activate a Health Lottery Playcard (the “Playcard”) with their chosen five number selections for any play. Participating Retailers can activate a Playcard or Players may activate the Playcard by phoning the Contact Centre or using the Website. The activation of a Playcard will result in one or more selec­tions of five numbers (up to a maximum of ten) being recorded on The Health Lottery account record designated by the unique number on the Playcard in question.

4.5 Following activation, a Playcard may be used to purchase Tickets for future Draws of the Main Lottery Game.

4.6 When available, a play-slip or a Player’s Guide with a detachable single use Playcard may also be used to purchase Tickets.

4.7 A Ticket will be valid only for the Draw(s) to be held on the date(s) shown on the face of the Ticket. Players may choose to purchase a Ticket which enters the Player into the Lottery and appropriate monthly Raffle Draw for up to five weeks in advance.

4.8 It is the Player’s responsibility to check at the time of purchase that the date of the Draw and the numbers shown on the Ticket are those requested.

4.9 For each line purchased for any weekly draw in a given month (e.g. entries purchased for draws in September), the player also receives one entry into that month’s Raffle Draw (e.g. September’s Raffle Draw which takes place on 1st October). For the avoidance of doubt if, in a single transaction, a player purchases entries into draws covering two months (e.g. 3 chances for draws in September and 2 chances for draws in October) the player will also receive 3 chances in the September Raffle (drawn on 1st October) and 2 chances in the October Raffle (drawn on 1st November).

4.10 Cancellations are allowed only under exceptional circumstances. Any cancellation or reversal will need to be completed at the same location and on the same terminal as the original transaction. THL will allow cancellations and reversals for both a Ticket sale and a pay-out. In e-pay and Payzone Retailers, also in Participating Retailers using their own EPOS system to sell Tickets there will be a 30 minute window after which a reversal and cancella­tion cannot be performed at the terminal. PayPoint Retailers will only allow a cancellation within 10 minutes of the relevant transaction provided that no other transactions have been made in the interim.

4.11 For the avoidance of doubt, a Player may not seek cancellation of a Quick Pick Ticket if the numbers selected are not to his or her liking.

4.12 A Player may in certain circumstances request the repayment of their stake, should that Player have purchased a Ticket in advance of a Draw that is subject to a change in these Terms and Conditions, prior to the point at which the changed Terms and Conditions have been published by THL on the website. The Player must contact THL in writing at Dept. 399, 2nd Floor, Queensgate, Grange Road East, Birkenhead CH41 5FD, including enclosing the orig­inal Ticket, name, address, and the bank details to which the refund should be credited. This communication and Ticket must be received by THL at least 72 hours in advance of the affected Draw subject to the limitations stated in clause 8.2. Online Players must notify THL by email using their registered email address within the same 72 hour timeline in order to facilitate the refund. The Player accepts that if their application for a refund is accepted their Ticket will be withdrawn from the applicable Draw and will not be eligible for any Prizes.

4.13 The Player is solely responsible for ensuring that the Ticket remains safe and in a good and legible condition. For Players having participated in the Draw by purchasing a Ticket from a Retailer, the Ticket is sole evidence of entry into the Draw and must be in the possession of the Player to enable them to claim a Prize. The Playcard or play-slip cannot be used to claim a Prize or be relied upon as evidence of entry into a Draw.

4.14 Subject always to clause 9.2, THL accepts no responsibility for lost, stolen, damaged or defaced Tickets.

5. PLAYING THE LOTTERY ONLINE

5.1 Online Players of the Lottery are required to provide THL with their name, date of birth, address, contact details and bank or payment card details before an online registration will be processed. In order to play online Players must have either a GB registered debit or credit* card registered at a GB address.  Identity checks will be carried out to confirm that the Player is at least 16 years old and this will leave a soft footprint on the Player’s credit file for 12 months.

5.2 Registered online Players will be provided with an e-wallet in which they may deposit funds which they wish to use to participate in the Lottery Draws. No more than £500 may be deposited in the e-wallet in a single transaction. Players can make payments by either debit or credit* card which will be made to Health Lottery Financial Ltd (“HLFL”), a sister company of THL which handles all financial transactions for THL and the CICs. Players who supply details of a jointly owned bank account accept that Prizes won will be paid into that account.

*Players wishing to pay by credit card should note that we are only able to accept Visa or Mastercard at this time. The facility to play using a credit card is only available to online Players.  Your credit card provider may charge you for payments and withdrawals associated with gaming transactions.  For the avoidance of doubt THL/HLFL will not be liable for any credit card charges levied at Players and will not refund these to the Player.

5.3 Online Players can play by subscription using Direct Debit (“Subscription Players”). The Direct Debit Guarantee applies to all Direct Debit arrangements set up by the Players. Direct Debits will be collected by HLFL.

5.4 No online Player may purchase more than £80 of Tickets for any single Lottery Draw. A Player purchasing Tickets on behalf of a syndicate may not purchase more than £80 of Tickets for any single Lottery Draw per member of the syndicate.

5.5 No online Player will be permitted to deposit more money if the balance in their e-wallet is more than £2,000.

5.6 THL reserves the right to impose such cooling-off periods on the use of deposited monies as it considers appro­priate and will notify the same to Players before the deposit is accepted.

5.7 THL reserves the right to terminate a Player’s online account at any time, at its absolute discretion. Upon the termi­nation of the online account, all monies held by THL on behalf of the Player will be returned to the Player’s bank account within 14 working days.

5.8 Players may be asked if they wish to be contacted for advertising, promotional and marketing purposes. If Players wish to be removed from THL’s mailing list, they should click on the unsubscribe link shown on all Health Lottery e-mails or contact THL at unsubscribe@healthlottery.co.uk or call the Health Lottery Contact centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge. Players may also update their marketing preferences via their online account.

5.9 Online entries are final and cannot be cancelled, reversed or refunded once completed.

5.10 In addition to these T&Cs, Health Lottery online play is subject to the Terms and Conditions for Playing the Health Lottery Draw Game and Instant Lottery Game via the Internet and by Direct Debit published on the Website.

6. THE LOTTERY DRAW AND PRIZES

6.1 For the Main Lottery Game, the Lottery Draws will take place on a weekly basis on Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays and each monthly Raffle Draw will take place on the 1st day of each month. THL also reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday

6.2 The names of the participating CICs which will benefit from the lottery Draws in any one week and the appropriate monthly Raffle Draw will be displayed on the Website and the relevant CIC name will also appear on the Ticket. Tickets for more than one Draw will clearly display the date of all Draws and the relevant CIC for each Draw.

6.3 The results of any Lottery will be published on the Website or in any other source shall be for information purposes only and a Prize shall only be awarded to a winning Ticket which has the number(s) recorded at the Draw itself, by THL and an independent auditor. Online Players will be notified automatically to their registered e-mail address if they have won a Prize.

6.4 In the Lottery Draw, five numbers will be drawn at random by an approved ball machine from the range between 1 and 50 inclusive (the “Winning Numbers”). An additional number, the Bonus Ball, will be drawn after all five Winning Numbers have been drawn.

6.5 Only one Prize may be claimed in respect of each entry made to the Lottery Draw.

6.6 Subject to this clause 6, Prizes paid to the holders of Tickets with Winning Numbers in the Lottery Draw will be as follows for the Main Lottery Game whose draws are held on a Tuesday, Wednesday, Thursday, Friday or a Saturday:

- If one Winning number and the bonus ball is matched on a Player’s Ticket, the Player will win one free ticket*

- If two Winning Numbers are matched on a Player’s Ticket, the Player will win one free ticket*

– If two Winning Numbers and the Bonus Ball are matched on the Player’s Ticket, the Player will win one Prize of £5.

– If three of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £10.

– If three of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £50.

– If four of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £250.

– If four of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £10,000.

– If five of the Winning Numbers are matched on a Player’s Ticket, the Player will win a Prize of £25,000 or the equivalent of 10% of total Ticket sales for that Draw, up to a maximum prize value of £100,000, whichever is the greater. If there are multiple match 5 winners, the Prize will be divided by the number of winners. For example, if the Jackpot Prize is £25,000 and there are two players, each with a ticket matching all 5 numbers, each will win £12,500. Prizes will be rounded down to the nearest pound if required.

* A ‘free ticket’ in this instance shall be a Quick Pick ticket i.e. the lottery numbers will be selected at random by the lottery system using a random number generator. For the avoidance of doubt, the player will not be able to choose their own numbers or the draw the ticket will be entered into.  In the case of an online winner of a ‘free ticket’ the player will be allocated a Quick Pick ticket which shall automatically be entered into the next available lottery Draw. In the case of a retail winner of a ‘free ticket’ the player will receive a Quick Pick ticket for the next available lottery Draw from the time that they redeem their prize from the retailer.

6.7 When a ‘free ticket’ is awarded as a prize, this will also generate an entry into the appropriate monthly Raffle Draw.  Players are therefore advised to retain their original ticket and any subsequent ‘free tickets’ as both will contain eligible entries into a Monthly Draw.

6.8 All ‘free tickets’ are fully paid for by THL (ELM).

6.9 Players who win a Prize Ticket or a cash Prize of up to £50 inclusive with a paper Ticket in the Main Lottery Game may collect their Prize from any Participating Retailer which sells Tickets for the Lottery Draw. Players who win a Prize of up to and including £250 in the Main Lottery Game may collect their funds at any participating Post Office location or any other location identified on the Health Lottery Website as allowing the redemption a £250 prize. Players who win a Prize in excess of £250 with a paper Ticket must contact THL on 0844 375 55 55 or by email at help@healthlottery.co.uk in order to claim their Prize. In instances where a retail player is required to claim their Prize via our Helpline or website, and the Prize includes a ‘free ticket’, a physical Quick Pick ticket will be dispatched to the Player. This will not be an entry into the next available draw, but a future Draw taking place after the ticket has been received by the Player.

6.10 Players who accumulate multiple Prizes of £5, £10 or £50 on the same Ticket must also contact THL to claim their Prize if the total amount accumulated exceeds £250. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge. THL will only pay out cash Prizes in excess of £50 by cheque or electronic transfer to a UK bank account. THL reserves the right to pay cash Prizes in excess of £50 by means of any new payment method that becomes available in the future.

6.11 Players are responsible for ensuring that the correct Prize is paid by the Retailer for a match Bonus Ball win, match 2 balls win, match 2 balls plus Bonus Ball win, match 3 balls win, match 3 balls plus bonus ball win or match 4 at the time the Ticket is validated or any other day deemed unsuitable for holding a Draw by Health Lottery Management, in its discretion.

6.12 Raffle Draw Prizes can be claimed up to 180 days after the Draw. Players must contact THL on 0844 375 5555 in order to claim their prize. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.

6.13 No Prize will be paid on a Ticket that has been forged, altered, damaged or defaced in any way.

6.14 No Prize will be paid on a Ticket that fails THL’s validation process.

6.15 Online players may collect their Prize(s) of up to £2,000 in the Lottery Draw through their Health Lottery online account. Other Prizes for higher amounts must be claimed by contacting THL on 0844 375 55 55.Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.

6.16 Online Players who win a Prize or a combination of Prizes in excess of £2,000 in the Lottery Draw must contact THL on 0844 375 55 55 in order to claim their Prize. Subscription Players will automatically receive notification from THL of their Prize.

6.17 By claiming and accepting a Prize Players agree to publicity which will be carried out at the sole discretion of THL.

6.18 Should the total sum of Prizes due for payment in respect of any Lottery Draw exceed £1,000,000, THL reserves the right to implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, THL may reduce all prize categories in proportion so as to bring the total Prize pay-out to a minimum of £1,000,000.

6.19 The Prize Pool for each weeks Lottery is calculated once the eligible numbers have been entered into the system. All prizes on the Health Lottery will be paid in full unless Prize Capping is required.

6.20 THL reserves the right to change the Prize sums paid to Players without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.

6.21 Winning Players may be required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.

6.22 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned immediately to THL.

6.23 THL will use its reasonable endeavours to provide the Prize payment to the Player within fourteen working days of receiving the Player’s identification documents but will not be liable for prize payments that are received beyond the quoted timescale. Prizes for the Health Lottery Game must be claimed no later than 18.00 hours on the 180th day following the day of the Draw. Any Prize not claimed within this period will be forfeited. If any Prize is claimed by post, THL must receive the Ticket and Claim Form at the address shown on the Claim Form within this period.

6.24 Each winning Player is responsible for paying any and all taxes on any Prize won.

6.25 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their written consent.

 

7. SELF EXCLUSION

7.1 Any Player may opt at any time to be excluded from purchasing Tickets for future Lottery Draws by visiting the Website or a Participating Retailer. For online Players at the start of the period of self-exclusion (the “Exclusion Term”), all monies held by THL in the Player’s e-wallet will be returned to the Player and the online account will be suspended.

7.2 Players may choose the length of the Exclusion Term, subject to a minimum period of six months. During the Exclusion Term, they will not be permitted to access their online account held with THL or to purchase any Tickets using that account.

7.3 THL will not contact the Player at the expiration of the Exclusion Term. The Player may reinstate the account held with THL by contacting info@healthlottery.co.uk, although a cooling-off period of one week will be imposed by THL before the account becomes active.

7.4 The Player may choose to enter another Exclusion Term at any time.

7.5 Players may choose to enter an opt-out scheme under which they will not receive marketing materials from THL. Where THL communicates with its Players by email, each message will include a brief description of the way that the recipient may notify THL that they wish communications to cease.

7.6 THL will remove from its marketing lists the details of any Player who, upon receipt of unwanted marketing material, calls THL’s Contact Centre or email unsubscribe@healthlottery.co.uk. A Player may also use the unsubscribe link at the bottom of any marketing email to stop any further marketing communications.

7.7 Players should play responsibly. Information on how to gamble responsibly and how to access information about, and help in respect of, problem gambling can be found on the website or by sending a stamped addressed enve­lope to the address in clause 1.2 above. Alternatively information is available from www.gamcare.org.uk.

8. LIMITATION OF THE HEALTH LOTTERY’S LIABILITY & RESERVATION OF RIGHTS

8.1 Nothing in these T&Cs shall exclude or limit THL’s liability:

(a) For death or personal injury resulting from THL’s negligence; or

(b) For fraudulent misrepresentation; or

(c) For liability that cannot be excluded or limited by law.

8.2 Subject always to clause 8.1 neither THL nor any of the societies participating in the Health Lottery from time to time shall be liable to a Player for any loss or damage suffered by a Player arising from:

(a) Any failures or delays in any delivery methods (including postal services) used by THL or the Player from time to time.

(b) Retailer error or incorrect or misuse of retailer terminal (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize).

(c) Any event which is beyond THL’s or the societies’ reasonable control.
And in addition;

(d) The Lottery is provided on an “as is” and “as available” basis and no representations or endorsements of any kind are made; and

(e) All warranties, conditions and guarantees relating to the Lottery made by or on behalf of THL, whether express or implied by law, in the course of dealing or otherwise, are excluded to the maximum extent permitted by law.

8.3 THL is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Lottery for:

(a) Loss of revenue, contract, profits, business or anticipated savings or loss of data;

(b) Any special or indirect or consequential losses; or

(c) Any loss of goodwill or reputation.

8.4 THL does not guarantee that use of the Website, telephone system, broadcast or live transmission will be uninterrupted, timely and / or error-free.

8.5 Subject to clause 8.1, THL’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player.

8.6 THL is not responsible for any websites which may be visited via hyperlinks provided on the Website. Visitors to and transactions made on such websites are conducted entirely at the site user’s own risk.

8.7 THL reserves the right to exclude any Player from the Lottery in the event that THL believes in its sole discretion that the Player may be using technology to gain an unfair advantage over other Players of the Lottery.

9. LIABILITY OF PLAYERS

9.1 Players agree to fully indemnify THL in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by THL due to the Player’s misuse of the Website.

9.2 Nothing contained in these T&Cs shall affect the statutory rights of any Player. THL’s Complaints Procedure is avail­able on request by writing to the address in 1.2, by emailing THL at help@healthlottery.co.uk or by calling the Contact Centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.

10. COMPLAINTS

In the event of a complaint or to express any dissatisfaction with any aspect of THL, Players should email THL on help@ healthlottery.co.uk or call the Contact Centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.

11. DISPUTE RESOLUTION

If a complaint is not resolved to a Player’s satisfaction by the use of THL’s Complaints Procedure, and subject to the dispute meeting the criteria detailed in the Gambling Commission’s Code of Practice, the Player may request information as to how to refer their complaint to an independent adjudicator for further investigation and review. This independent adjudicator, namely the Independent Betting Adjudication Service (IBAS), is specialised in the resolution of gaming disputes.

12. INTELLECTUAL PROPERTY

All intellectual property rights generated as a result of the operation of the Lottery shall be the property of THL and Players agree to take all steps (at THL’s cost) to vest in THL any intellectual property which the Player creates in the course of entering the Lottery.

13. DATA PROTECTION

All information provided by Players to THL for the purposes of the Lottery will be stored, managed and used in accordance with current Data Protection legislation and also with the THL’s Privacy Statement as posted on the Website. THL’s Privacy Statement forms part of these T&Cs.

14. GOVERNING LAW

These T&Cs are governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts. 

15. INSOLVENCY

We are required by our licence to inform Players about what happens to funds which we hold on account for you, and the extent to which funds are protected in the event of insolvency www.gamblingcommission.gov.uk/consumers/protection_of_customer_funds.aspx The Lottery monies managed by THL and HLFL on behalf of the CICs are ring-fenced and covered by a Declaration of Trust of which the CICs and the Players are the beneficiaries. In the event that THL or HLFL are declared insolvent, the lottery funds are protected and the creditors of THL or HLFL will have no recourse to the lottery funds held on trust for the CICs and the Players. This meets the Gambling Commission’s requirements for the segregation of customer funds at the level: high protection.

1. INTRODUCTION

1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for all society lottery draws (the Lottery) which are promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies (“CICs”) listed on its website www.healthlottery.co.uk (the “Website”).

1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence numbers 000-026057-R-309179 and 000-026057-N-309180.

1.4 The Health Lottery Scheme manages 51 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. They operate under the Gambling Act 2005, (“The Act”) each or all being referred to as “The Health Lottery”, depending on the context. Operating this way allows every single part of Great Britain to receive their share of the appropriate proceeds.

1.5 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and proceeds are allocated according to Ticket sales for each CIC that is open. Money is then donated to health related ‘Good Causes’ within their respective local areas.

1.6 A complete list of the CICs promoting the society lotteries can be seen at Annex A of these Terms and Conditions.

1.7 Players should be aware that all the participating CICs are independent companies. THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and Good Causes they support is available. It should also be noted that the allocation of funds to Good Causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity, People’s Health Trust and not by THL.

1.8 At least 20% of the proceeds of each Lottery shall be paid to health related Good Causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.

1.9 All entries into and participation in the Lottery is strictly governed by these T&Cs. By entering the Lottery, a Player agrees to be bound by the T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.

1.10 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the Website along with the Game Rules, and THL will provide a copy by post if requested to do so on receipt of a stamped addressed envelope at the address in clause 1.2 above. T&Cs booklets and copies of the shortened form of the T&Cs and Game Rules (the Player’s Guide) can be obtained from a Health Lottery Participating Retailer.

1.11 If and when changes are made to the T&Cs, THL will use its database of Players that have registered online to notify all those Players for whom it has email details. THL will also distribute a revised version of its T&Cs to all Participating Retailers. The T&Cs may be amended by THL from time to time and will be published on the Website.

2. DEFINITIONS

Any words within these T&Cs which start with a capital letter shall have the following meanings:

(a) “£1 Game” means The Heath Lottery product with draws normally held on Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays (but such frequency may be subject to change) and for which the cost of each entry is £1 per line per Draw.

(b) “£1 Quick Pick Game” means the Health Lottery product offered by THL with draws normally held on Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays (but such frequency may be subject to change) and for which the cost of each entry is £1 per line per draw and numbers are selected automatically at random.

(c) “Bonus Ball” means the number drawn in addition to the 5 regular numbers in the draw for the £1 Game. This may also be referred to as the “Bonus Number” in marketing materials referring to the £1 Game.

(d) “Claim Form” means a form provided by THL by mail or email to Players claiming a Prize of more than £50 in accordance with the THL postal claim procedure.

(e) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

(f) “Fixed Prize” means a prize category below the Jackpot Prize where the winners will receive a set amount not shared with other players subject to the same limitations in exceptional circumstances found at sections 6.15 and 6.16 of these T&Cs. These prize categories are £10, £20, £50, £250 and £10,000.

(g) “Game Rules” means the rules which are applicable to playing the draw based lottery game (£1 Game) and which are published on THL’s website.

(h) “Good Causes” means the promotion of health for the public benefit by increasing and supporting sustainable health equality in and for disadvantaged communities and groups across England, Scotland and Wales.

(i) “Hot Ticket Draw” means the promotional draw that may be conducted from time to time by THL using a random number generator to select winning Hot Ticket Codes from all of the Codes that have been entered into the relevant Lottery Draw. Players matching 5 winning numbers from the £1 Game will not be eligible to win a Prize in the Hot Ticket Draw.

(j) “Hot Ticket Code” means the Transaction Number provided by the terminal provider to retail Players or by email to online Players which will be entered into the Hot Ticket Draw that THL may conduct from time to time for promo­tional purposes for the chance to win additional Prizes as advertised.

(k) “Hot Ticket Prize” means any prize be it a cash amount or a product offered by THL as part of the Hot Ticket Draw it may run from time to time for promotional purposes.

(l) “Jackpot” or “Jackpot Prize” means the top prize in any £1 Game Lottery Draw.

(m) “Lottery Draw” or “Draw” means the weekly lottery draws conducted by THL every Tuesday, Wednesday, Thursday, Friday and Saturday for the £1 Game. Sales will be closed for these draws at 19.45 on each draw day. THL reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday or any other day deemed unsuit­able for holding a Draw by Health Lottery Management, in its discretion.

(n) “Lottery Ticket” or “Ticket” means the Ticket which is purchased by a Player in anticipation of a Lottery Draw and which carries the numbers selected by the Player (or in the case of a Quick Pick Ticket the numbers selected randomly) for entry into the Lottery and which may contain more than one line of play;

(o) “Participating Retailer” means a retailer or store that has agreed to sell Health Lottery Tickets on behalf of THL and the CICs.

(p) “Play” means any individual selection of 5 numbers entered into the Lottery.

(q) “Player” means an eligible person who purchases a Lottery Ticket in accordance with these T&Cs; and

(r) “Player’s Guide” means the shortened Game Rules and Terms and Conditions printed by THL for use at retail locations.

(s) “Prize” means the prize monies, non cash Prizes or Free Ticket that may be won in the course of the Lottery draw or Hot Ticket draw in accordance with these T&Cs and any other rules of the Lottery.

(t) “Prize Ticket Promotion” means any promotion that the Health Lottery may run from time to time offering the chance to win a Quick Pick Ticket as a Prize to Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion. The opening and closing dates for these promotions will be stated clearly on the Health Lottery Website under the ‘Promotions’ tab and in print advertisements for the promotion.

(u) “Prize Ticket” means a single Quick Pick entry for Play into a Lottery Draw issued as a prize for Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion, whether for the same or another participating CIC at times when THL is offering a Prize Ticket Promotion.

(v) “Prize Capping” means the process that may be applied, if required by the Gambling Commission to reduce the value of prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single draw of the £1 Game exceeds £1m.

(w) “Quick Pick” means a line of play where all numbers have been selected at random by the lottery system using a random number generator.

(x) “Winning Number” or “Regular Number” means the 5 numbers drawn in the £1 Game before any Bonus Ball is drawn.

(y) “Ticket” means a paid for entry into the £1 Game. This is defined in (n) above.

3. CONDITIONS OF ENTRY

3.1 To enter the Lottery and to be eligible to win a Prize, Players:

(a) Must be 16 years of age or over; and

(b) Must comply with these T&Cs and any other rules of the Lottery notified by THL.

3.2 Any corporate body incorporated and with a registered office address in Great Britain may purchase and claim prizes in the Lottery.

3.3 Excluded Persons are ineligible to participate in the Lottery and shall not be entitled to receive any Prizes. Players will have the option to self-exclude for a period of 6 months to 5 years. Once excluded, Players will not be able to delete their account as a record of their exclusion must be kept.

3.4 All entry instructions communicated by THL shall form part of the Game Rules of the Lottery which are available on the Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2 above.

3.5 In purchasing a Ticket, Players acknowledge and agree that:

(a) They may be entered into a Lottery Draw which is not promoted by the CIC representing their geographic region; and

(b) A minimum of 20% of the Ticket price will go towards Good Causes.

3.6 By personally accepting the Prize from THL, Players warrant that they:

(a) Are not a director or an employee of THL, the CICs, or a key IT contractor or supplier claiming a prize on their own behalf. A director or an employee of THL may however claim a prize on behalf of THL;

(b) Are not a spouse or dependent of any person described in 3.6(a); and

(c) Are eligible to win a Prize under clause 3.1; and

(d) Fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.

3.7 THL will have sole and absolute discretion as to whether to accept any entry to the Lottery and pay out any Prizes. Its decision in the matter will be final and binding.

3.8 THL will rely on its own technical logs and records when determining whether a Player is eligible to receive a Prize.

3.9 The Player accepts that the Ticket they purchase in any week may not benefit directly the region in which they bought the Ticket. THL aims to ensure that different CICs representing different regions take it in turns to partici­pate in The Health Lottery each week to ensure, where possible, that across the course of a year, every participating region of Great Britiain will benefit from monies raised as equally as possible.

3.10 Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Gambling Act 2005 and any relevant regulations made thereunder from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time and published on the THL Website.

4. HOW TO ENTER THE LOTTERY

4.1 Players enter the Lottery Draw either by purchasing a paper Ticket from a retailer authorised by THL or by using the Website to purchase an online Ticket. Tickets will normally cost £1 per line per Draw for the Tuesday, Wednesday, Thursday, Friday and Saturday draws. At times when The Health Lottery offers a Prize Ticket Promotion, Players may also enter the Lottery Draw by way of having been issued a Prize Ticket for Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion.

4.2 Participating Retailers may require proof of age or other identification to be shown before the Ticket will be sold. THL reserves the right to introduce new channels.

4.3 For the £1 Game, the Player must choose five different numbers, each of which must be between 1 and 50 inclusive, or may prefer to be allocated five different numbers in that range (a “Quick Pick”). In cases where a Player enters the Lottery by way of a Prize Ticket having been issued for Players who have met the promotion criteria as stated in the terms and conditions of the relevant promotion, the entry shall be issued by way of a Quick Pick only.

4.4 For the £1 Game the Player may choose to activate a Health Lottery Playcard (the “Playcard”) with their chosen five number selections for any play. Participating Retailers can activate a Playcard or Players may activate the Playcard by phoning the Contact Centre or using the Website. The activation of a Playcard will result in one or more selec­tions of five numbers (up to a maximum of ten) being recorded on The Health Lottery account record designated by the unique number on the Playcard in question.

4.5 Following activation, a Playcard may be used to purchase Tickets for future Draws of the £1 Game.

4.6 When available, a Playslip or a Player’s Guide with a detachable single use Playcard may also be used to purchase Tickets.

4.7 A Ticket will be valid only for the Draw(s) to be held on the date(s) shown on the face of the Ticket. Players may choose to purchase a Ticket which enters the Player into the Lottery for up to five weeks in advance.

4.8 It is the Player’s responsibility to check at the time of purchase that the date of the Draw and the numbers shown on the Ticket are those requested.

4.9 Cancellations are allowed only under exceptional circumstances. Any cancellation or reversal will need to be completed at the same location and on the same terminal as the original transaction. THL will allow cancellations and reversals for both a Ticket sale and a payout. In e-pay and Payzone Retailers, also in Participating Retailers using their own EPOS system to sell Tickets there will be a 30 minute window after which a reversal and cancella­tion cannot be performed at the terminal. PayPoint Retailers will only allow a cancellation within 10 minutes of the relevant transaction provided that no other transactions have been made in the interim.

4.10 For the avoidance of doubt, a Player may not seek cancellation of a Quick Pick Ticket if the numbers selected are not to his or her liking.

4.11 A Player may in certain circumstances request the repayment of their stake, should that Player have purchased a Ticket in advance of a Draw that is subject to a change in these Terms and Conditions, prior to the point at which the changed Terms and Conditions have been published by THL on the website. The Player must contact THL in writing at Dept 399, 2nd Floor, Queensgate, Grange Road East, Birkenhead CH41 5FD, including enclosing the orig­inal Ticket, name, address, and the bank details to which the refund should be credited. This communication and Ticket must be received by THL at least 72 hours in advance of the affected Draw subject to the limitations stated in clause 8.2. Online Players must notify THL by email using their registered email address within the same 72 hour timeline in order to facilitate the refund. The Player accepts that if their application for a refund is accepted their Ticket will be withdrawn from the applicable Draw and will not be eligible for any Prizes.

4.12 The Player is solely responsible for ensuring that the Ticket remains safe and in a good and legible condition. For Players having participated in the Draw by purchasing a Ticket from a Retailer, the Ticket is sole evidence of entry into the Draw and must be in the possession of the Player to enable them to claim a Prize. The Playcard or Playslip cannot be used to claim a Prize or be relied upon as evidence of entry into a Draw.

4.13 Subject always to clause 9.2, THL accepts no responsibility for lost, stolen, damaged or defaced Tickets.

5. PLAYING THE LOTTERY ONLINE

5.1 Online Players of the Lottery are required to provide THL with their name, date of birth, address, contact details and bank or payment card details before an online registration will be processed. In order to play online Players must have either a GB registered debit or credit* card registered at a GB address.  Identity checks will be carried out to confirm that the Player is at least 16 years old and this will leave a soft footprint on the Player’s credit file for 12 months.

5.2 Registered online Players will be provided with an e-wallet in which they may deposit funds which they wish to use to participate in the Lottery Draws. No more than £500 may be deposited in the e-wallet in a single transaction. Players can make payments by either debit or credit* card which will be made to Health Lottery Financial Ltd (“HLFL”), a sister company of THL which handles all financial transactions for THL and the CICs. Players who supply details of a jointly owned bank account accept that Prizes won will be paid into that account.

*Players wishing to pay by credit card should note that we are only able to accept Visa or Mastercard at this time. The facility to play using a credit card is only available to online Players.  Your credit card provider may charge you for payments and withdrawals associated with gaming transactions.  For the avoidance of doubt THL/HLFL will not be liable for any credit card charges levied at Players and will not refund these to the Player.

5.3 Online Players can play by subscription using Direct Debit (“Subscription Players”). The Direct Debit Guarantee applies to all Direct Debit arrangements set up by the Players. Direct Debits will be collected by HLFL.

5.4 No online Player may purchase more than £80 of Tickets for any single Lottery Draw. A Player purchasing Tickets on behalf of a syndicate may not purchase more than £80 of Tickets for any single Lottery Draw per member of the syndicate.

5.5 No online Player will be permitted to deposit more money if the balance in their e-wallet is more than £2,000.

5.6 THL reserves the right to impose such cooling-off periods on the use of deposited monies as it considers appro­priate and will notify the same to Players before the deposit is accepted.

5.7 THL reserves the right to terminate a Player’s online account at any time, at its absolute discretion. Upon the termi­nation of the online account, all monies held by THL on behalf of the Player will be returned to the Player’s bank account within 14 working days.

5.8 Players may be asked if they wish to be contacted for advertising, promotional and marketing purposes. If Players wish to be removed from THL’s mailing list, they should click on the unsubscribe link shown on all Health Lottery e-mails or contact THL at unsubscribe@healthlottery.co.uk or call the Health Lottery Contact centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.

5.9 Online entries are final and cannot be cancelled, reversed or refunded once completed.

5.10 In addition to these T&Cs, Health Lottery online play is subject to the Terms and Conditions for Playing the Health Lottery Draw Game and Instant Lottery Game via the Internet and by Direct Debit published on the Website.

6. THE LOTTERY DRAW AND PRIZES

6.1 The Lottery Draws will take place on a weekly basis on Tuesdays, Wednesdays, Thursdays, Fridays and Saturdays for the £1 Game. THL also reserves the right to hold a Draw on an alternative date should the Draw occur on a Bank Holiday

6.2 The names of the participating CICs which will benefit from the Draw in any one week will be displayed on the Website and the relevant CIC name will also appear on the Ticket. Tickets for more than one Draw will clearly display the date of all Draws and the relevant CIC for each Draw.

6.3 The results of any Lottery will be published on the Website or in any other source shall be for information purposes only and a Prize shall only be awarded to a winning Ticket which has the number(s) recorded at the Draw itself, by THL and an independent auditor. Online Players will be notified automatically to their registered e-mail address if they have won a Prize.

6.4 In the Lottery Draw, five numbers will be drawn at random by an approved ball machine from the range between 1 and 50 inclusive (the “Winning Numbers”). An additional number, the Bonus Ball, will be drawn after all five Winning Numbers have been drawn.

6.5 Only one Prize may be claimed in respect of each entry made to the Lottery Draw.

6.6 Subject to this clause 6, Prizes paid to the holders of Tickets with Winning Numbers in the Lottery Draw will be as follows for the £1 Game whose draws are held on a Tuesday, Wednesday, Thursday, Friday or a Saturday:

– If two Winning Numbers and the Bonus Ball are matched on the Player’s Ticket, the Player will win one Prize of £10.

– If three of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £20.

– If three of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £50.

– If four of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £250.

– If four of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £10,000.

– If five of the Winning Numbers are matched on a Player’s Ticket, the Player will win a Prize equivalent to 10% of total Ticket sales for that Draw, up to a maximum prize value of £100,000. If there are multiple match 5 winners, the Prize will be divided by the number of winners. For example, if total Ticket sales are £900,000, the Jackpot Prize will be £90,000. If there are two winners, each Ticket having matched 5 numbers will win £45,000 (£90,000/2). Prizes will be rounded up to the nearest pound if required.

– The top prize in the Tuesday, Wednesday, Thursday and Friday Draw will be less as midweek sales are consistently lower than Saturday Ticket sales.

6.7 Players who win a Prize Ticket or a cash Prize of up to £50 inclusive with a paper Ticket in the £1 Game may collect their Prize from any Participating Retailer which sells Tickets for the Lottery Draw. Players who win a Prize of up to and including £250 in the £1 Game may collect their funds at any participating Post Office location or any other location identified on the Health Lottery Website as allowing the redemption a £250 prize. Players who win a Prize in excess of £250 with a paper Ticket must contact THL on 0844 375 55 55 or by email at help@healthlottery.co.uk in order to claim their Prize.

6.8 Players who accumulate multiple Prizes of £1, £10 or £20 on the same Ticket must also contact THL to claim their Prize if the total amount accumulated exceeds £250. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge. THL will only pay out cash Prizes in excess of £50 by cheque or electronic transfer to a UK bank account. THL reserves the right to pay cash Prizes in excess of £50 by means of any new payment method that becomes available in the future.

6.9 Players are responsible for ensuring that the correct Prize is paid by the Retailer for a match 2 balls plus Bonus Ball win, match 3 balls win, match 3 balls plus bonus ball win or match 4 at the time the Ticket is validated. or any other day deemed unsuitable for holding a Draw by Health Lottery Management, in its discretion.

6.10 When a Hot Ticket Raffle is offered, Hot Ticket Prizes can be claimed up to 180 days after the Draw. Players must contact THL on 0844 375 5555 in order to claim their prize.Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.

6.11 No Prize will be paid on a Ticket that has been forged, altered, damaged or defaced in any way.

6.12 No Prize will be paid on a Ticket that fails THL’s validation process.

6.13 Online players may collect their Prize(s) of up to £2,000 in the Lottery Draw through their Health Lottery online account. Other Prizes for higher amounts must be claimed by contacting THL on 0844 375 55 55.Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.

6.14 Online Players who win a Prize or a combination of Prizes in excess of £2,000 in the Lottery Draw must contact THL on 0844 375 55 55 in order to claim their Prize. Subscription Players will automatically receive notification from THL of their Prize.

6.15 By claiming and accepting a Prize Players agree to publicity which will be carried out at the sole discretion of THL.

6.16 Should the total sum of Prizes due for payment in respect of any Lottery Draw exceed £1,000,000, THL reserves the right to implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, THL may reduce all prize categories in proportion so as to bring the total Prize payout to a minimum of £1,000,000.

6.17 In the event that the total Prize payout exceeds £1,000,000 when a Prize Ticket Promotion is being offered, THL reserves the right to cancel this promotion and refuse to issue free Tickets to eligible Players in the Draw.

6.18 The Prize Pool for each weeks Lottery is calculated once the eligible numbers have been entered into the system. All prizes on the Health Lottery will be paid in full unless Prize Capping is required.

6.19 THL reserves the right to change the Prize sums paid to Players without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.

6.20 Winning Players may be required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.

6.21 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned immediately to THL.

6.22 THL will use its reasonable endeavours to provide the Prize payment to the Player within fourteen working days of receiving the Player’s identification documents but will not be liable for prize payments that are received beyond the quoted timescale. Prizes for the Health Lottery Game must be claimed no later than 18.00 hours on the 180th day following the day of the Draw. Any Prize not claimed within this period will be forfeited. If any Prize is claimed by post, THL must receive the Ticket and Claim Form at the address shown on the Claim Form within this period.

6.23 Each winning Player is responsible for paying any and all taxes on any Prize won.

6.24 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their written consent.

7. SELF EXCLUSION

7.1 Any Player may opt at any time to be excluded from purchasing Tickets for future Lottery Draws by visiting the Website or a Participating Retailer. For online Players at the start of the period of self-exclusion (the “Exclusion Term”), all monies held by THL in the Player’s e-wallet will be returned to the Player and the online account will be suspended.

7.2 Players may choose the length of the Exclusion Term, subject to a minimum period of six months. During the Exclusion Term, they will not be permitted to access their online account held with THL or to purchase any Tickets using that account.

7.3 THL will not contact the Player at the expiration of the Exclusion Term. The Player may reinstate the account held with THL by contacting info@healthlottery.co.uk, although a cooling-off period of one week will be imposed by THL before the account becomes active.

7.4 The Player may choose to enter another Exclusion Term at any time.

7.5 Players may choose to enter an opt-out scheme under which they will not receive marketing materials from THL. Where THL communicates with its Players by email, each message will include a brief description of the way that the recipient may notify THL that they wish communications to cease.

7.6 THL will remove from its marketing lists the details of any Player who, upon receipt of unwanted marketing material, calls THL’s Contact Centre or email unsubscribe@healthlottery.co.uk. A Player may also use the unsubscribe link at the bottom of any marketing email to stop any further marketing communications.

7.7 Players should play responsibly. Information on how to gamble responsibly and how to access information about, and help in respect of, problem gambling can be found on the website or by sending a stamped addressed enve­lope to the address in clause 1.2 above. Alternatively information is available from www.gamcare.org.uk.

8. LIMITATION OF THE HEALTH LOTTERY’S LIABILITY & RESERVATION OF RIGHTS

8.1 Nothing in these T&Cs shall exclude or limit THL’s liability:

(a) For death or personal injury resulting from THL’s negligence; or

(b) For fraudulent misrepresentation; or

(c) For liability that cannot be excluded or limited by law.

8.2 Subject always to clause 8.1 neither THL nor any of the societies participating in the Health Lottery from time to time shall be liable to a Player for any loss or damage suffered by a Player arising from:

(a) Any failures or delays in any delivery methods (including postal services) used by THL or the Player from time to time.

(b) Retailer error or incorrect or misuse of retailer terminal (including the loss of opportunity to enter The Health Lottery and/or right to receive a Prize).

(c) Any event which is beyond THL’s or the societies’ reasonable control.
And in addition;

(d) The Lottery is provided on an “as is” and “as available” basis and no representations or endorsements of any kind are made; and

(e) All warranties, conditions and guarantees relating to the Lottery made by or on behalf of THL, whether express or implied by law, in the course of dealing or otherwise, are excluded to the maximum extent permitted by law.

8.3 THL is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Lottery for:

(a) Loss of revenue, contract, profits, business or anticipated savings or loss of data;

(b) Any special or indirect or consequential losses; or

(c) Any loss of goodwill or reputation.

8.4 THL does not guarantee that use of the Website, telephone system, broadcast or live transmission will be uninterrupted, timely and / or error-free.

8.5 Subject to clause 8.1, THL’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player.

8.6 THL is not responsible for any websites which may be visited via hyperlinks provided on the Website. Visitors to and transactions made on such websites are conducted entirely at the site user’s own risk.

8.7 THL reserves the right to exclude any Player from the Lottery in the event that THL believes in its sole discretion that the Player may be using technology to gain an unfair advantage over other Players of the Lottery.

9. LIABILITY OF PLAYERS

9.1 Players agree to fully indemnify THL in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by THL due to the Player’s misuse of the Website.

9.2 Nothing contained in these T&Cs shall affect the statutory rights of any Player. THL’s Complaints Procedure is avail­able on request by writing to the address in 1.2, by emailing THL at help@healthlottery.co.uk or by calling the Contact Centre on 0844 375 55 55. 10. COMPLAINTS

In the event of a complaint or to express any dissatisfaction with any aspect of THL, Players should email THL on help@ healthlottery.co.uk or call the Contact Centre on 0844 375 55 55. 11. DISPUTE RESOLUTION

If a complaint is not resolved to a Player’s satisfaction by the use of THL’s Complaints Procedure, and subject to the dispute meeting the criteria detailed in the Gambling Commission’s Code of Practice, the Player may request information as to how to refer their complaint to an independent adjudicator for further investigation and review. This independent adjudicator, namely the Independent Betting Adjudication Service (IBAS), is specialised in the resolution of gaming disputes.

12. INTELLECTUAL PROPERTY

All intellectual property rights generated as a result of the operation of the Lottery shall be the property of THL and Players agree to take all steps (at THL’s cost) to vest in THL any intellectual property which the Player creates in the course of entering the Lottery.

13. DATA PROTECTION

All information provided by Players to THL for the purposes of the Lottery will be stored, managed and used in accordance with current Data Protection legislation and also with the THL’s Privacy Statement as posted on the Website. THL’s Privacy Statement forms part of these T&Cs.

14. GOVERNING LAW

These T&Cs are governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts. 

15 INSOLVENCY

We are required by our licence to inform Players about what happens to funds which we hold on account for you, and the extent to which funds are protected in the event of insolvency www.gamblingcommission.gov.uk/consumers/protection_of_customer_funds.aspx The Lottery monies managed by THL and HLFL on behalf of the CICs are ring-fenced and covered by a Declaration of Trust of which the CICs and the Players are the beneficiaries. In the event that THL or HLFL are declared insolvent, the lottery funds are protected and the creditors of THL or HLFL will have no recourse to the lottery funds held on trust for the CICs and the Players. This meets the Gambling Commission’s requirements for the segregation of customer funds at the level: high protection.

1. INTRODUCTION

1.1 The Terms and Conditions (the “T&Cs”) below set out the rules for The Health Lottery’s QuickWin society lottery draws (QuickWin) which are promoted and managed by Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies (“CICs”) or “Societies” listed on its website www.healthlottery.co.uk (the “Website”).

1.2 The correspondence address is Health Lottery ELM Limited, Dept. 374, 2nd Floor, Queensgate, Grange Road East, Birkenhead CH41 5FD.

1.3 THL is licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence number 000-026057-R-309179.

1.4 The Health Lottery Scheme manages 12 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. They operate under the Gambling Act 2005, (“The Act”) each or all being referred to as “The Health Lottery”, depending on the context. Operating this way allows every single part of Great Britain to receive their share of the appropriate proceeds.

1.5 Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual CIC. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and proceeds are allocated according to lottery sales for each CIC that is open. Money is then donated to health related ‘Good Causes’ within their respective local areas.

1.6 A complete list of the CICs promoting the society lotteries can be seen at Annex A of these Terms and Conditions.

1.7 Players should be aware that all the participating CICs are independent companies. THL has a link on the Website to each of the individual CICs where information about each of the CICs, the regions they represent and Good Causes they support is available. It should also be noted that the allocation of funds to Good Causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity, People’s Health Trust and not by THL.

1.8 At least 20% of the proceeds of each Lottery shall be paid to health related Good Causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.

1.9 All entries into and participation in the QuickWin lottery is strictly governed by these T&Cs. By entering the QuickWin lottery, a Player agrees to be bound by the T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the QuickWin lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.

1.10 THL reserves the right to amend these T&Cs from time to time. The current T&Cs will be posted on the Website along with the Game Rules, and THL will provide a copy by post if requested to do so on receipt of a stamped addressed envelope at the address in clause 1.2 above.

1.11 If and when changes are made to the T&Cs, THL will use its database of Players that have registered online to notify all those Players for whom it has email details.

2. DEFINITIONS

Any words within these T&Cs which start with a capital letter shall have the following meanings:

(a) “QuickWin Game” means the online Heath Lottery product with draws held every two and a half minutes (but such frequency may be subject to change) and for which the cost is £1 per line per Draw. Players choose their own 5 numbers between 1 and 50 per line.

(b) “QuickWin Quick Pick Game” means the online Health Lottery product offered by THL with draws normally held every two and a half minutes (but such frequency may be subject to change) and for which the cost is £1 per line per draw where a Player chooses not to select numbers but instead all numbers have been selected at random by the lottery system using a random number generator.

(c) “Bonus Ball” means the number drawn in addition to the 5 regular numbers in the Draw for the QuickWin Lottery. This may also be referred to as the “Bonus Number” in marketing materials referring to the QuickWin Game.

(d) “Claim Form” means a form provided by THL by mail or email to Players claiming a Prize of more than £250 in accordance with the THL postal claim procedure.

(e) “Excluded Person” means all persons who do not meet the eligibility criteria set out in clause 3.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as THL, a relevant CIC and the Gambling Commission may agree from time to time. Any person who enters the QuickWin Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

(f) “Fixed Prize” means a prize category below the Jackpot Prize where the winners will receive a set amount of money not shared with other players subject to the same limitations in exceptional circumstances found at sections 6.15 and 6.16 of these T&Cs. These prize categories are a) one free play in the next available draw, b) £1.50, c) £3, d) £10, e) £20, f) £50, g) £250 and h) £10,000.

(g) “Game Rules” means the rules which are applicable to playing the draw based lottery game (QuickWin Game) and which are published on THL’s website.

(h) “Good Causes” means the promotion of health for the public benefit by increasing and supporting sustainable health equality in and for disadvantaged communities and groups across England, Scotland and Wales.

(i) “Jackpot” or “Jackpot Prize” means the top prize in any QuickWin Game Lottery Draw.

(j) “Lottery Draw” or “Draw” means the QuickWin Lottery draws conducted by THL every two and a half minutes (but such frequency may be subject to change). THL reserves the right to hold the next available Draw at an alternative time should the Draw in question be subject to a technical error or due to any circumstance beyond the control of Health Lottery Management, in its discretion.

(k) “Lottery Ticket” or “Ticket” means the email confirmation which a Player receives when lines have been purchased by a Player in anticipation of a Lottery Draw and which carries the numbers selected by the Player (or in the case of a Quick Pick Ticket the numbers selected randomly) for entry into the Lottery and which may contain more than one line of play.

(l) “Play” means any individual selection of 5 numbers per line entered into the QuickWin Lottery.

(m) “Player” means an eligible person who participates in a Draw in accordance with these T&Cs.

(n) “Prize” means the prize monies or free Ticket that may be won in the course of the Draw in accordance with these T&Cs.

(u) “Prize Ticket” means a single Quick Pick entry for Play into a QuickWin lottery Draw issued as a prize for Players who have met the criteria as stated in the terms and conditions.

(v) “Prize Capping” means the process that may be applied, if required by the Gambling Commission to reduce the value of prizes in certain circumstances such as when the total value of cash Prizes won by Players in a single draw of a QuickWin Game exceeds £1m.

(w) “Winning Numbers” or “Regular Number” means the 5 numbers drawn in the QuickWin Game before any Bonus Ball is drawn.

3. CONDITIONS OF ENTRY

3.1 To enter the QuickWin Lottery and to be eligible to win a Prize, Players:

(a) Must be 16 years of age or over; and

(b) Must comply with these T&Cs and any other rules of the QuickWin Lottery notified by THL.

3.2 Players accounts must be registered to an individual at their home address within Great Britain in order for them to play and claim prizes in the QuickWin Lottery.

3.3 Excluded Persons are ineligible to participate in the QuickWin Lottery and shall not be entitled to receive any Prizes. Players will have the option to self-exclude for a period of 6 months to 5 years. Once excluded, Players will not be able to delete their account as a record of their exclusion must be kept.

3.4 All entry instructions communicated by THL shall form part of the Game Rules of the QuickWin lottery which are available on the Website or can be obtained on request by sending a stamped addressed envelope to the address in clause 1.2 above.

3.5 In purchasing a Ticket, Players acknowledge and agree that:

(a) They may be entered into a QuickWin lottery Draw which is not promoted by the CIC representing their geographic region; and

(b) A minimum of 20% of the Ticket price will go towards Good Causes.

3.6 By personally accepting the Prize from THL, Players warrant that they:

(a) Are not a director or an employee of THL, the CICs, or a key IT contractor or supplier claiming a prize on their own behalf;

(b) Are not a spouse or dependent of any person described in 3.6(a); and

(c) Are eligible to win a Prize under clause 3.1; and

(d) Fully understand that any misrepresentation of fact as to the Player’s eligibility, whether intentional or unintentional, will make the Player an Excluded Person and ineligible to win a Prize.

3.7 THL will have sole and absolute discretion as to whether to accept any entry to the QuickWin Lottery and pay out any Prizes. Its decision in the matter will be final and binding.

3.8 THL will rely on its own technical logs and records when determining whether a Player is eligible to receive a Prize.

3.9 The Player accepts that the Ticket they purchase in any Draw may not benefit directly the region in which they bought the Ticket. THL aims to ensure that different CICs representing different regions take it in turns to partici­pate in the QuickWin lottery each week to ensure, where possible, that across the course of a year, every participating region of Great Britain will benefit from monies raised as equally as possible.

3.10 Each Player agrees to be bound by the Game Rules, these T&Cs, any applicable provisions of The Gambling Act 2005 and any relevant regulations made thereunder from time to time. THL will not be liable for any loss or damage (including the loss of opportunity to enter the QuickWin lottery and/or right to receive a Prize) suffered by a Player if such Player has not complied with the Game Rules and/or these T&Cs. The Game Rules and T&Cs may be amended by THL from time to time and published on the Website.

4. HOW TO ENTER THE LOTTERY

4.1 Players enter the QuickWin lottery by using the Website to purchase an online Ticket. Tickets will cost £1 per line per Draw.

4.2 For the QuickWin Game, the Player must choose five different numbers, each of which must be between 1 and 50 inclusive, or may prefer to be allocated five different numbers in that range (a “Quick Pick”). In cases where a Player enters the QuickWin Lottery by way of a Prize Ticket having been issued for Players who have met the criteria as stated in the terms and conditions, the entry shall be issued by way of a Quick Pick only.

4.3 A Ticket will be valid only for the next available Draw as shown on screen.  For the avoidance of doubt Player may not pay for forward play beyond the next available Draw.

4.4 In instances where a Player selects their own lottery numbers, it is the Player’s responsibility to check the onscreen display prior to confirming their purchase that the numbers shown are those requested.

4.5 Cancellations are not allowed under any circumstances.

4.6 For the avoidance of doubt, a Player may not seek cancellation of a Quick Pick Ticket if the numbers selected are not to his or her liking.

5. PLAYING THE LOTTERY ONLINE

5.1 Online Players of the QuickWin Lottery are required to provide THL with their name, date of birth, address, contact details and bank details before an online registration will be processed. In order to play online Players must have a GB registered debit or credit card registered at a GB address. Identity checks will be carried out to confirm that the Player is at least 18 years old and this will leave a soft footprint on the Player’s credit file for 12 months.

5.2 Registered online Players will be provided with an e-wallet in which they may deposit funds which they wish to use to participate in the Draws. No more than £500 may be deposited in the e-wallet in a single transaction. Players can make payments by Debit or Credit Card which will be made to Health Lottery Financial Ltd (“HLFL”), a sister company of THL which handles all financial transactions for THL and the CICs. Players who supply details of a jointly owned bank account accept that Prizes won will be paid into that account.

5.3 No online Player will be permitted to wager more than £75 per day.

5.4 No online Player will be permitted to wager a total of more than £400 per week.

5.5 No online Player will be permitted to deposit more money if the balance in their e-wallet is more than £2,000.

5.6 THL reserves the right to impose such cooling-off periods on the use of deposited monies as it considers appro­priate and will notify the same to Players before the deposit is accepted.

5.7 THL reserves the right to terminate a Player’s online account at any time, at its absolute discretion. Upon the termi­nation of the online account, all monies held by THL on behalf of the Player will be returned to the Player’s bank account within 5 working days.

5.8 Players may be asked if they wish to be contacted for advertising, promotional and marketing purposes. If Players wish to be removed from THL’s marketing database, they should click on the unsubscribe link shown on all THL e-mails or contact THL at unsubscribe@healthlottery.co.uk or call the Health Lottery Contact centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.

5.9 Online entries are final and cannot be cancelled, reversed or refunded once completed.

5.10 In addition to these T&Cs, Health Lottery online play is subject to the Terms and Conditions for Playing the Health Lottery Draw Game and Instant Lottery Game via the Internet and by Direct Debit published on the Website.

6. THE LOTTERY DRAW AND PRIZES

6.1 The names of the participating CICs which will benefit from the Draw in any one week will be displayed on the Website.

6.2 The results of any Lottery published on the Website shall be for information purposes only and a Prize shall only be awarded to a winning Ticket which has the number(s) recorded at the Draw itself. Players will be notified on screen if they have won a Prize and this information will also be recorded in the player’s transaction history.

6.3 In the Draw, five numbers will be selected at random by an approved Random Number Generator (RNG) from the range between 1 and 50 inclusive (the “Winning Numbers”). An additional number, the Bonus Ball, will be selected after all five Winning Numbers have been selected.

6.4 Only one Prize may be claimed in respect of each entry made to the QuickWin lottery Draw.

6.5 Subject to this clause 6, Prizes paid to the holders of Tickets with Winning Numbers in a QuickWin lottery Draw will be as follows:

– If the Bonus Ball only is matched on the Player’s Ticket, the Player will win one Prize of a free line in the next available Draw.  The free line will be comprised of the same five numbers that originally won the prize.  For the avoidance of doubt Players winning one free line in the next available draw will not be able to select their own numbers or the QuickPick option. The free play is fully paid for by THL.

– If one Winning Number and the Bonus Ball are matched on the Player’s Ticket, the Player will win one Prize of £1.50.

– If two of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £3.00.

– If two of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £10.00.

– If three of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £20.00.

– If three of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £50.00.

– If four of the Winning Numbers are matched on a Player’s Ticket, the Player will win one Prize of £250.00

– If four of the Winning Numbers and the Bonus Ball are matched on a Player’s Ticket, the Player will win one Prize of £10,000.

– If five of the Winning Numbers are matched on a Player’s Ticket, the Player will win a Prize of £25,000.

6.6 Players who win a cash Prize in excess of £250 must contact THL on 0844 375 55 55 or by email at help@healthlottery.co.uk in order to claim their Prize. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.

6.7 No Prize will be paid on an entry that fails THL’s validation process.

6.8 Online players may collect their Prize(s) of up to £250 in a QuickWin Draw through their Health Lottery online account.

6.9 By claiming and accepting a Prize Players agree to publicity which will be carried out at the sole discretion of THL.

6.10 Should the total sum of Prizes due for payment in respect of any Lottery Draw exceed £1,000,000, THL reserves the right to implement Prize Capping to reduce the sum of the Prizes distributed to Players. In such circumstances, THL may reduce all prize categories in proportion so as to bring the total Prize pay-out to a minimum of £1,000,000.

6.11 THL reserves the right to change the Prize structure without further notice at its absolute discretion where it is required to do so by law, regulation or the instruction of the Gambling Commission.

6.12 Winning Players are required to provide such proof of their identity, age and compliance with these T&Cs as THL shall require before the Prize payment is made.

6.13 Where a Prize is paid to an Excluded Person or is otherwise paid in error, the Prize must be returned immediately to THL.

6.14 THL will use its reasonable endeavours to credit Winning Players’ wallets with Prize payments of £250 and below within one minute of each Draw. Players may then withdraw their winnings to their registered payment card.  It may take up to fourteen working days to reach a Player’s bank account.  For high prize winners i.e. £10,000 and £25,000 THL will use its reasonable endeavours to provide the Prize payments within fourteen working days of receiving the Player’s identification documents but will not be liable for late delivery. Prizes for the QuickWin Lottery must be claimed no later than 18.00 hours on the 180th day following the day of the Draw. Any Prize not claimed within this period will be forfeited.

6.15 Each winning Player is responsible for paying any and all taxes on any Prize won.

6.16 Except when required to do so by law, or for the purpose of publicising unclaimed Prizes, THL will not make public information about Prize winners without first obtaining their consent.

 

7. SELF EXCLUSION

7.1 Any Player may opt at any time to be excluded from purchasing Tickets for future Lottery Draws by visiting the Website. At the start of the period of self-exclusion (the “Exclusion Term”), all monies held by THL in the Player’s e-wallet will be returned to the Player and the online account will be suspended.

7.2 Players may choose the length of the Exclusion Term, subject to a minimum period of six months. During the Exclusion Term, they will not be permitted to access their online account held with THL or to purchase any Tickets using that account.

7.3 THL will not contact the Player at the expiration of the Exclusion Term. The Player may reinstate the account held with THL by contacting info@healthlottery.co.uk, although a cooling-off period of one week will be imposed by THL before the account becomes active.

7.4 The Player may choose to enter another Exclusion Term at any time.

7.5 Players should play responsibly. Information on how to gamble responsibly and how to access information about, and help in respect of, problem gambling can be found on the website or by sending a stamped addressed enve­lope to the address in clause 1.2 above. Alternatively information is available from www.gamcare.org.uk.

 

8. LIMITATION OF THE HEALTH LOTTERY’S LIABILITY & RESERVATION OF RIGHTS

8.1 Nothing in these T&Cs shall exclude or limit THL’s liability:

(a) For death or personal injury resulting from THL’s negligence; or

(b) For fraudulent misrepresentation; or

(c) For liability that cannot be excluded or limited by law.

8.2 Subject always to clause 8.1 neither THL nor any of the Societies participating in the Health Lottery from time to time shall be liable to a Player for any loss or damage suffered by a Player arising from:

(a) Any failures or delays in any delivery methods (including postal services) used by THL or the Player from time to time.

(b) Any event which is beyond THL’s or the Societies’ reasonable control.
And in addition;

(c) The Lottery is provided on an “as is” and “as available” basis and no representations or endorsements of any kind are made; and

(d) All warranties, conditions and guarantees relating to the QuickWin Lottery made by or on behalf of THL, whether express or implied by law, in the course of dealing or otherwise, are excluded to the maximum extent permitted by law.

8.3 THL is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with the Lottery for:

(a) Loss of revenue, contract, profits, business or anticipated savings or loss of data;

(b) Any special or indirect or consequential losses; or

(c) Any loss of goodwill or reputation.

8.4 THL does not guarantee that use of the Website, telephone system, broadcast or live transmission will be uninterrupted, timely and / or error-free.

8.5 Subject to clause 8.1, THL’s liability to any Player shall be limited to the amount of any Prize which may have become due to that Player.

8.6 THL is not responsible for any websites which may be visited via hyperlinks provided on the Website. Visitors to and transactions made on such websites are conducted entirely at the site user’s own risk.

8.7 THL reserves the right to exclude any Player from the QuickWin Lottery in the event that THL believes in its sole discretion that the Player may be using technology to gain an unfair advantage over other Players of the Lottery.

9. LIABILITY OF PLAYERS

9.1 Players agree to fully indemnify THL in respect of all liabilities, damages, claims, actions, expenses, demands or costs incurred by THL due to the Player’s misuse of the Website.

9.2 Nothing contained in these T&Cs shall affect the statutory rights of any Player. THL’s Complaints Procedure is avail­able on request by writing to the address in 1.2, by emailing THL at help@healthlottery.co.uk or by calling the Contact Centre on 0844 375 55 55. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.

10. COMPLAINTS

In the event of a complaint or to express any dissatisfaction with any aspect of THL, Players should email THL on help@ healthlottery.co.uk or call the Health Lottery Helpline on 0844 375 55 55 between the hours of 09:00 – 17:30 Monday – Friday. Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.  The Complaints Procedure may be viewed and downloaded from the Website.

11. DISPUTE RESOLUTION

If a complaint is not resolved to a Player’s satisfaction by the use of THL’s Complaints Procedure, and subject to the dispute meeting the criteria detailed in the Gambling Commission’s Code of Practice, the Player may request information as to how to refer their complaint to an independent adjudicator for further investigation and review. This independent adjudicator, namely the Independent Betting Adjudication Service (IBAS), is specialised in the resolution of gaming disputes.

12. INTELLECTUAL PROPERTY

All intellectual property rights generated as a result of the operation of the QuickWin Lottery shall be the property of THL or its licensors and Players agree to take all steps (at THL’s cost) to vest in THL any intellectual property which the Player creates in the course of entering the Lottery.

13. DATA PROTECTION

All information provided by Players to THL for the purposes of the QuickWin Lottery will be stored, managed and used in accordance with current Data Protection legislation and also with the THL’s Privacy Statement as posted on the Website. THL’s Privacy Statement forms part of these T&Cs.

14. GOVERNING LAW

These T&Cs are governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts. 

15. INSOLVENCY

We are required by our licence to inform Players about what happens to funds which we hold on account for you, and the extent to which funds are protected in the event of insolvency www.gamblingcommission.gov.uk/consumers/protection_of_customer_funds.aspx The Lottery monies managed by THL and HLFL on behalf of the CICs are ring-fenced and covered by a Declaration of Trust of which the CICs and the Players are the beneficiaries. In the event that THL or HLFL are declared insolvent, the lottery funds are protected and the creditors of THL or HLFL will have no recourse to the lottery funds held on trust for the CICs and the Players. This meets the Gambling Commission’s requirements for the segregation of customer funds at the level: high protection.

The GDPR introduces further protection  with regard to processing of personal data. Data subjects now have the right to be informed; the right of access to their personal data; the right to rectification; the right to erasure plus other supplementary information. 1. The Game/Promotion

By entering this promotion (“the Promotion”), you agree to be bound by the following terms and conditions (the “T&Cs”).

1.1 The promotion is open to mainland UK residents aged 16 or over who set up a new Health Lottery Direct Debit during the Promotion Period (please see 1.2 below) (with the exception of employees of The Health Lottery and the Gambling Commission, their immediate families living at the same address, certain contractors of Health Lottery as well as anyone else professionally connected with the promotion).

1.2 The promotion will start at 00:01am on 1st March 2018 and finish at 23:59pm on 30th November 2018 at 19:30 ("the Promotion Period").

1.3 Every Player who, during the Promotion Period, sets up a new online Direct Debit for any draws through their online Health Lottery account (excludes QuickWin and Instant Win games) is eligible to receive the bonus credit in line with these T&Cs.

1.4 Direct Debit payments will be collected on the 1st, 5th, 10th, 15th, 20th or 25th of every month from the nominated bank account.

1.5 Eligible players will receive the equivalent of 100% of their monthly spend as a bonus credit into their bonus wallet for the first 8 weeks following successful direct debit payment collections. The bonus payment will be received within 28 days from the first collection date.  In order to play and withdraw any winnings associated with the bonus credit awarded, players must add a debit card to their account.  Monthly bonus is capped at £10.  Only two monthly bonus payments (each equivalent to 100% of the monthly direct debit payment and capped at £10) will be awarded to players regardless of the number of new direct debit subscriptions they set during the promotion period.  For the avoidance of doubt, only the first new subscription will qualify for the bonus.

1.6 Bonus is fully paid for by The Health Lottery ELM.

1.7 Bonus credit that is awarded will expire after 30 days from the date it is awarded unless used and bonus credit may not be withdrawn. There is no cash alternative to the bonus credit.

1.8 Bonus play is only valid online. Bonus cannot be used on QuickWin -or Instant Win games, withdrawn or used to qualify for other bonus awards.

1.1 The Health Lottery is running this Promotion in conjunction with Grace & Courage (the “Supplier”) and a third party providing the Promotion Item (the “Partner”) (as specified in the Special conditions above).  Each Promotion is open to online Players of The Health Lottery (“Players”) who are residents of mainland Great Britain (excluding Northern Ireland) and aged 16 or over (with the exception of employees of The Health Lottery and the Gambling Commission, their immediate families living at the same address, certain contractors of Health Lottery as well as anyone else professionally connected with the Promotion).  The Promotion is also open to Suppliers’ employees (subject to each Partner’s own internal restrictions).

 

1.2 A Promotion will start at 00:01 am on  a particular promotion date (as specified in the Special conditions above) and finish 14 days later at 23:59pm   ("the Promotion Period").

 

1.3 Players who, during the Promotion Period, purchase a Health Lottery ticket online through the Health Lottery Website shall be entitled to claim the Promotion Item in the form of a voucher (the “Voucher”) entitling them to a free or discounted product or service from the Partner as determined by The Health Lottery in conjunction with the Partner up until the Final Redemption Date (as specified in the Special conditions above). 

 

1.4 A Player may claim a Voucher in the following ways:

 

Purchasing a Health Lottery ticket online

a. A Player must log in to their Health Lottery account from the Health Lottery website and purchase five pounds £5.00 of Health lottery tickets (the “Purchase”) online within the Promotion Period. The Purchase only applies to Health Lottery tickets and excludes QuickWin and Instant Win games, furthermore any entries made using an awarded bonus do not qualify for the Promotion. If a Player does not already have an account, they will need to create one as detailed in clause 1.8 below in order to purchase the tickets online;

 

b. Once a Player has made the Purchase online they will automatically be given an option to be directed to the Health Lottery’s promotions interactive page.

 

c. On the promotions interactive page the Player is required to enter their name and their registered e-mail address in the relevant entry boxes.  They will be sent an email containing the Voucher.  (If a Player does not receive an email in their inbox they should check other folders including their junk folder before contacting the Contact Centre).  A Player will then have until the Final Redemption Date (as stipulated in the Special Conditions) to redeem the Promotion Item on the Voucher.  If the Promotion Item is not redeemed within this time frame it will expire. For the avoidance of doubt if a Player deletes an email containing a Voucher they will not be able to redeem the Promotion.

 

d. Health Lottery Direct Debit players may participate in the Promotion and will receive a Voucher for every additional £5 they spend on Health Lottery tickets in a single transaction (excluding QuickWin and Instant Win Games) using a debit or credit card and following the steps described above.   



e. Please note that online Players will not be eligible to receive a Voucher if they purchase tickets using bonus points or in connection with any other Health Lottery offer.

 

1.5 Once a Player has received a Voucher, the Partner will be responsible to the Player for fulfilment of the Promotion Item on the Voucher.

 

1.6 Conditions governing the amount of Promotional Items that a Player can claim per Purchase may vary with each Promotion.  Please see the Special conditions above for details of conditions governing this Promotion. 

 

1.7 Each Promotion is an exclusive entity in its own right, and may not be used in conjunction with any other offer, regardless of eligibility and no Promotion (or Voucher) may be exchanged for another Promotion (or Voucher) or the cash value of the Promotion offer (or Voucher).

 

1.8 To set up an account with The Health Lottery website the Player must go to www.healthlottery.co.uk ("the Site") and click on ‘Sign Up’.  The Health Lottery Terms and relevant Games Rules and Procedures (all available on the Site) shall apply to; registration, use of your account and the playing of Health Lottery games online.  In order to activate an account the Player will be sent an e-mail with a link to the Player’s e-mail address submitted on the Registration page.  The Player must open this e-mail and click on the link to activate their account.

1.15 Complaints:

*amount will be collected on the 1st, 5th, 10th, 15th, 20th or 25th of every month from the nominated bank account.

1.3 Eligible players will receive the equivalent of £7 for each weekly £7 spend as a bonus credit into their bonus wallet for each successful direct debit payment. The bonus is applied for the first 7 weeks subject to successful payment collection and the first bonus payment will be received within 28 days from the first collection date.  In order to play and withdraw any winnings associated with the bonus credit awarded, players must add a debit card to their account.

1.4 Bonus is fully paid for by The Health Lottery ELM.

1.5 Each bonus credit that is awarded will expire after 30 days from the date it is awarded unless used and bonus credit may not be withdrawn.  There is no cash alternative to the bonus credit.

1.6 Bonus play is only valid online. Bonus cannot be used on instant wins, withdrawn or used to qualify for other bonus awards. 

1.7 To set up a Direct Debit for The Health Lottery, go to www.healthlottery.co.uk ("the Site"), log in to your account and click Play Now.  Select your numbers, enter your nominated bank details followed by Confirm.  Please read the onscreen message and click Confirm again to complete the direct debit subscription. An e-mail containing details of your payment schedule and first draw to be entered will be sent to your registered e-mail address. The Health Lottery Terms and relevant Games Rules and Procedures (all available on the Site) apply to registration, use of your account and the playing of Health Lottery games online.

1.8 Entries not complying with these T&Cs will not be valid.

1.9 The Promoter shall have no liability for any system failure or other action or event which prevents a player from entering the Promotion.

1.10 The Promoter's decision is final. No correspondence will be entered into.

1.      Definitions

1.1 Definitions

Any words within these Terms and Conditions which start with a capital letter shall have the following meanings:

‘Act’

means the Gambling Act 2005

‘Age Verification Process’

means the automatic process conducted during player registration in order to verify that a player is aged 16 or over.

Claim Form’

means the form that will be supplied to a claimant to be completed as part of the process for claiming certain large Prizes in the Lottery Draw Game or Instant Lottery Games.

'Direct Debit'

The entitlement to participate in some Draw-Based Games for a multiple number of Draws by setting a recurring payment method.

'Entry'
means a chance or entry in the Lottery Draw Game which has been registered as an entry on the Health Lottery Computer System.

‘Excluded Person’

means all persons who do not meet the eligibility criteria set out in clause 4.1 and such other persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC  and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

‘Game(s)’

means either the Lottery Draw Game or an Instant Lottery Game.'Health Lottery'

‘Health Lottery Computer System’

means the computer system operated by the Health Lottery or its software suppliers for the purpose of recording and entering online entries into the Lottery Draw Game and the purchase and playing of Instant Lottery Games.

 ‘Instant Lottery Game’

means an instant win Health Lottery product offered to Players via the Website.

 ‘Instant Lottery Game Rules’

means Game Rules published on the Health Lottery website specifically for each Instant Lottery product in a ‘How to Play’ section accompanying each game.

‘Key IT Contractor’

means contractors involved in the development and support of the Health Lottery Computer System software and infrastructure

'Lottery Draw Game'

means The Health Lottery draw of 5 main numbers and a bonus number conducted on Wednesdays and Saturdays.

‘Lottery Draw Game Rules’

means The Health Lottery Draw Game Rules published on the Health Lottery website. ‘Main Health Lottery Terms and Conditions’

means the Terms and Conditions published separately on the Health Lottery’s website and applying to both retail and online sales of the Health Lottery Draw Game.

'Player'

means a member of the playing public who after successfully completing registration and accessing a Game,  purchases a ticket, and is eligible to play the Game in accordance the Terms and Conditions relating to this Game.

'Prize'

means a prize listed in the official prize structure of the Game and which has been has been won by a Player. 

‘Self Excluded Person’

Means any person who has chosen to exclude themselves from the Lottery for any reason, either via the Website, Contact Centre or in a Retailer in accordance with the Act.

‘Website’

The website of the Health Lottery at www.healthlottery.co.uk   

2. The Health Lottery and the Games

2.1 The Terms and Conditions set out below for playing by remote means of the Health Lottery Draw Game and Instant Lottery Games which are promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies listed on its website www.healthlottery.co.uk All the intellectual property rights including copyright and trademarks used on the Health Lottery website are owned by the Health Lottery. The Health Lottery may change these Terms and Conditions from time to time, these changes take effect immediately upon publication to the Health Lottery website and shall be binding on all Players.

2.2 The Health Lottery Draw Game is played at a retailer, via the Health Lottery Website or by Online Direct Debit and is governed by these Terms and Conditions for Playing the Health Lottery Draw Game and Instant Lottery Games via the Internet and by Direct Debit as well as the Main Health Lottery Terms & Conditions and the Game Rules. The Main Health Lottery Terms and Conditions and Game rules are published on the Health Lottery website and may be changed from time to time, any changes taking immediate effect upon publication.

2.3 The Health Lottery Instant Lottery Games are played are played solely via the Health Lottery Website and are governed by these Terms and Conditions. The Health Lottery Instant Lottery Games are also subject to the Instant Lottery Game Rules published on the Health Lottery Website in a ‘How to Play’ section specific to each Instant Lottery Game.

2.4 The Health Lottery  operates as a series of society lotteries under the Gambling Act 2005, (“The Act”) each or all being referred to as ”The Health Lottery” or “THL”, depending on the context. Operating this way allows costs to be kept to a minimum so that larger sums of Society Lottery funding can be allocated to local health related Good Causes, and, unlike other lotteries, every single part of Great Britain gets their share of the appropriate proceeds.

2.5  Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries each week and proceeds are allocated according to ticket sales for each CIC that is open. Money is then donated to support health related ‘Good Causes’ within their respective local areas.

2.6 Players should be aware that all the participating CICs are independent companies.  THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and good causes they support is available.  It should also be noted that the allocation of funds to good causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity People’s Health Trust and not by THL.

2.7 At least 20% of the proceeds of each Lottery of the Lottery Draw Game shall be paid to health related good causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.  

2.8 For Instant Lottery Games, 20% of the proceeds of every Game shall be paid to health related good causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted. 

2.9 All entries into and participation in the Games are strictly governed by these Terms and Conditions and the Game Rules. By entering the Lottery Draw Game or an Instant Lottery Game, a Player agrees to be bound by the Terms and Conditions in force on that date. THL reserves the right to refuse any Entry to the Lottery Draw Game and Instant Lottery Games or to withhold any Prize if it has reasonable grounds to believe that the Game Rules & Terms and Conditions have been breached.

2.10 THL reserves the right to amend these Terms and Conditions from time to time. The current version will be posted on the Website, and THL will provide a copy by post on receipt of a stamped address envelope at the address in 1.1. Alternatively a copy of the shortened form of the Terms and Conditions can be obtained on request from a Health Lottery Participating Retailer. 

2.11 These Terms and Conditions apply to all Games played via the Health Lottery Website, or via Direct Debit.

2.12 Only by Registering to Play and accepting the Terms and Conditions, can a Player access Games on the Health Lottery Website or play by Direct Debit.

2.13 The Player warrants that once registered they will play the Game in compliance with the Terms and Conditions and will not use the Health Lottery website for malicious purposes including but not limited to the transmission of offensive content or computer viruses.

2.14 By accepting the Prize from THL, Players warrant that they:

a) are not a director or an employee of THL claiming a prize on their own behalf .

b) an employee of the CICs, People’s Health Trust or a key IT contractor or supplier;

c) are not a spouse or dependent  of any person described above in a) and b). 

3. The Health Lottery Instant Lottery Games

3.1 The Instant Lottery Games are offered on the Health Lottery’s Website and form part of the Health Lottery scheme, offered through its Remote Operating Licence issued by the Gambling Commission (Licence number 000-026057-R-309179).

3.2 The Health Lottery may at any time announce the opening or the closing of an Instant Lottery Game. The announcement of the closing of a particular Game shall be displayed in the ‘News’ section of the website. This announcement will include the exact closing date and the date and the date by which Prize claims for that particular Game must be received to be valid.

3.3 The Health Lottery may close a Game without notice or compensation should the integrity of the Game be questioned or subject to a complaint by a Player, the Commission or any interested party such as law enforcement agency.

3.4 In order to access and play any Instant Lottery Game, a Player will need to have completed his account registration in accordance with section 4 below and accepted these Terms and Conditions.

3.5 The result of each Instant Lottery Game shall be pre-determined at the time of purchase and shall not include any element of skill. The Health Lottery Computer System will determine prizes based on the probabilities and not from a limited pool of prizes.  

3.6 The chances of winning a Prize will be exactly the same at the point of purchase and shall not be affected by previous wins in the same Game or other Prizes previously paid in other Instant Lottery Games . The advertised prize structure shall remain in place at all times, with each prize tier always available for a win as the Instant Lottery Games do not use a limited pool.

3.7 Prizes for Instant Lottery Games are limited to £25,000, unless the proceeds of a Game shall be greater than £250,000, in which case the prize may be increased to an amount up to £400,000 or 10% of the proceeds, whichever is lower.

3.8 The Game Rules for each Instant Lottery Game shall be contained  in a clearly visible ‘How to Play’ section which shall contain for each game the name of the Game, the price of entry, the play symbols, the Prize structure and the odds of winning for each Prize tier.

3.9 Instant Lottery Games are available on a sample basis in “Try Me” mode. When the games are played in this mode the player will not be charged to play the game, neither will any prizes displayed be payable. Players will need to complete the Age Verification Process in order to access ‘Try Me’ mode.

3.10 If a player purchases but fails to complete an Instant Lottery Game for any reason this Instant Lottery Game will be available to resume when the player reconnects to the Health Lottery Computer System.

3.11 An Instant Lottery Game is considered complete when its outcome status in the Health Lottery Computer System shows whether or not a Prize has been won. An Instant Lottery Game is considered incomplete when for any reason it has not been possible, after play has been purchased, to determine whether a Prize has been won or not.  Players will have the opportunity to resume an incomplete game upon reconnecting to the Health Lottery Computer System.

3.12 Any Game purchased but not played shall be completed automatically upon closure of this Game, following a notice to players pursuant to section 3.

3.13 If the Health Lottery Computer System shows an Instant Lottery Game as being complete, its result shall stand and the system record of this shall prevail, whether or not the Player has witnessed the completion of the Game.

3.14 The result of all completed Games will be available in the Player’s account history once logged in to the Website.

4. Player Registration

4.1 Registration requirements  

(a) Any person wishing to play the Health Lottery On-line and or set up a direct debit to play must be located in Great Britain. Players and Direct Debit Players agree that playing the Games after registration whilst located in any jurisdiction other than the Great Britain is strictly prohibited.  The Health Lottery has the right to terminate a Player's Account and withhold any Prize to any Player or Direct Debit Player in respect of any Games played whilst located in any jurisdiction other than Great Britain.

(b) Any person wishing to play the Health Lottery must aged 16 years or older;

(c) Any person wishing to play the Health Lottery On-line must supply their debit card details which must be linked to bank account (or building society) that is based in Great Britain (GB) for which they are an authorised user, and must also be linked to a GB address. Players who supply details of a jointly owned bank accept that Prizes won may be paid into that account.

(d) When registering, the bank card referred to in (c) above must not have been reported as lost or stolen and cannot be used to open any more than one Account;

(e) The Health Lottery reserves the right to exclude persons who do not meet the eligibility criteria set out above. Excluded Persons may also include persons (or category of persons) as the Gambling Commission may specify from time to time or as The Health Lottery, a relevant CIC  and the Gambling Commission may agree from time to time. Any person who enters the Lottery but who does not comply with these T&Cs shall be considered an Excluded Person.

4.1.1 The Health Lottery reserves the right to refuse a Registration at its absolute discretion.

4.1.2 The Health Lottery reserves the right to carry out checks or request information from Players during or after registration to verify that the Players and the information supplied by Players meet the criteria set out in this clause. No Prizes will be paid to a Player if the criteria set out in this clause are not met, or if they are ineligible to play for any reason. In carrying out these checks, personal information provided will be disclosed to a credit reference agency to perform an identity check, this is a verification footprint rather than a credit footprint which cannot, under any circumstances be used in the credit decision process or affect the person’s credit rating.  The check looks only at the existence of the Name, Address and Date of Birth with lenders rather than any current or previous credit information. This will leave a soft footprint on the Player’s credit file for 12 months. These checks will also be conducted when a postal claim is made and in the event our electronic checks cannot verify player details we may request physical documentation such as driving licence or passport to prove eligibility to claim prize.

4.1.3 In order for the Health Lottery to decide whether the Player is eligible to play, the player will need to provide their name, home address details, date of birth, debit card detail and e-mail address.

4.1.4 Once the Health Lottery has verified the information supplied during the Registration process detailed above you will be asked to enter a User Name and Password.

4.1.5 On successful completion of this you will be able to play Games. If the Health Lottery subsequently discovers that a Player was not or is no longer eligible to open an Account, the Health Lottery reserves the right to suspend or terminate that Account.  

4.1.6 The Player is responsible for keeping login details secure. You must inform the Health Lottery immediately of any unauthorised access to your Account. Should a player forget their password, the Player must follow the instruction details on the registration or login page in order to obtain a new password.

4.1.7 By completing registration the Player agrees to indemnify the Health Lottery against all costs, damages, claims, liability, expenses, losses and payments incurred by or awarded against the Health Lottery arising directly or indirectly from the Player’s negligent conduct, omission or malicious use of their account.

5. Payment and Funding of Accounts

5.1. Once registered, you will be able to place £5 as a minimum and £500 maximum into your Account at any one time and in any one transaction.

5.2 The Health Lottery will check at the point that you attempt to place money into your account using the debit card details that you supply whether or not you have sufficient funds in your bank (or Building Society) account,

5.3 You will only be permitted to place a maximum of £500 into your wallet at any time or 24 hour period using your Debit Card.  You will not be permitted to place any more than £2000 into your On-line account. 

5.4 You will be limited to £40 for any one Lottery Draw Game. You will be limited to £500 worth of play on Instant Lottery Games per day. Players may reduce these limits at their discretion. A reduction we take effect immediately, any subsequent increase requested by the player will be subject to a cooling off period.

5.5 You will be only be permitted to withdraw Funds from your on-line account back onto the Debit Card registered with the Health Lottery.  The minimum withdrawal amount is £10 unless your account balance is less than £10 in which case you will be able to withdraw the whole balance.

5.6 Should your debit card be lost or should you wish to change your registered debit card before it has expired you will be required to contact the Health Lottery Contact Centre on 0844 375 5555. Before your new cards details can be added you will need to withdraw any funds in your account. Should your debit card expire you may update your account with the details of your new card through your account on the website.

5.7 A Player may close an Account at any time, at which time the Health Lottery will return any funds to the bank (or building society) account registered on the Health Lottery Computer system, or by other means should that bank account no longer be active for any reason. Players may close their account online using the 'Close Account' function, or alternatively call the Health Lottery Contact Centre on 0844 375 55 55 to confirm the closure of the account verbally. Players will also have the opportunity to self-exclude from a period of 6 months to 5 years. Self Excluded Persons who have excluded themselves using a form in a retail point and notified The Health Lottery of their exclusion may be blocked from playing online. THL reserves the right to retain personal details for its own reasonable purposes after an account is closed. Reasons may include, but are not limited to, compliance with anti-money laundering legislation and any other record keeping requirements for legal or regulatory compliance.

5.8 Direct debit cancellations take up to 5 working days to come into effect. If your next payment collection date is scheduled within 5 working days of your notification to cancel, this payment will still be collected and you will be entered into all draws associated with this payment. If there are more than 5 working days until your next collection date all entries associated with this direct debit will be cancelled and you will not be entered into any subsequent draws. 
5.9 Online entries are final and cannot be cancelled, reversed or refunded once completed.

5.10 In addition to these Terms and Conditions, Health Lottery online play is subject to the Terms and Conditions for Playing the Health Lottery Draw Game and Instant Lottery Game via the Internet and by Direct Debit published on The Health Lottery’s website

6. Operation of Accounts

6.1 The Health Lottery may terminate, vary or suspend the provision of the Games, access to a Player's Account’s without prior notice:-

(a) on breach of these Terms and Conditions, the relevant Game  Rules; or

(b) for maintenance work required to upgrade or update the Health Lottery Computer System; or

(c) if the Health Lottery ceases to offer the Games; or

(d) for any other reason at the Health Lottery's sole discretion.

6.2 On termination of an Account, the Health Lottery will return the Player's Funds to the bank (or building society) account, details of which are held by the Health Lottery on the Health Lottery Computer System in respect of that Player, or return the Funds to the relevant Player by other appropriate means using all reasonable endeavours. In the event that a refund cannot be made the provisions made in Clause 5.3 will apply.

6.3 The Health Lottery’s decisions as to whether or not a Play is a winning Play or in respect of any other matter or dispute arising from the payment or awarding or non-payment or non-awarding of prizes shall be final and binding upon all Players and any other person or persons having any interest in the matter or dispute. In the event of a dispute in respect of a winning Play, Claim Form, or the payment or awarding of any prize, the Health Lottery may withhold payment of the Prize and/or make an equivalent payment into court until the dispute has been resolved. In the case of Instant Lottery Games only the result held on the THL Computer System will be deemed as the final result. If the images displayed on a players screen do not match the record on the Computer System this will be deemed a display error and the result on the Computer System will stand.

6.4 If a Player informs any bank (or building society) that unauthorised use of a debit card has been undertaken in relation to an Account and the bank (or building society) requests that the relevant sums be returned by the Health Lottery to the relevant Player's bank (or building society) account ("Chargeback"), the Health Lottery will suspend the Player's Account and ask the Player to contact the Contact Centre on 0844 375 5555.

6.5 The Health Lottery reserves the right to debit the Player's Account with the amount of the Chargeback together with any funds that the Player has utilised that are subject to that Chargeback. If that debit results in a negative balance in the relevant Player's Account, the Health Lottery reserves the right to recover that balance from the Player at which point the Health Lottery will terminate that Account.

6.6 If an Account becomes Dormant and there are funds on that Account, the Health Lottery may at its discretion, return the Funds, to the bank (or building society) supplied by the Player using the debit card details as held by the Health Lottery .

6.7 It is the responsibility of the Player to ensure that the information supplied to register to play the Health Lottery On-line is kept up to date.

7. Applicable Law

These Rules and Terms & Conditions and the rights and obligations of the Health Lottery, Players and Direct Debit Players set out herein shall be governed by and construed in all respects in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

1. The Game/Promotion

By entering this promotion (“the Promotion”), you agree to be bound by the following terms and conditions (the “T&Cs”).

1.1 The Promotion is open to mainland UK residents aged 16 or over who purchase a Health Lottery ticket for any Saturday draw (excluding QuickWin and Instant Win Games) during February 2018 ("the Promotion Period") (with the exception of employees of The Health Lottery and the Gambling Commission, their immediate families living at the same address, certain contractors of Health Lottery as well as anyone else professionally connected with the promotion).

1.2 The Raffle Draw will take place following each £1.00 Saturday Lottery Draw during February 2018 (the “Promotion Period”); results will be published by the Company via the Health Lottery Website, and selected publications. Each payment transaction for a £1.00 Saturday lottery ticket during the promotion period will generate a unique raffle code (“Hot Ticket Code”) that will be entered into the appropriate Raffle Draw. Where a single transaction is made up of multiple lines, the unique Hot Ticket Code generated shall be applied to each line purchased for a Saturday draw only. This is a free prize draw linked to a lottery and is funded by The Health Lottery ELM. No additional purchase is required. The Raffle Draw will be undertaken by the Company using a random number generator to select a winner from all of the valid Hot Ticket Codes that have been entered in the Lottery Draws held on Saturdays during the Promotion Period. The start and end date of the promotion will be stated on the 'Promotions' tab of the Company's website. The Company reserves the right to end the Raffle Draw promotion at any time. The Company also reserves the right to extend the promotion at its discretion.

2. Method of Play

2.1 All tickets entered into a Saturday £1.00 Lottery Draws during the Promotion Period will be eligible to participate in the Raffle Draw for that particular week. Players will be required to retain their ticket in order to redeem any prizes that are won in the Raffle Draw.

2.2 Online and Direct Debit players will be allocated a Hot Ticket Code per entry into a Saturday draw during the promotion period and this will be included on the email confirmation when the entry is made.

2.3 Only players who fail to match 5 numbers in the appropriate Saturday Health Lottery draw are eligible to win a prize.

3. Winning Selections

3.1 Subject to the Company’s Game Rules and Terms and Conditions, any Player who has not matched 5 numbers from the Saturday draw during the promotion period, and who does match a Hot Ticket Code drawn for that draw, will be eligible to win a prize.

3.2 Players can claim their Raffle Draw Prize up to 180 days after each draw by following the Company’s normal Prize claim process by contacting the Company on 0844 375 55 55* and registering a claim. Subscription Players will automatically receive notification to their registered email account and are also required to contact the Company on the above number to claim their prize.

4. Approximate Odds of Winning
After each Saturday £1.00 Lottery Draw during the Promotion Period a random number generator will be used by the company to select the winning Hot Ticket Code from those which have been assigned to each £1.00 lottery ticket and online entry. The odds of winning a prize will be determined by the total number of entries in each draw.

5. Prize Amounts and Payment of Prizes

5.1 The Hot Ticket prize shall be:

Saturday 3rd February Draw: one prize of £25,000
Saturday 10th February Draw: one prize of £25,000
Saturday 17th February Draw: one prize of £25,000
Saturday 24th February Draw: one prize of £25,000

5.2 Cash Prizes will be administered and processed in line with the Company’s Terms and Conditions and Game Rules.

* Calls to the Company will be charged at 7p per minute plus your telephone provider’s access charge.

 

1. The Game/Promotion

By entering this promotion (“the Promotion”), you agree to be bound by the following terms and conditions (the “T&Cs”).

1.1 The Promotion is open to mainland UK residents aged 16 or over who receive details of this promotion via a Health Lottery affiliate site containing the specific promo code which must be used to take advantage of the offer.  Players must purchase at least £12 of Health Lottery tickets in a single transaction during the Promotion Period (please see 1.2 below) (with the exception of employees of The Health Lottery and the Gambling Commission, their immediate families living at the same address, certain contractors of Health Lottery as well as anyone else professionally connected with the promotion).

1.2 The Promotion will start at 06.00am on Wednesday 15th November 2017 and finish at 23:59pm on Wednesday 31st January 2018 ("the Promotion Period").  

1.3 Players who purchase at least £12 of Health Lottery tickets online will be credited with the equivalent of a 50% bonus (up to a maximum bonus of £10) of the money spent after they spend at least £12 in a single transaction on any Health Lottery draw (excludes online games). The bonus may be used to purchase entries for any Health Lottery draws (excludes online games).  Bonus is fully paid for by The Health Lottery ELM. Offer excludes Retail players and Direct Debit players.

1.4 Bonus credit will expire after 48 hours from the time that it is awarded unless used and bonus credit may not be withdrawn.

1.5 Bonus play is only valid online. Bonus play is not valid for the purchase of an online instant win game and cannot be used in conjunction with other Health Lottery offers or promotions. 

1.6 Entries not complying with these T&Cs will not be valid.

1. Online Cash Raffle Draw Promotions
By entering these promotions (“the Promotion”), you agree to be bound by the following terms and conditions (the “T&Cs”).

2. The Promotion is open to mainland UK residents aged 16 or over who purchase tickets online in accordance with the criteria as defined in the raffle email notification for any £1.00 Health Lottery Draw during the Promotion Period (please see 3. below) (with the exception of employees of The Health Lottery and the Gambling Commission, their immediate families living at the same address, certain contractors of Health Lottery as well as anyone else professionally connected with the promotion).

3. The promotion will start at and end per the time and dates specified on the raffle email notification ("the Promotion Period").  Online entries made for any future draws during this period will qualify for the raffle.

4. The criteria for entry into each raffle is specified in the terms and conditions which appear on the raffle email notification together with details of the prizes on offer and the number of prizes that are available.

5. The Raffle Draw date is the first working day after the end of the Promotion Period which appears on the raffle email notification.  This is a free prize draw linked to a lottery and is funded by The Health Lottery ELM. No additional purchase is required. The Raffle Draw will be undertaken by the Company in the presence of an independent adjudicator and using a random number generator to select a winner from all valid raffle entries that have been entered in the Raffle Draw. The start and end date of the promotion will be stated on the 'Promotions' tab of the Company's website. The Company reserves the right to end the Raffle Draw promotion at any time. The Company also reserves the right to extend the promotion at its discretion.

6. This promotion excludes Retail players however Direct Debit players purchasing tickets by debit card during the promotion period in accordance with the criteria as defined in the raffle email notification will be entered into the draw.

7. Subject to the Company’s Game Rules and Terms and Conditions, any Player who has purchased a Health Lottery ticket online during the Promotion Period will be eligible to win a prize.

8. The winner shall be notified by email and cash prizes will be paid directly into the bank account associated with the winners’ Health Lottery account.  Where possible, vouchers will be emailed directly to winners, whereas physical prizes such as iPhones, iPads etc. will be dispatched within 28 working days of the draw using the Royal Mail Special Delivery service.

The Terms and Conditions (the “T&Cs”) below set out the rules for all Pull Tab Lottery draws (the Lottery) which are promoted and managed by The Health Lottery ELM Limited (“THL”) on behalf of the Community Interest Companies (“CICs”) listed on its website www.healthlottery.co.uk (the “Website”).

THL’s Pull Tab Lottery vending machines, ticket sets and game support services are provided by Gamestec Leisure Limited (“Gamestec”), External Lottery Managers licensed and regulated by the Gambling Commission (www.gamblingcommission.gov.uk) which has issued licence numbers 000-031454-N-312603-003 and 000-031454-R-312602-003.

The Health Lottery Scheme manages 51 society lotteries that operate in rotation and each represents a different geographical region of Great Britain. They operate under the Gambling Act 2005, (“The Act”) each or all being referred to as “The Health Lottery”, depending on the context. Operating this way allows every single part of Great Britain to receive their share of the appropriate proceeds.

Each of the society lotteries is licensed by the Gambling Commission and is promoted by both the Societies and by THL. Each Society is an individual Community Interest Company. Each CIC represents one or more Local Authority areas within England, Scotland and Wales and during the course of each year they will operate a lottery or lotteries for the benefit of their local communities. Different CICs take turns in operating their lotteries to an agreed frequency and proceeds are allocated according to Ticket sales for each CIC that is open. Money is then donated to health related ‘Good Causes’ within their respective local areas.

Players should be aware that all the participating CICs are independent companies. THL will provide a link on its website to each of the individual CICs where information about each of the CICs, the regions they represent and Good Causes they support is available. It should also be noted that the allocation of funds to Good Causes raised by the Health Lottery for the CICs is determined by the relevant CICs and their partner charity, People’s Health Trust and not by THL.

At least 20% of the proceeds of each Lottery shall be paid to health related Good Causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.

All entries into and participation in the Lottery is strictly governed by these T&Cs. By entering the Lottery, a Player agrees to be bound by the T&Cs in force on the day of purchase. THL reserves the right to refuse any entry to the Lottery or to withhold any Prize if it has reasonable grounds to believe that these T&Cs have been breached.

 

2. TERMS & CONDITIONS

These Terms and Conditions are the Pull Tab Lottery terms and conditions. By entering the lottery, entrants agree to be bound by these rules.

 

This lottery is being promoted by both the CICs and by THL and is called The Health Lottery Pull Tab Lottery.

 

For the purpose of the Gambling Act 2005, this lottery is defined as a 'Society Lottery.'

 

This lottery is licensed by the Gambling Commission under the 2005 Gambling Act, and is promoted Donald Macrae, 20 – 22 Wenlock Road, London N1 7GU.


At least 20% of the proceeds of each Lottery shall be paid to health related Good Causes within the territorial boundaries of the participating CIC on whose behalf the Lottery is being promoted.

 

Underage Gambling is an offence, players must be aged 18 (eighteen) years of age or over. The operating agents or premises operating the machines reserve the right to ask for proof of age.
 

Tickets shall be priced at £1.00 and the cost of entry is uniform across all ticket sets.
 

All lottery entry sales are final and no refunds shall be made at any time. All entrants acknowledge that their payment of the entry fee per ticket to enter the lottery does not guarantee that they will win any prize.
 

To accept a prize you must be aged 18 years or over, and we reserve the right to ask for proof of age redeeming any prizes

Prizes, including the top prizes, are subject to availability at time of ticket purchase.


To participate, a person inserts the relevant charge into a gaming machine whereupon a ticket will then be issued, showing the name of the game, and game reference. The tabs are then removed to reveal the game symbols. If the revealed symbols match the winning combinations shown on the tickets then you have won a prize.


A predetermined number of pull tab winning and non-winning tickets are contained in each game.
 

Any valid ticket bearing a winning combination entitles its holder(s) to claim from the authorised retailer who sold the ticket, the prize as detailed on the ticket.
 

For any prize amount of £100 or less, please take your Lottery Ticket to the bar to collect your prize immediately.
 

For prizes over £100, players are required to complete a claim form and post it to: The Lottery Manager, Gamestec Leisure Limited, Low Lane, Horsforth, Leeds, LS18 4ER.  Take your winning Pull Tab Lottery ticket to the bar where bar staff will provide you with a claim form. Full details of the claim process can be found on the claim form itself. Prize payments will be sent to you by recorded mail within 5 working days.  Gamestec holds no responsibility for lost or stolen postal claims. We advise that postal claims are sent via recorded or special delivery.
 

All winning tickets are subject to validation before payment. The operating agents or premises operating the machines reserve the right to ask for proof of age.
 

All prize tickets must be redeemed within 180 days of the lottery expiry date which can be found on the ticket. Prizes not claimed before the expiry date will be deemed to be forfeit and will be allocated to The Health Lottery (ELM) Ltd. as a donation.
 

By accepting the prize, the winner agrees to take part in promotional activity and The Health Lottery (ELM) reserves the right to use the name and address of the winner, their photograph and audio and/or visual recordings of them in any publicity unless prior notification has been received.
 

The Health Lottery (ELM) Ltd shall not be liable to the player for any loss or damage suffered or arising from playing this Lottery.
 

Nothing within these terms and conditions shall create or should be construed as creating any form of contract between any entrant and The Health Lottery (ELM) Ltd.

1. The Game/Promotion

1.3 Eligible players will receive the equivalent of £7 for each weekly £7 spend as a bonus credit into their bonus wallet for each successful direct debit payment. In the first instance your complaint should be registered with us by calling 0844-375 55 55* or e-mail us at help@thehealthlottery where a member of our Customer Services team will endeavour to address the issue and resolve the query or, if you prefer, you may write to us at the address shown below.


* Calls to The Health Lottery Helpline will be charged at 7p per minute plus your telephone provider’s access charge.Lines are open Monday – Saturday between 0900-1730.


If an immediate solution cannot be achieved because further investigation is necessary, we will let you know straight away.


Should our investigation take longer than anticipated, which will only happen if the circumstances are particularly complex, we will explain why and we will make sure you are provided with regular updates.We will not normally allow any complaint to be unresolved for more than 4 weeks, as we will always agree a course of action with you within this time.


Any investigation will be overseen by a specially selected and trained staff member who will stay in contact with you throughout the investigatory period

In the unlikely event that you are still unhappy with how your complaint is being handled or resolved, we have in place an escalation procedure which means that you can request the involvement of an appropriate manager by writing to us the addresses show at the bottom.


If at any time you are unhappy with the progress or outcome of our investigations, please do not hesitate to contact the staff member handling your complaint.


If at the end of this process, you still remain dissatisfied with the outcome further review can be requested and a full review of the dispute and outcome will be conducted by THL Compliance Department.


In the unlikely event you remain dissatisfied with the outcome and subject to your dispute meeting the criteria detailed in the Gambling Commission's Codes of Practice, you may request information from the THL Compliance Department in relation to the process of referring your complaint to an independent adjudicator for further investigation and review.


The independent adjudicator will consider your complaint totally impartially and we are bound by their decision. The request for third party adjudication information should be made in writing to the address shown below.
